Conditions of Approval: Project is subject to all current City of Meridian ordinances and annexations (AZ -06-
065, AZ -07-010), preliminary plats (PP -07-007, PP -07-012), final plats (FP -07-027, FP -07-033), development
agreements (DA -107099628, DA -107134668), CZC-07-259 (concept plan for the parking lot, drive aisles
and building locations) and all other applications approved for this site. The issuance of this CZC does not
release the applicant from any previous requirements of the other permits issued for this site.
Landscape Plan: The Landscape Plan prepared by The Land Group, dated January 3, 2008, labeled L 1.0, is
approved (stamped "Approved" on January 31, 2008 by the Meridian Planning Department) with no changes.
The approved landscape plan is not to be altered without prior written approval of the Planning Department.
No field changes to the landscape plan permitted; prior written approval of all material changes is required.
Prior to final inspection and sign off for this project, a written certificate of completion shall be
submitted to the Planning Department, prepared by a landscape architect, landscape designer or
qualified nurseryman responsible for the landscape plan upon completion of the landscape installation.
The Certificate of Completion shall verify that all landscape improvements, including plant materials
and sprinkler installation, are in substantial compliance with the approved landscape plan.
Site Plan: The Site Plan prepared by Horrocks Engineers, dated October 18, 2007, labeled Retail A Layout is
approved (stamped "Approved" on January 25, 2008 by the Meridian Planning Department) with the following
changes (see redline changes on site plan): 1) Provide one bicycle parking space for every twenty five (25)
vehicle parking spaces provided on this site (see UDC 11 -3C -6G); 2) Provide a minimum 5 -foot
sidewalk adjacent to the drive aisle on the eastside of the proposed building in accordance with UDC 11-
3A -17A. Except for the changes mentioned above, the approved site plan is not to be altered without prior
written approval of the Planning Department.
Elevations: This project complies with the Design Review requirements of UDC 11-3A-19.The Elevations
prepared by VCBO Architecture, dated December 5, 2007, labeled A2.1 and A2.2 are approved with no
changes from the Planning Department.
Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the
approved specifications and in accordance with UDC 11-3A-15.
Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with
the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the
Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the
existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11-
3B -10-C.5.
Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-3C and 11-313.
Project engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to the
Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA
and signed accessible.
Curbing: Per UDC 11 -3B -5I, all landscape areas adjacent to driveways, parking lots, or other vehicle use
areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to
allow for storm water runoff.
Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed
prior to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and
shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18.
Li htin : Lighting shall not cause glare or impact the traveling public or neighboring development and
comply with lighting standards as defined in UDC 11-3A-11.
Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in
compliance with UDC 11-3D.
Trash Enclosure: Trash enclosures shall be built in the location and to the size approved by SSC. All
dumpster(s) must be screened in accordance with UDC -11-3A-12.
Handicap -Accessibility: The structure, site improvements and parking areas must be in compliance with all
federal handicap -accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any
changes must be made to the site plan to accommodate the ACRD requirements, a new site plan shall be
submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of
Occupancy. All changes in occupancy need to comply with the requirements of the Building Department. It is
unlawful to use or occupy any building or structure until the Building Official has issued a certificate of
occupancy. A certificate of occupancy or temporary certificate of occupancy is obtained from the Building
Department (208) 887-2211 after inspections are complete and the field inspection record is returned to the
Building Department.
Plan Modifications: Except for the changes mentioned above, the approved Site Plans and Elevations, stamped
"Approved" on January 31, 2008, are not to be altered without prior written approval' of the Planning
Department. No significant field changes to the site or landscape plans are permitted; prior written approval of
all changes is required.
Note: If the plat for the subdivision in which this property lies has not been recorded, all subdivision
improvements shall be installed prior to occupancy of the first structure in the subdivision.

