A portion of the site will remain in light industrial zoning to allow business park development. 10. Characteristics of subject property which make a zoning amendment desirable. Bedelco property has been annexed and zoned as I-L in the City of Meridian since 1979. (See Ordinance #329.) The industrial market has changed significantly since 1979 and now small business parcels are needed next to affordable housing. This site is ideal for a planned business and living center. This project will help transition from industrial to residential in the Old Town neighborhood. 11. Necessity or desirability of development pertaining to the zoning amendment and its harmony with adjacent development. Meridian business park development now requires a combination of small, flexible business lots adjacent to affordable housing. Employers and company owners have informed Bedelco and Wayne S. Forrey that Meridian: needs a combination business park and affordable living center to accommodate business needs. 'The fastest growing component of Treasure Valley's economy is small business. Small business cannot afford the traditional large lots found in industrial parks. Small business must also pay minimum wage to new employees. Affordable housing is necessary next to small business so employees can purchase a home and walk or bicycle to work. This concept saves money for both the business and employee. The Bedelco Business and Living Center will meet these needs and help Meridian diversify its tax base. 12. We also find that this subdivision is located in census tract 103.12 and in the attendance zone for Chief Joseph Elementary, Meridian Middle School and Meridian High School. The School District may be required to transport elementary students from this subdivision to Ridgewood Elementary or another school that may have capacity, due to overcrowding at Chief Joseph Elementary. Using the above information we can predict that these homes, when completed, will house 25 elementary aged children, 23 middle school aged children, and 17 senior high aged students. At the present time Chief Joseph Elementary is at 101 of capacity, Meridian Middle School is at 139 of capacity and Meridian High School is at 130 of capacity. The Meridian School District is not opposed to growth in our district,' however this subdivision will cause increased over- crowding in all three schools. There is little opportunity to shift attendance boundaries since the surrounding schools are also well over capacity. Before we could support this subdivision, we would need land dedicated to the district or at least made available at a minimum price for a school site in this area. The site would need water and sewer services available. In addition we would need to pass another bond issue for the construction of schools. Even if we were willing to use portable classrooms for a year or two, this project would require one classrooms at the elementary level, one at the middle school level and one at the high school level. To build portables ready to occupy by students will cost • approximately $40,000 each. As you can see the total for four portables would be $120,000. We would welcome a meeting with you to-find ways of mitigating the projected costs to the school district. The engineers and architects involved with the design of this project should obtain current best management practices for stormwater disposal and design a stormwater management system that is preventing groundwater and surface water degradation. The City of Meridian Comprehensive Plan. has a goal to extend Locust Grove Road over I-84 as a connection from Franklin Road to Overland Road. This would make. Locust Grove Road. a north- south arterial roadway that would provide a straight through connection from Franklin Road to Pine Avenue (abutting subject parcel} as a continuation of the arterial road system. Pine Avenue is proposed to be upgraded from a collector to a minor arterial roadway. The District requirements reflect these changes. 5. The Ada County Ridge-To-Rivers Pathway Plan shows a future pathway along the Union Pacific Railroad which runs along the south boundary of subject parcel. PRELIMINARY PLAT - B~LCO BUSINESS AND LIVING C~ER SUBDIVISION October 17, 1994 Page 3 6. After review by Traffic Services, staff does not see the need for a Traffic Study. The purpose of a traffic study is to determine a project's overall impacts on the nearby roadway system. This project is located adjacent to Pine Street and. Locust Grove Road. Pine Street was recently investigated as a. full corridor study and the entire route was examined and planned. Locust Grove is anew arterial and is also fully planned. The traffic study would therefore not provide any new information. 7. The residential streets of Stonehenge. Street and Idaho Avenue form a convenient cut-thru between Pine Avenue and Locust Grove. Staff recommends the site be reconfigured to eliminate the cut-thru traffic by offsetting the segment of Idaho east of Ralstin Street. 8. The perpendicular parking at the neighborhood park on. Rail- road/Stonehenge is not normally acceptable.