RE: Request for Boundary Change - BEDELCO, Inc.
Dear Mayor Kingsford:
Ada County Development Services has received a request on behalf of
BEDELCO, Inc. to remove 10.94 acres from the Meridian Area of City
Impact, so it can be included within the Boise Area of City Tmpact.
The portion that is requested for removal is part of a parcel that
is 74.33 acres in size. The land under discussion is located in
the NE 1/4, Section 16, T3N, R1E and is situated west of S.
Cloverdale Road, south of Franklin Road, and north of Interstate
84. It is bordered by the Ridenbaugh Canal on the west boundary,
which inhibits Meridian from servicing the 10.94 acre portion. The
balance of the parcel is already within the Boise Area of City
Impact and will be serviced by that city.
A copy of a letter written by you to the Board of Ada County
Commissioners is included with the request. It states that the
City of Meridian has no objections to the exclusion of the 10.94
acre parcel from the Meridian Area of City Impact, as the natural
boundary of the Ridenbaugh Canal does inhibit the City's ability to
service the site. It is also clear that the City of Meridian is
not implying that the City is agreeing to amend the Area of Impact
.for all such parcels that are divided by Area of Impact boundaries .
In compliance with Section 9-4-5 of the Ada County Code (Meridian
Area of City Impact, "Renegotiation"), a meeting has been scheduled
for staff members representing the City of Meridian, Boise City,
Ada County, and Briggs Engineering (acting on behalf of the
applicant) staff. The meeting is necessary because the request
will involve an amendment to the Meridian and Boise Area of City
Impact maps. The meeting is scheduled for Friday, September. 11,
1992, at 2:00 p.m., County Building, second floor (Ada County
Development Services). Mr. Jack Niemann has been contacted about
this meeting, and you and the Meridian City Attorney are welcome to
attend as well. I believe this is a straight-forward request and
do not anticipate any controversy with this item.

We are requesting a boundary change along the Boise and Meridian Area of City
Impact boundary. The parcel is located in the NE 1/4, Section 16, Township 3
North, Range 1 East or west of S. Cloverdale Road, south of Franklin Road and
north of Interstate 84. The parcel is 74.33 acres in size of which 10.94 acres lies
within the Meridian Area of City Impact. We have discussed the removal of the
10.94 acres from the Meridian Impact Area with the City of Meridian. Meridian City
Council authorized a letter (Exhibit 3) indicating the City's position on removal of
the 10.94 acres from their impact area and inclusion of it in Boise's Area of City
Impact.
The parcel is bordered by the Ridenbaugh Canal on the west boundary (Exhibit
1). The canal inhibits Meridian from servicing the 10.94 acre portion. Boise Public
Works has indicated that they will not service the 10.94 acres which lies within the
Meridian Area of City Impact, unless it is by agreement included in Boise's Area
of Impact. Since 85.28% of the property lies within the Boise Area of City Impact
and will be serviced by Boise, it is reasonable that the remainder be included.
Preliminary discussions have indicated Boise will accept the property in its impact
area.
BEDELCO, Inc. submitted a rezone and planned residential development
application to Ada County on July 20, 1992. The subdivision plat includes 155
residential lots, 10 open space lots and 1 lot designated as a potential elementary
school and park site.

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City
of Meridian and the laws of the State of Idaho, that the Planning
and Zoning Commission of the City of Meridian will hold a public
hearing at the Meridian City Hall, 33 East Idaho Street, Meridian,
Idaho, at the hour of 7:30 o'clock p.m., on Tuesday, October 13,
1992, for the purpose of reviewing and considering the Application
of BEDELCO, INC., for a boundary change of the Meridian's Area of
Impact along the Boise and Meridian Area of City Impact boundary.
The parcel where the boundary would change is located in the NE
1/4, Section 16, Township 3 North, Range 1 East, Boise Meridian,

Interstate 84. The total parcel consist of 74.33 acres of which
10.94 acres lies within the Meridian Area of City Impact, and
which 10.94 acres the Applicant requests to be excluded from the
Meridian Area of Impact.
A more particular legal description of the above property is
on file in the City Clerk's office at Meridian City Hall, 33 East
Idaho Street, and is available for inspection during regular
business hours.
Any and all interested persons shall be heard at said public
hearing and the public is welcome and invited to submit testimony.