panels, or prefabricated steel panels are prohibited except as accent materials.
3. Parking Lots: No more than 70% of the off-street parking area for the structure shall be located
between the front fapade of the structure and abutting streets, unless the principal building(s) and/or
parking is/are screened from view by other structures, landscaping and/or berms.
4. Pedestrian walkways:
a. A continuous internal pedestrian walkway that is a minimum of eight feet in width shall be
provided from the perimeter sidewalk to the main building entrance. The walkway width shall
be maintained clear of any outdoor sale displays, vending machines, or temporary structures.
b. The internal pedestrian walkway shall be distinguished from the vehicular driving surfaces
through the use of pavers, colored or scored concrete, or bricks.
c. Walkways at least eight feet in width, shall be provided for any aisle length that is greater than
150 parking spaces or 200 feet away from the main building entrance.
d. The walkways shall have weather protection (including but not limited to an awning or arcade)
within 20 feet of all customer entrances.

Timberline Surveying, on behalf of Ahlquist Development, LLC, is requesting Certificate of
Zoning Compliance review and Design Review for a retail building to be located on the future
Lot 1, Block 3, Gardner -Ahlquist Gateway No. 1, and Lot 10, Block 3, Gardner -Ahlquist
Gateway South, formerly Lots 7 & 9, Block 5, of the Montvue Park Subdivision.
The project consists of a multi -tenant, approximately 20,000 square -foot retail building. Ample
parking is provided. Only 41 stalls are required per the UDC; the developer will provide 44
stalls on-site. Additionally, this CZC application proposes over 20,000 square feet of
landscaping, equivalent to 1/3 of the size of the subject lot.

Design Review Narrative for Retail Building A
This 20,000 square -foot building is designed in an `L' shape. The center feature is a hexagon -
shaped space that is.flanked by two wings of retail spaces. The finishes are E.F.I.S. and a stone
veneer that is used as a column element. Each retail space is identified by a variety of parapets
that vary in height, shape, and color. The height of the parapets are designed to screen off the
views of the mechanical equipment on the roof. The E.I.F.S. consists of five different colors that
are used to separate the retail spaces and to compliment the stone veneer. The roof of the
hexagon space is a pre -finished standing -seam metal roof. Metal awnings that vary in shape are
also pre -finished standing -seam metal roofs. This building offers a wide variety of colors,
textures, and materials.

conditions and requirements also apply to MCZC-08-005/DES-08-003.
• Prior to final approval you will need to submit construction plans to the ACHD
Development Review Department to insure compliance with the conditions identified above
or for traffic impact fee assessment. This is a separate review process that requires direct
plans submittal to the Development Review staff at the Highway District.
• A traffic impact fee will be assessed by ACHD and will be due prior to the issuance of a
building permit. Contact ACHD Planning & Development Services at 387-6170 for

Request for Appeal of Staff Decision
Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the
final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not
properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error
of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or
enforcement of the ACHD Policy Manual.
a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged
the applicant for the processing of appeals, to cover administrative costs.
b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary
of Highway Systems, which must be filed within ten (10) working days from the date of the
decision that is the subject of the appeal. The notice of appeal shall refer to the decision
__being appealed, -identify -the appellant by name, address and telephone_ number and state
the grounds for the appeal. The grounds shall include a written summary of the provisions
of the policy relevant to the appeal and/or the facts and law relied upon and shall include a
written argument in support of the appeal. The Commission shall not consider a notice of
appeal that does not comply with the provisions of this subsection.
c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of
the filing of the notice of appeal to reply to the notice of the appeal, and may during such
time meet with the appellant to discuss the matter, and may also consider and/or modify
the decision that is being appealed. A copy of the reply and any modifications to the
decision being appealed will be provided to the appellant prior to the Commission hearing
on the appeal.
d.. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal
will be noticed and scheduled on the "Commission agenda at a regular meeting to beheld
within thirty (30) days following the delivery to the appellant of the ROWDS Manager's
reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal
and the reply shall be delivered to the Commission at least one (1) week prior to the
hearing.
e. Action by Commission: Following the hearing, the Commission shall either affirm or
reverse, in whole or part, or otherwise modify, amend or supplement the decision being
appealed, as such action is adequately supported by the law and evidence presented at
the hearing.