- Parallel parking is preferred. However, due. to the low thru traffic volumes, the. proposed parking configuration may be accepted. The fal- lowing parking dimensions are needed: 1. minimum stall depth shall. be 15-feet.. 2. minimum distance from the end of the parking space to the centerline of the roadway shall be 35-feet. 3. The homeowners association shall enter into a held harm- less agreement with ACHD with reference to the perpendicular parking. 9. The site plan indicates. the access to the private. storage area will be from Bedelco Avenue. 10. Locust Grave is scheduled for improvements in the ACRD Five Year Work Program, therefore staff recommends. that. a deposit be made to the Public Rights-of-Way Trust Fund for the re- quired street improvements (5-foot sidewalks) on Locust Grove abutting bath parcels. 11. Staff anticipates that the intersection. of Locust Grove and Pine will be signalized at a yet to be determined time in the future . 12. Ultimately the proposed new Locust Grove will, be constructed. as a 5-lane arterial (4 thru lanes + 1 turn lane.) with a 65- foot back-to-back street section, 5-foot sidewalks and 5-foot planters in 90-feet of right-of-way. Staff recommends that the developer be required to pave 30-feet of paving. 13. Staff recommends that the interior streets be constructed as. 37-foot back-to-back street section with 4-foot. Access-from the commercial lots to Pine Avenue (future arteri- al) and Locust Grove (arterial) will be restricted. The sub- mitted site plan shows an access point on Pine 180-feet west of the Pine/proposed Locust Grove extension and an access paint 180-feet south of the Pine/proposed Locust. Grove exten- sion. The aforementioned access points do not meet. ACHD stan- dards. Staff recommends that the project have two access points. on the Pine Avenue frontage, the nearest access point to the proposed Locust Grove extension shal be a minimum of 230-feet. west of the back of curb on Locust Grove to the near edge of the driveway for a full service driveway. The second access point shall be constructed a minimum distance of 460-feet, near edge to near edge of pavement as measured from the pave- ment of Locust Grove. 15. Staff recommends that access points on the new extension of Locust Grove be located at the following minimums: 1st access: 230-feet south of Pine Avenue 2nd access: 460-feet south of Pine. Avenue 3rd access: 150-feet south of near curb of 2nd access (staff recommends that the road to the residential, development be located here) 4th access: 150-feet south of near curb of 3rd access and 150-feet north of the railroad's right-of-way. 16. Staff recommends that cross access easements be provided far the commercial lots, and be noted and shown on the final plat. 17. The existing Locust Grove Road. will be required to be improved. to a half of a 41-foot street section, as it will be re-classi- fied as a local-commercial road. Four foot sidewalk will. also be required. 18. Staff recommends that the applicant provide a deposit to the Public Rights-Of-Way Trust Fund for 5-foot wide concrete side- walk for the segment of Pine Avenue east of the. Locust Grove Road extended and construct a 5-foot wide concrete sidewalk at the property line west of Locust. Grove extended.. 19. Although the notice is incorrect for what you actually want done, the notice is correct because that is the acreage indicated on the rezone request application form. Now that the City has become aware of what you actually want to do, we can restrict the rezone to the land you actually want rezoned, which apparently is just the portion that you want to have rezoned to R-15. Mr. Crookston stated that the notice is sufficient and that the public hearing may proceed as scheduled for December 15, 1994. There definitely would be a problem if the rezone was wanted for property not included in the 54.45 acres, but the public and adjacent property owners have been adequately put on notice that the rezone has been requested, even though it is for a smaller parcel than indicated, because the property is included within the 54.45 acres. In the event the rezone is granted, it would be granted only for that land to which the legal description pertains. Additionally, in regard to your request for tabling of the preliminary plat, I cannot guarantee that the preliminary plat action will be tabled at the next Planning & Zoning Commission meeting, as that is a decision the P&Z Commission members must make. We also find that this subdivision is located in census tract 103.12 and in the attendance zone for Chief Joseph Elementary, Meridian Middle School and Meridian High School. The School District may be required to transport elementary students from this subdivision to Ridgewood Elementary or another school that may have capacity, due to overcrowding at Chief Joseph Elementary. Using the above information we can predict that these homes, when completed, will house 2.5 elementary aged children, 23 middle school aged children, and 17 senior