Boundary Change
The Ada County Planning and Zoning Commission has scheduled a
public hearing on the above item for October 8, 1992. The results
of the negotiations .meeting held September 11, 1992, between
representatives of Boise City, Ada County, Meridian, and the
applicant indicated that the development project is worthwhile and
that the Area of Impact boundary should be changed to accommodate
this particular project.
It is understood that the location of the Ridenbaugh Canal makes it
difficult for the City of Meridian to service the site and that it
is more feasible for the City of Boise to extend services to the
property. Therefore, the boundary is proposed to be relocated to
put the proposed development entirely within the Boise Area of City
Impact. At present, 85 percent of the project site is within the
Boise Area of City Impact, and the balance is in the Meridian Area
of Impact. Approval of the boundary change will put the entire
parcel within the Boise City Area of Impact.

NOTICE OF PUBLIC HEARING
On October 8, 1992, at 7:00 p.m., the Ada County Planning and
Zoning Commission will hold a public hearing in the Les Bois Room
of the Boise City Hall, 150 N. Capitol Blvd., to consider an
amendment to the Boise City and Meridian Area of City Impact
Boundary Maps (Section 9-3-1A and Section 9-4-1A, Ada County Code).
The applicant is BEDELCO, Inc.(92-01-ZOA).
The boundary change would remove 10.92 acres from the Meridian Area
of City Impact and place the land within the Boise Area of City
Impact. The area is generally located west of S. Cloverdale Road,
south of Franklin Road, and north of Interstate 84, in the NE 1/4
of Section 16, Township 3 North, Range 1 East. The property is
bordered on the west by the Ridenbaugh Canal.
Further information about the proposed boundary change can be

We are requesting a boundary change along the Boise and Meridian Area of City
Impact boundary. The parcel is located in the NE 1/4, Section 16, Township 3
North, Range 1 East or west of S. Cloverdale Road, south of Franklin Road and
north of Interstate 84. The parcel is 74.33 acres in size of which 10.94 acres lies
within the Meridian Area of City Impact. We have discussed the removal of the
10.94 acres from the Meridian Impact Area with the City of Meridian. Meridian City
Council authorized a letter (Exhibit 3) indicating the City's position on removal of
the 10.94 acres from their impact area and inclusion of it in Boise's Area of City
Impact..
The parcel is bordered by the Ridenbaugh Canal on the west boundary (Exhibit
1). The canal inhibits Meridian from servicing the 10.94 acre portion. Boise Public
Works has indicated that they will not service the 10.94 acres which lies within the
Meridian Area of City Impact, unless it is by agreement included in Boise's Area
of Impact. Since 85.28% of the property lies within the Boise Area of City Impact
and will be serviced by Boise, it is reasonable that the remainder be included.
Preliminary discussions have indicated Boise will accept the property in its impact
area.
BEDELCO, Inc.- submitted a rezone and planned residential development
application to Ada County on July 20, 1992. The subdivision plat includes 155
residential lots, 10 open space lots and 1 lot designated as a potential elementary
school and park site.

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City
of Meridian and the laws of the State of Idaho, that the City
Council of the City of Meridian will hold a public hearing at the
Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 o'clock p.m., on Tuesday, November 17, 1992, for the
purpose of reviewing and considering the Application of BEDELCO,
INC . , for a boundary change of the Meridian' s Area of Impact along
the Boise and Meridian Area of City Impact boundary. The parcel
where the boundary would change is located in the NE 1/4, Section
16, Township 3 North, Range 1 East, Boise Meridian, west of S.
Cloverdale Road, south of Franklin Road and north of Interstate
84. The total parcel consist of 74.33 acres of which 10.94 acres
lies within the Meridian Area of City Impact, and which 10.94
acres the Applicant requests to be excluded from the Meridian Area
of Impact.
A more particular legal description of the above property is
on file in the City Clerk's office at Meridian City Hall, 33 East
Idaho Street, and is available for inspection during regular
business hours.
Any and all interested persons shall be heard at said public
hearing and the public is welcome and invited to submit testimony.