9. Capital Improvements Plan/Five Year Work Program
The following improvements are scheduled in the District's Five Year Work Plan.
• Franklin Road between Touchmark Way and Five Mile Road is scheduled to be widened to
5 -lanes in 2009.
• The intersection of Franklin Road and Cloverdale Road is scheduled to be widened to 7 -
lanes on the north leg, 6 -lanes on the south leg, 9 -lanes on the west leg, and 8 -lanes on the
east leg, and signalized in 2009.
The following improvement is scheduled in the District's Capital Improvement Plan (CIP).
• Franklin Road between Eagle Road and Cloverdale Road is scheduled to be widened to 7 -
lanes in 11 to 20 years.
B. Findings for Consideration
Traffic Impact Study
A traffic impact study for Meridian Gateway was prepared by Horrocks Engineers. Below is a
summary of the findings.
o The Meridian Gateway Development is planned to be located south of Franklin Road
and east of Eagle Road in Meridian, Idaho. The intersections counted were Eagle
Road/Franklin Road, Eagle Road/St. Lukes Drive, and Touchmark Way/Franklin Road.
o The. Meridian Gateway consists of approximately 160,000 sq. ft. of general offices, ,
75,000 sq. ft. of medical offices, 34,000 sq. ft. of retailers and one hotel.
o The site proposes one right-in/right-out only access on Eagle Road, one full access on
Franklin Road and one full access on St. Luke's Drive. Under full build conditions the
development is expected to generate 7,210 new daily trips. Of these trips 449 will occur
during the AM peak hour and 685 will occur during the PM peak hour.
o During the existing AM peak hour the Eagle Road/Franklin Road intersection operates at
LOSC and Eagle Road/St. Luke's Drive and Franklin Road/Touchmark Way
intersections operate at LOS B. During the existing PM peak hour the Eagle
Road/Franklin Road intersection operates at LOS D, the intersection of Eagle Road/St.
Luke's Drive operates at LOS C, and the intersection of Franklin Road/Touchmark Way
operates at LOS B.
Gardner -Ahlquist Gateway Subdivision
• The pass -by and internal capture percentages are consistent with ITE procedures.
2. Eagle Road
Staff Comment/Recommendation: Eagle Road is under the jurisdiction of the Idaho
Transportation Department (ITD). The applicant, the City of Meridian, and ITD should work
together to determine if additional right-of-way or improvements are necessary on Eagle Road.
3. Franklin Road
Right -of -Way Policy: District policy requires 96 -feet of right-of-way on arterial roadways (Figure
72-F1 B). This right-of-way allows for the construction of a 5 -lane roadway with curb, gutter, 5 -foot
concrete detached sidewalks and bike lanes.
Sidewalk Policy: District policy requires 7 -foot wide attached (or 5 -foot detached) concrete
sidewalk on all collector roadways and arterial roadways (7204.7.2).
Applicant's Proposal: The applicant has proposed to dedicate additional right-of-way along
Franklin Road abutting the site.
Staff Comment/Recommendation: The applicant will be required to dedicate 60 -feet of right-of-
way from the centerline Franklin Road abutting the site. The 60 -feet of right-of-way will
accommodate the road widening project scheduled in the District's Capital Improvement Program.
The applicant will not be required to construct a sidewalk with this application, as it already exists.
Franklin Road between Eagle Road and Touchmark Way is on a 5 -year no cut moratorium until
2010, due to its reconstruction in 2005. Submit all pavement cut requests to Chuck Rinaldi at 387-
6258. Additionally, Franklin Road is scheduled to be chip -sealed in 2007. Any work (pre -approved
though cut panel) will need to be completed prior to the chip -seal operation or contact District
Maintenance and Operations to the delay the chip -seal process.
4. Internal Streets
Right -of -Way Policy: District policy requires 54 -feet of right-of-way on industrial/commercial
roadways (Figure 72-F1 B). This right-of-way allows for the construction of a 3 -lane roadway with
curb, gutter and 5 -foot wide concrete sidewalks.
40 -foot Street Section Policy: District policy 7202.8 and 72-F1A, requires roadways abutting
commercial developments to be constructed as a 40 -foot street section with curb, gutter and 5 -foot
concrete sidewalk within 54 -feet of right-of-way.
Applicant Proposal (Internal streets): The applicant is proposing to construct the internal streets
as a 40 -foot street section with two 20 -foot travel lanes, vertical curb, gutter, and 5 -foot concrete
sidewalks within 54 -feet of right-of-way. One of the new internal streets (E. Louise Drive) is
proposed to tie into existing E. Louise Drive, a stub street which was constructed as part of
Touchmark Living Center Subdivision. This roadway connection provide access to the signal at
Touchmark and Franklin Road.
The applicant has proposed to tie into one other existing loop roadway (N. Montvue Drive), located
approximately 340 -feet east of the west property line (measured property line to centerline). The
loop road (N. Montvue Drive) is then proposed to terminate with a temporary turnaround easement
on lot 2. The section of N. Montvue Drive located north of the temporary turnaround is proposed to
be vacated, approximately 220 -linear feet.