high aged students. At the present time Chief Joseph Elementary is at 101 of capacity, Meridian Middle School is at 139$ of capacity and Meridian High School is at 130 of capacity. The Meridian School District is not opposed to growth in our district, however this subdivision will cause increased over- crowding in all three schools. There is little opportunity to shift attendance boundaries since the surrounding schools are also well over capacity. Before we could support this subdivision, we would need land dedicated to the district or at least made available at a minimum price for a school site in this area. The site would need water and sewer services available. In addition we would need to pass another bond issue for the construction of schools. Even if we were willing to use portable classrooms for a year or two, this project would require one classrooms at the elementary level, one at the middle school level and one at the high school level. To build portables ready to occupy by students will cost approximately $40,000 each. As you can see the total for four portables would be $120,000. We would welcome a meeting with you to find ways of mitigating the projected costs to the school district. Forrey, AICP, 52 E. Franklin Rd., Boise, ID 83642) FACTS & FINDINGS: 1. Bedelco Business and Living Center is a 54.4-acre, commercial and residential subdivision. The property is located on the south side of Pine and is proposed to be traversed by a new extension/alignment of Locust Grove Road. On the west side of the proposed Locust Grove, there are 120-lots proposed as single family residential and 13-lots as commercial. on 35.6-acres. No development is shown on the east side as part of this application. There are 6,470-feet of new public street proposed, including 1,210-feet of the Locust Grove extension. This application includes a rezone for a portion of the proper- ty from I-L to R-15. 2. The Commission reviewed and approved a preliminary plat for the portion of this subdivision at the southwest corner of Pine and the existing Locust Grove as Cogeneration Power Plant Subdivision on March 2, 1994. The developer has indicated this preliminary plat will not proceed to final. After review by Traffic Services, staff does not see the need for a Traffic Study. The purpose of a traffic study is to determine a project's overall impacts on the nearby roadway system. This project is located adjacent to Pine Street and Locust Grove Road. Pine Street was recently investigated as a full corridor study and the entire route was examined and planned. Locust Grove is anew arterial and is also fully planned. The traffic study would therefore not provide any new information . 7. The residential streets of Stonehenge Street and Idaho Avenue form a convenient cut-thru between Pine Avenue and Locust Grove. Staff recommends the site be reconfigured to eliminate the cut-thru traffic by offsetting the segment of Idaho east of Ralstin Street. 8. The perpendicular parking at the neighborhood park on Rail- road/Stonehenge is not normally acceptable. Parallel parking is preferred. However, due to the low thru traffic volumes, the proposed parking configuration may be accepted. The fol- lowing parking dimensions are needed: 1. minimum stall depth shall be 15-feet. 2. minimum distance from the end of the parking space to the centerline of the roadway shall be 35-feet. 3. The homeowners association shall enter into a hold harm- less agreement with ACRD with reference to the perpendicular parking. 9. The site plan indicates the access to the private storage area will be from Bedelco Avenue. 10. Locust Grove is scheduled for improvements in the ACRD Five Year Work Program, therefore staff recommends that a deposit be made to the Public Rights-of-Way Trust Fund for the re- quired street improvements (5-foot sidewalks) on Locust Grove abutting both parcels. 11. Staff anticipates that the intersection of Locust Grove and Pine will be signalized at a yet to be determined time in the future . 12. Ultimately the proposed new Locust Grove will be constructed as a 5-lane arterial (4 thru lanes + 1 turn lane) with a 65- foot back-to-back street section, 5-foot sidewalks and 5-foot planters in 90-feet of right-of-way. Staff recommends that the developer be required to pave 30-feet of paving. 13. Staff recommends that the interior streets be constructed as 37-foot back-to-back street section with 4-foot (minimum) sidewalks in 50-feet of right-of-way. Reconfigure the site to eliminate the cut-thru traffic by offsetting the segment of Idaho Avenue east of Ralstin Street. Coordinate with District staff. 4. The perpendicular parking lot for the park at the southwest corner of the site shall provide the following: 1. minimum stall depth shall be 15-feet, 2. minimum distance from the end of the parking space to the centerline of the roadway shall be 35-feet, and 3. the homeowners association shall enter into a hold harm- less agreement with ACRD with reference to the perpendicular parking. 