In compliance with he referral process which is part of the Area
of City Impact Agre meet, this letter serves to notify you about
the recent adoption of an amendment to Title 9 of the Ada County
Code. The Board of da County Commissioners voted on December 3,
1992 to approve an endment to change the boundary between the
Boise and Meridian Area of City Impacts, in order to remove 10.94
acres from the Meridian Area of City Impact and place the acres in
the Boise City Area of City Impact.
The amendment was formally adopted as Ordinance 257, and it shall
be published in the Idaho Statesman within 30 days of its approval
date. A copy of the ordinance is attached.

The above entitled Application to amend the Meridian
Comprehensive Plan having come on for public hearing on October
13, 1992, at 7:30 o'clock p.m., and the Planning and Zoning
Commission having heard any and all testimony that was submitted,
including judicial knowledge, and including its knowledge of
existing plans for the areas under consideration and having duly
considered all the evidence, officially noticed evidence and the
facts of the Comprehensive Plan itself, the Local Planning Act of
1975, the Planning and Zoning Commission makes the following:
FINDINGS OF FACT
1. That the Application was submitted by the Applicant
representative, Briggs Engineering and is not an application of
the City of Meridian.
2. That notice of public hearing on the annexation and zoning
was published for two (2) consecutive weeks prior to the said
public hearing scheduled for October 13, 1992, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the October 13, 1992,
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were

made available to newspaper, radio and television stations;
3. That the property included in the application is
described in the application, and by this reference is
incorporated herein; that the property requested to be deleted
from the Meridian Area of Impact and the Urban Service Planning
Area Boundary is 10.94 acres in size; it is a little more than one
quarter of a mile west of Cloverdale Road.
4. That the specific parcel of property to which the
Application applies is now contained within the Meridian Area of
Impact and Urban Service Planning Area but not within the City
Limits of the City of Meridian and is zoned by the County and not
by the City of Meridian.
5. That the western boundary of the parcel is the
Ridenbaugh Canal; that the can is a large can; that it would
inhibit Meridian in attempting to provide services of sewer,
water, fire and police protection to the area.
6. The reasons for the proposed amendments are stated in
the Application.
7. That the Area of Impact Agreements between the City of
Meridian and Ada County states in part as follows:
"That if a parcel under single ownership is divided by the
boundary line of the Meridian Area of Impact and the line
divides such property so that one or both of the parts has
a depth of three hundred feet or less, such part may be
included in the jurisdiction within which the remainder and
larger portion of the property is located"
that the depth of the subject parcel, as measured from the
boundary of the Meridian Area of Impact varies from 0.00 feet to

approximately 575 feet; that the subject parcel is a triangular
piece of property.
8. ,That the parcel is a part of 74.33 acres of land owned
by the Applicant; that Applicant has proposed to develop the
entire parcel to include 155 residential lots, ten open space lots
and one lot designated as a potential elementary school and park
site; that the Applicant represented that if the parcel is, deleted
from the Meridian Area of Impact and the Meridian Urban Service
Planning Area that the City of Boise would provided services to
the parcel.
9. That then Meridian Compr®henaive Plan recognizes that
if it is to be useful and effective it should not be filed away
and should be continually reviewed and updated. The Area of Impact
and Urban Service Planning Areas are integral components of the
Meridian Comprehensive Plan. The recommendations and components
within the Comprehensive Plan should not be interpreted as
unalterable commitments, but rather as a reflection of the best
foreseeable direction at a given point in time.
10. That the ground water in the area where the parcel is
located likely flows towards Meridian or through Meridian.
11. That these findings of fact have been prepared prior to
hearing and the Commission reserves the right to amend these
findings, if necessary, after the hearing.