installation of a root barrier. The policy also requires Class I and Class III trees to provide a
minimum planter width of 10 -feet.
7. Other Access
Eagle Road and Franklin Road are classified as principal arterial roadways. Other than the access
specifically approved with this application, direct lot access is prohibited to these roadways and
should be noted on the final plat.
C. Special Notice to the City of Meridian
All of the identified roadway and transportation mitigation proposals in the submitted Traffic Impact
Study are either not in any public agency plans to construct (ACHD & ITD) or proposed by the
applicant to be constructed.- Therefore, the impacts of this development cannot be adequately
mitigated and surrounding intersections will not operate at an acceptable level of service.
D. Site Specific Conditions of Approval
Comply with requirements of ITD and City of Meridian for the Eagle Road frontage. Submit to the
District a letter from ITD regarding said requirements prior to District approval of the final plat or
issuance of a building permit (or other required permits), whichever occurs first. Contact the District
IH f Traffic Engineer at 334-8340.
2. Dedicate 60 -feet of right-of-way from the centerline Franklin Road abutting the site.
3. Construct the internal streets as a 40 -foot street section with two 20 -foot travel lanes, vertical curb,
gutter, and 5 -foot concrete sidewalks within 54 -feet of right-of-way, as proposed.
4. Construct one temporary turnaround on lot 2, as proposed.
5. Submit a vacation application for the existing right-of-way on N. Montvue Drive to be vacated or
exchanged. If the vacation/exchange is not approved by the District through the separate process,
the applicant will be required to improve the existing roadways to current public street standards
6. Construct one roadway (E. Louise Drive) to intersect Eagle Road located approximately 200 -feet
north of the south property line (measured property line to centerline).
Construct one roadway to intersect Franklin Road located approximately 360 -feet west of the east
property line (measured property line to centerline). Design and install a median to construct on
Franklin Road that will restrict this roadway to left-in/right-in/right-out only.
Other than the access specifically approved with this application, direct lot access is prohibited to
Eagle Road and Franklin Road and shall be noted on the final plat.
9. Comply with all Standard Conditions of Approval.

Any existing irrigation facilities shall be relocated outside of the right-of-way.
2. Private sewer or water systems are prohibited from being located within any ACHD roadway or
right-of-way.

F. Conclusions of Law
1. The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval
are satisfied.
2. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular transportation system within the vicinity impacted by the
proposed development.