5. Access to the private storage area shall be from Bedelco Ave- nue. 6. Construct the extension of Locust Grove Road with 30-feet of paving., 8. Access from the commercial lots to Pine Avenue (future arteri- al) and Locust Grove (arterial) shall be restricted on Pine Avenue. The nearest access point to the proposed Locust Grove extension shall be a minimum of 230-feet west of the back of curb on Locust Grove to the near edge of the driveway for a full service driveway. The second access point shall be con- structed a minimum distance of 460-feet, near edge to near edge of pavement as measured. from the pavement of Locust Grove. 10. Provide design data for proposed access to public streets for review and appropriate action by ACRD. 23. Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when the driveways are not being shared with the adjacent property. 24. Aright-of-way permit must be obtained from ACRD for all street and utility construction within the public right-of- way. All lots need to show scaled dimensions. 4. Landscaped buffer should be provided along westerly side of property to screen adjacent low-density residential area from this development. 5. All proposed or existing utilities including, but not limited to, storm and sanitary sewers, irrigation laterals, ditches, drainage, bridges, culverts, water mains, fire hydrants, streetlights, and their respective profiles need to be shown on the preliminary plat. 6. The proposed parking area cannot be closer than four feet (4') to the road right-of--way. 7. Adjacent platted and unplatted property needs to be properly labeled. 8. This district must also be in such proximity to insure connection to the Municipal Water and Sewer systems of the City of Meridian. Uses incompatible with light industry are not permitted, and strip development is prohibited. 5. Even though R-15 zoning is requested, the Applicant lists the density as 4.4 as the density per acre on the Application for preliminary plat which was submitted in conjunction with this rezone request. 6. That the R-15 Zone requires a minimum of 2,400 square feet per dwelling unit and 50 feet of street frontage; that Wayne Forrey stated that this R-15 request is for 60' wide lots with a minimum of 900 square feet per structure; that the price range will be from $73,000 to $77,000; that they may have detached. garages; that they will be on foundations; that storage space will be provided for RV's, etc; that a neighborhood park along the Five Mile Creek will consist of 2.25 acres. 7. That the subject property has been solely used in the past as vacant ground or as agricultural ground with no development whatsoever. 8. Opal Farrington testified that she, too, is opposed for reasons of alleged. increase in trash and traffic, and would rather see industrial or commercial, because the schools are already over crowded. c. Stephanie Churchman, a representative of Builders Masonry Products testified that Builders Masonry Products is opposed to the rezoning of an industrial property to residential; that Builders Masonry. operates 10 hours daily and sometimes longer in the summer; that the hazards of noise levels, time restrictions, potential property damage and vandalism, will soon hinder our business. d. Melinda Harper, and Helen Sharp testified regarding a screening being provided to muffle noise and light. e. Dwaine Ward, representative of Treasure Valley Homes, stated he was in favor of manufactured housing; that probably 60-70~ would be retired people. 10. That comments were submitted by the Meridian Fire Department, City Engineer, Meridian School District, Ada County Street Name Committee, Central District Health Department, Nampa & Meridian Irrigation District, Idaho Power, the Meridian Planning Director, and the Ada County Highway District. All comments, are by this reference incorporated herein as if set forth in full. 12. That the comments of the Planning Director were to adding FINDINGS OF FACT AND CONCLUSIONS OF LAW _ Page - 4 ~ ! a sectional location of map to the preliminary plat; showing the lots scaled dimensions; landscaped buffer should be provided along the westerly side of the property to screen adjacent low-density residential area from this development; all proposed or existing utilities including, but not limited to, storm and sanitary sewers, irrigation laterals, ditches, drainage, bridges, culverts, water mains, fire hydrants, street lights, and their respective profiles need to be shown on the preliminary plat, that the adjacent platted and unplatted property needs to be properly labeled, that right-of- way and roadway widths need to be shown, that the Applicants submitted .only a partial plat which shows revisions to the I-L area; that required changes should be submitted as a total revision so staff and agencies are not referencing various versions of the plat; that she recommended that the application be tabled and that the Applicant resubmit a complete preliminary plat addressing staff and agency concerns. 