1. That the procedural requirements of the Local Planning

Act, Title 67, Chapter 65, Idaho Code, including all notice and
hearing requirements have been met; that the Planning and Zoning
Commission has authority to recommend amends to the Comprehensive
Plan, the Area of Impact and the Urban Service Planning Area.
2. That the Application was initiated by the Applicant and
not by the Planning and Zoning Commission.
3. That the Commission may take judicial or official notice
of existing conditions in the City, County and State, and of
governmental actions, policies and ordinances and of its own prior
findings in other land use Applications and those of the City
Council.
4. That the function of adopting, amending, or repealing
a Comprehensive Plan, the Area of Impact or the Urban Service
Planning Area is a legislative function. Burt vs. The City of
Idaho Falls, 105 Idaho 65, 665 P.2d 1075 (1983). That even though
this is a legislative function, the Local Planning Act requires
that Findings of Fact and Conclusions be made for any Application
provided for in the Act.
5. That the Application itself is concluded to be
sufficient.

Plan Amendments that the Plan can be amended to reflect "Good
Planning" and the desires and goals of the citizens and the City
Council and the Planning and Zoning Commission, as the citizens
representatives; that the same reasoning applies to amendments to
the Area of Impact and the Urban Service Planning Area.

7. That since the Area of Impact and Urban Service Planning
Area are parts of the Meridian Comprehensive Plan and the Plan and
the Plan is what it says it is, ie. it is a Plan. The Plan
itself states that it "Summarizes Policies and Proposals and does
not develop detailed site plans". The comment to the Policy
Diagram indicates that the Diagram "is to be used as a general
guide for land use decision-making, not as a legalistic or .literal
and definitive map" . The Plan and its components, therefore
should be liberally construed but still maintained as the
functional guideline for land use decisions; i.e., the Plan
policies and objectives cannot be willingly disregarded when there
is an apparent conflict between the Plan and the proposed use.
The City has the duty to continually plan; that the Commission
treats amendments proposed either by private entities or the City
itself as part of the planning duty and function.
9. That the Commission concludes that the facts presented
and the officially noticed facts are sufficient to amend the Plan.
10. That these conclusions of law have been prepared prior
to hearing and the Commission reserves the right to amend these
conclusions, if necessary, after the hearing.

BOUNDARY BY BEDELCO, INC.: '
Chairman Johnson: I will now open the Public Hearing. Is there
a representative that would like to come forward and address the
commission.
Becky Bowcutt, Briggs Engineering, 1111 S. Orchard, Boise, was
sworn by the attorney.
Bowcutt: I am representing Bedelco tonight for this request.
This particular parcel consists of 74.33 acres. It's under
primary jurisdiction of Ada County and it is split by the Area of
City Impact Boundary for Boise and Meridian. 85.3% of the
property lies within Boise's Area of City Impact. We have
applied with Ada County for 155 residential lot plan development
with ten open space lots consisting of medians. and then, we also
have a potential well site for south county water company. We
have also extended to the Meridian School District and the Boise
Parks Department a site for a school and park. The beauty of our

proposal is that the school and the park would have to purchase
just at cost less acreage than they normally purchase for this
type of usage. The developers have offered to the Parks
Department to provide a buffer which would consist of a berm and
fence along Cloverdale along Interstate 84 would also plant a
variety of grass. They discussed with Meridian School District
if this site was acceptable to them providing services to this
particular parcel and then doing curbing and so forth. Basically
what we~ are coming to you for is this 10.94 acres which consists
of this portion here (shown on map), we cannot get services to it
because Boise will not allow their sewer line to pass the area of
City Impact Boundary. We do have this natural barrier here, the
Ridenbaugh Canal, which runs all the way around the north and
west side of the. property. We met with the Mayor of Meridian,
' Boise Public Works Planning Departments and Jack and everyone
agreed that it only made sense that this portion be excluded from
Meridian's Area of City Impact and Boise be allowed to take that
in. Our request if to remove that from Meridian's City Impact
and to allow Boise to pick it up. Are there any questions?
Crookston: How far does the Ridenbaugh Canal extend to the
south?
Bowcutt: Explained location of Ridenbaugh on map.
Crookston: The Ridenbaugh Canal does that further extend back
into Boise's Area of Impact upon the southern area or does it
extend more into the Meridian Area of Impact?
Bowcutt: Explained on map. At the angle it appears to be coming
back into Meridian's Area of Impact.
Crookston: Do you know whether or not it goes in and out and in
and out of the Area of Impact?
Bowcutt: The Ridenbaugh is zig-zagged all over the County, I
really couldn't tell you I'm sorry.
Crookston: Explained concerns about the Ridenbaugh. What I'm
thinking is that it might be wise to include the whole Canal into
Boise's Area o.f Impact.
Bowcutt: This only involves this particular property and I
believe it was stated that in no way did the City of Meridian
want to stipulate that it would include anything other than just
this.