Horrocks Engineers, on behalf of Gardner -Ahlquist Development is requesting CZC Modification
and Alternative Compliance for Retail "A". This CZC application CZC-08-005; DES -08-003 was
approved on January 31, 2008, with a subsequent modification approved on July 14, 2008. The
Retail "A" building is located on Lot 1, Block 3 of the Gardner -Ahlquist Gateway Subdivision No.
1 as recorded in Book 100, Page 12936 records of Ada County. This property is located in the
Northwest 1/4 of the Northwest 1/4 of Section 16, T3N, R1E, B.M, Meridian, Ada County.
The purpose of the modification is to accommodate the expansion of a patio on the west side of the
building, along Eagle Road. Recently, a CZC with Alternative Compliance was approved in the
Retail "A" building for Smashburger, LLC that allowed patio expansion on a portion of the west
side of Retail "A". With this application, the applicant proposes to continue the patio expansion
north, along the remaining portion of the building between the Smashburger site and Buffalo Wild
Wings. The patio will be a valuable amenity to potential tenants allowing them to showcase their
business and will add pedestrian scale and usability to the west side of the building.
Because approximately 341 sq. ft. of the proposed patio expansion will encroach into the 35'
landscape buffer along the west side of the building, the applicant is requesting alternative
compliance in the form of patio improvements and increased landscaping. The patio is proposed to
be improved to the same aesthetic standards as the adjoining Smashburger patio. Decorative patio
railing identical to what was installed at Smashburger, will also be continued along the proposed
expansion to create continuity and uniformity.
The existing landscaping will be relocated to the edge of the expanded patio and additional
landscaping consisting of decorative shrubs will be installed to mitigate for the lawn area that is lost
with the patio expansion.

Enclosed is the submittal for the Buffalo Wild Wings Grill and Bar that will be
going into the Portico Shopping Center. Included in this submittal are the
required drawings as specified on the submittal checklist.
This project is a tenant fit in an existing building shell. There will be a patio
addition and the exterior will be painted in order to adhere to the Buffalo Wild
Wings corporate requirements. Signage will be added as well as LED lighting
as part of the trade dress package. The included site plan and landscape plan
are from the shell building civil engineer and landscape consultant,
respectively. No other alterations to the building exterior will be made nor will
the building footprint change.
Not included in the submittal is the affidavit of legal interest form. That form will
be provided by either Kari Davis or Tom Ahlquist, who are the owner's of the
project.

Elevations: This project complies with the Design Review requirements of UDC 11-3A-19.The Elevations prepared by
VCBO Architecture, dated December 5, 2007, labeled A2.1 and A2.2 are approved with no changes from the Planning
Department.
The revised elevations Prepared by Intertech Design Services, dated April 24, 2008, labeled ELV 1 and ELV 2 are
approved with no changes from the Planning Department. The approved elevations are for the Buffalo Wild
Wines portion of the building only.
Irri ag tion An underground, pressurized irrigation system must be installed to all landscape areas per the approved
specifications and in accordance with UDC 1 13A- 15.
Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree
Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks Department
Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to
construction. Any severely damaged tree must be replaced in compliance wit UDC 11 -3B -10-C.5.
Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-3C and 11-3B. Project
engineer/architectshall certifythat the number and size of handicap -accessible spaces conforms to the Americans with
Disabilities Act (ADA). Handicap accessible stalls must have signage in accordancqDer ADA and signed accessible.
Curbing: Per UDC ll-3B-5I,all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be
protected by curbing, w1Eel stops, or other approvedprotective devices. Curbing may be cut to allow for storm water
runoff.
Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to
occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be
designed in compliance with UDC 11-3B-11 and UDC 11-3A-18.
Lighting: Lighting shall not cause glare or impact the traveling public or neighboring development and comply
with lighting standards as defined in UDC 13A-11.
Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance
with UDC 11-3D.
Trash Enclosure: Trash enclosures shall be built in the location and to the size approved by SSC. All dumpster(s)
must be screened in accordance with UDGl1-3A-12.
Handicap -Accessibility. The structure, site improvements and parking areas must be in compliance with all federal
handicap -accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must
be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of
Meridian Planning staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy.

Note: If the plat for the subdivision in which this property lies has not been recorded, all subdivision
improvements shall be installed prior to occupancy of the first structure in the subdivision.