13. That comments concerning this application were made by Bruce Freckleton, Assistant to Gary .Smith, City Engineer, that any existing irrigation ditches crossing the property be included in this platting and shall be tiled per City ordinance; that the Nampa & Meridian Irrigation district will need to approve the plans; that a determination of seasonal high ground water elevation needs to be made and a profile of the sub-surface soil conditions; that the preliminary plat map contour lines need to be tied to an established Benchmark; that 250 watt high pressure sodium street lights will be required adjacent to the subdivision's entrances on FINDINGS OF FACT AND CONCLUSIONS OF LAW _ Page - 5 District; that such comments are incorporated herein as if set forth in fu1L. 15. That the following comments are made in the Meridian Comprehensive Plan, LAND USE, 3., industrial policies: 3.3 Access to industrial areas -from collector and local streets will be discouraged. 3.4 Industrial uses adjacent to residential area should not create noise, odor, air pollution, and visual pollution greater than levels normally associated with surrounding residential activities. 3.5 Industrial development should be encouraged to locate adjacent to existing industrial uses. 16. That pursuant to 1i-2-416 L, the City may require a development agreement when property is rezoned. 17. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been followed. CONCLUSIONS 1. That all the procedural requirements of the .Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicants' property. 2. That the City has the authority to take judicial notice of its own ordinances, other governmental statues and ordinances, and of actual conditions existing within the City and state. 3. That the City has judged this Application for a zoning amendment upon the basis of guidelines contained in Section 11-2- 416 of the Revised and Compiled Ordinances of the City of Meridian and upon the basis of the Local Planning Act of 1975, Title 67 Chapter 65, Idaho Code, the Comprehensive Plan of the City of Meridian, and the record submitted to it and the things of which it can take judicial notice. 5. That 11-2-416 A of the Zoning Ordinance states, in part, as follows: "When the public necessity, convenience, general welfare or zoning and development practice require, the Council may amend, supplement, change, or repeal the regulations, restrictions, and boundaries or classifications of property as well as the regulations and provisions of this Ordinance." 6. That 11-2-416 (R) of the Revised and Compiled Ordinances of the City of Meridian sets forth standards under which the City shall review applications for zoning amendments; that upon a review of those requirements and a review of the facts presented and conditions of the area, the Planning and Zoning Commission specifically concludes as follows: (a) The R-15 zoning would not be harmonious with and in accordance with the Comprehensive Plan since the Plan states that industrial development should be encouraged to locate adjacent to existing industrial uses and since the .Plan states that industrial uses should not create noise, odor, air pollution, and visual .pollution greater than levels normally associated with surrounding residential activities, placing a residential use next to an industrial zone likely could inhibit the development of the industrial uses. (b) The area is not intended to be rezoned in the future. (c) The area included in the proposed zoning amendment is intended to be developed in the fashion that would be allowed under the new zoning of R-15 as the Applicant has submitted a FINDINGS OF FACT AND CONCLUSIONS OF LAW _ Page - 8 proposed subdivision plat of the entire area and-it shows development to meet the requested rezoning of R-15, however, the entire area is now zoned light industrial and the R-15 development would not be compatible with the industrial zoning and probable uses. (d ) There have been no recent changes in the area or adjacent area which dictate that the area requested to be rezoned should be so rezoned. (e) That the property, designed in an R-15 fashion and under R-15 requirements and limitations, is designed so as to be harmonious with the surrounding area; however, the R-15 zone is not compatible with the I-L zone. (f) The R-15 zone and its use would not be hazardous to the existing or future uses of the neighborhood and should not be disturbing to the property owners in the adjacent residential areas, but the I-L industrial uses would not be compatible with the R-15 uses. (g) The property would be able to be adequately served with most public facilities. (li) The R-15 zone would not create excessive additional requirements at public cost for public facilities and services but may be detrimental to the I-L industrial development since the industrial uses cannot create noise, odor, air pollution, and visual pollution greater than levels normally associated with surrounding residential activities. (i) The R-15 zone and developments should not involve a use detrimental to the existing residential area or the general welfare of the area, but the I-L industrial uses may involve uses that are detrimental to the R-15 uses. (j) Development in an R-15 fashion should not cause an increase in vehicular traffic over and above what the traffic increase would be if developed as I-L. (k) That a rezone would not result in the destruction, loss or damage of any natural or scenic feature of major importance. (1) The proposed zoning amendment to rezone the land to R-15 from I-L light industria is-not in the best interest of City of Meridian. 