Giesler: Questioned one of ACHD's requirements. On Findings of
Fact #2, "no direct lot access to this street will be allowed",
I'm not sure that I understand what that means.
Allison: The design of the subdivision itself provides for a
primary right of way into the school. The primary right of way
into the school will be a 50' easement paved road which will not
have any houses fronting it from the Collector status street that
serves that secondary road.
Tolsma: There is two proposed access into this property,
correct ?
Allison: Yes actually there are three.

ITEM #7: D. L. JOHNSON REGARDING PROPERTY ON OVERLAND ROAD:
Crookston: The City had sent Best Western Concrete Products a
letter .stating that the property needed to be screened so that
their facilities would be screened from residential view. There
was apparently some response to that request, Best Western's
Attorney contacted the City Clerk. There were some discussion
between their attorney, Bill Collins and Jack Niemann.
Apparently there was some ultimate misunderstanding as to whether
or not Mr. Collins was supposed to get back to Mr. Niemann or
whether Mr. Niemann was supposed to get back to Mr. Collins. In
any event after the one discussion there was no further
communication. The Council last meeting instructed me to send
Best Western a demand letter to come into compliance, which I
did. I subsequently was contacted by Mr. Lohr, we talked about
it and he told me he was represented by an attorney. I got a
hold of the attorney, he recognized that some type of screening
needs to be done. This was discussed with Mr. Niemann and he
stated you would appear here tonight. Our Ordinance requires a
screening from Industrial to be screened from residential
properties thereto. I guess my inquiry to you is, what do you
feel would be appropriate?
Johnson: I would like to see some sort of landscaping or road
side beautification.
Crookston: Mr. Collins and I discussed some form of landscaping
and shrubbery.
Johnson: I've got other people interested in this also. Berm it
up with different types of plants.

Kingsford: Briefly for the public, this is a subdivision that is
entered on the West side of Cloverdale that because of the
Ridenbaugh Canal making an irregular shape a small portion of
that parcel lands in Meridian's Area of Impact. What they are
requesting is to take that out of Meridian's Area of Impact and
allow it to be developed with Boise's. Any questions the Council
has for Mr. Briggs.
Crookston: The application excludes the canal so that the canal
would remain within Meridian's Area of Impact. Was that ever
addressed with the owners of the property as to if that could be
worked out. It seemed to me that it was more appropriate to have
the jurisdiction of that canal stay with the municipal entity
over which the property that your developing is going to be part
of. Was that ever addressed?
Briggs: That idea was never thought about. Number one the
property on the other side of course will still be Meridian's
Area Impact, so it's either going to be in Meridian's Area of
Impact or Boise's. Control of the canal is really a nebulous
thing, I'm not sure that anybody really wants it.
Kingsford: Is that a deeded parcel?
Briggs: Bedelco's property runs only through the south and the
east side of the canal. They own nothing in the canal right of
way. Our application could not include the canal because we have
no right of ownership that goes with the property on the other
side.
Crookston: I think the Mayor's question is to whether it's a
deeded parcel or an easement?
Briggs: The canal is an easement. (Gave explanation)

cooperative with the Meridian School District and that they are
currently providing for a twelve acre sit e, .which includes a five