7. Stephanie Churchman,~a representative of Builders Masonry Products testified that Builders Masonry Products is opposed to the rezoning of an industrial property to residential; that Builders Masonry operates 10 hours daily and sometimes longer in the summer; that the hazards of noise levels, time restrictions, potential property damage and vandalism, will soon hinder our business. d. Melinda Harper, and Helen Sharp testified regarding a screening being provided to muffle noise and light. e. Dwaine Ward, representative of Treasure Valley Homes, stated he was in favor of manufactured housing; that probably 60-70$ would be retired people. 10. That comments were submitted by the Meridian Fire Department, City Engineer, Meridian School District, Ada County Street Name Committee, Central District Health Department, Nampa & Meridian Irrigation District, Idaho Power, the Meridian Planning Director, and the Ada County Highway District. All comments, are. by this reference incorporated herein as if set forth in full. 12. That the comments of the Planning Director were to adding FINDINGS OF FACT AND CONCLUSIONS OF LAW _ Page - 4 ~ ! a sectional location of map to the preliminary plat; showing the lots scaled dimensions; landscaped buffer should be provided along the westerly side of the property to screen adjacent low-density residential area from this development; all proposed or existing utilities including, but not limited to, storm and sanitary sewers, irrigation laterals, ditches, drainage, bridges, culverts, water mains, fire hydrants, street lights, and their respective profiles need to be shown on the preliminary plat, that the adjacent platted and unplatted property needs to be properly labeled, that right-of- way and roadway widths need to be shown, that the Applicants submitted only a partial plat which shows revisions to the I-L area; that required changes should be submitted as a total revision so staff and agencies, are not referencing various versions of the plat; that she recommended that the application be tabled and that the Applicant resubmit a complete preliminary plat addressing staff and agency concerns. 13. That comments concerning this application were made by Bruce Freckleton, Assistant to Gary Smith, City Engineer, that any existing irrigation ditches crossing the property be included in this platting and shall be tiled per City ordinance; that the Nampa & Meridian Irrigation district will need to approve the plans ; that a determination of seasonal high ground water elevation needs to be made and a profile of the sub-surface soil conditions; that the preliminary plat map contour lines need to be tied to an established Benchmark; that 250 watt high pressure sodium street lights will be required adjacent to the subdivision's entrances on FINDINGS OF FACT AND CONCLUSIONS OF LAW _ Paae - 5 E. Pine Avenue and N. Locust Grove Road; that a master street drainage plan which includes the method of disposal and approval .from the affected drainage district needs to be provided; that the Ada County Street Name Committee, approving the subdivision name and street names needs to be submitted; that existing domestic wells and/or septic systems will have to be removed, except wells that may be used for non-domestic purposes such as irrigation; that information detailing the traffic impact on existing or adjacent roadways & intersections needs to be submitted; that Lot 16 Block 3 and Lot 9 Block 4 are not considered "Flag Lots" and shall have a minimum street frontage of 40 feet measured on the chord; that Lot 19 & 22 Block 4 shall have a minimum street frontage of 50 feet; that any existing FEMA Flood Plain Boundaries on the .preliminary plat map need to be indicated and/or any plans to reduce said boundaries; that Applicant needs to submit the proposed restrictive covenants and/or deed restrictions for review; that all comments, are by this reference incorporated herein as if set forth in full. 14. That the comment from the Ada County Highway District regarding this application was a request to defer action on the preliminary plat; that the ACRD is in the process of resolving several access and alignment conflicts that may significantly impact the configuration of the plat; that comments were also received from the Meridian police and fire department, Meridian School District, Ada County Street Name Committee, Central district Health Department, Idaho Power and Nampa & Meridian Irrigation FINDINQS OF FACT AND CONCLUSIONS OF LAW _ Page - 6 • District; that such comments are incorporated herein as if set forth in full. 15. That the following comments are made in the Meridian Comprehensive Plan, LAND USE, 3., industrial policies: 3.3 Access to industrial areas from ,collector and local streets will be discouraged. 3.4 Industrial uses adjacent to residential area should not create noise, odor, air pollution, and visual pollution greater than levels normally associated with surrounding residential activities. 3.5 Industrial development should be encouraged to locate adjacent to existing industrial uses. 16. That pursuant to 11-2-416 L, the City may require a development agreement when property is rezoned. 17. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicants' property. 2. That the City has the authority to take judicial notice of its own ordinances, other governmental statues and ordinances, and of actual conditions existing within the City and state. 3. That the City of Meridian has authority to place conditions upon granting a zoning amendment. FINDINGS OF FACT AND CONCLUSIONS OF LAW _ Page - 7 • 4. That the City has judged this Application for a zoning amendment upon the basis of guidelines contained in Section 11-2- 416 of the Revised and Compiled Ordinances of the City of Meridian and upon ,the basis of the Local Planning Act of 1975, Title 67 Chapter 65, Idaho Code, the Comprehensive Plan of the City of Meridian, -and the record submitted to it and the things of which it can take judicial notice. 5. That 11-2-416 A of the Zoning Ordinance states, in part, as follows:. "When the public necessity, convenience, general welfare or zoning and development practice require, the Council. may amend, supplement, change, or repeal the regulations, restrictions, and boundaries or classifications of property as well as the regulations and provisions of this Ordinance." 6. That 11-2-416 (R) of the Revised and Compiled Ordinances of the City of Meridian sets forth standards under which the City shall review applications for zoning amendments; that upon a review of those requirements and a review of the facts presented and conditions of the area, the Planning and Zoning Commission specifically concludes as follows: (a) The R-15 zoning would not be harmonious with and in accordance with the Comprehensive Plan since the Plan states that industrial development should be encouraged to locate adjacent to existing industrial uses and since the Plan states that industrial uses should not create noise, odor, air pollution, and visual pollution greater than levels normally associated with surrounding residential activities, placing a residential use next to an industrial zone likely could inhibit the development of the industrial uses. (b) The area is not intended to be rezoned in the future. (c) The area included in the proposed zoning amendment is intended to be developed in the fashion that would be allowed under the new zoning of R-15 as the Applicant has submitted a FINDINC3S OF FACT AND CONCLUSIONS OF LAW _ PBQe - 8 proposed subdivision plat of the entire area and it shows development to meet the requested rezoning of R-15, however, the entire area is now zoned light industrial and the R-15 development would not be compatible with the industrial zoning and probable uses. (d) There have been no recent changes in the area or adjacent area which dictate that the area requested to be rezoned should be so rezoned. (e) That the property, designed in an R-15 fashion and under R-15 requirements and limitations, is designed so as to be harmonious with the surrounding area; however, the R-15 zone is not compatible with the I-L zone. (f) The R-15 zone and its useRwould not be hazardous to the existing or future uses of the. neighborhood and should not be disturbing. to the property owners in the adjacent residential areas, but the I-L industrial uses would not be compatible with the R-15 uses. (g) The property would be able to be adequately served with most public facilities. (h) The R-15 zone would not create excessive additional requirements at public cost for public facilities and services but may be detrimental to the I-L industrial development since the industrial uses cannot create noise, odor, air pollution, and visual pollution greater than levels normally associated with surrounding residential activities. (i) The R-15 zone and developments should not involve a use detrimental to the existing residential area or .the general welfare of the area, but the I-L industrial uses may involve uses that are detrimental to the R-15 uses. (j) Development in an R-15 fashion should not cause an increase in vehicular traffic over and above what the traffic increase would be if developed as I-L. (k) That a rezone would not result in the destruction, loss or damage of any' natural or scenic feature of major importance. (1) The proposed zoning amendment to rezone the land to R-15 from I-L light industria is not in the best interest of City of Meridian. 7. That it is concluded that the Application to rezone a portion of the property from I-L Light Industrial to R-15 FINDINGS OF FACT AND CONCLUSIONS OF LAW _ Pag__.__e-9 • Residential should be denied.
