Conditions of Approval: Project is subject to all current City of Meridian ordinances and annexation and
zoning (AZ -04-034), Conditional Use Permit (CUP -04-052), Preliminary Plat (PP -04-043), and Final Plat (FP -
05 -03 1) applications associated with this site, if applicable. The issuance of this CZC does not release the
applicant from any previous requirements of the other permits issued for this site.
Landscqping: The Landscape Plan prepared by The Land Group, Inc., labeled FPL -1 is approved (stamped
"Approved" on January 25, 2008 by the Meridian Planning Department) with the following changes/notes:
1) Per the standards in UDC 11 -3B -8C plant three trees in the 5 -foot wide Ian dscape buffer
ad* acent to the east side of the parking lot (see redlines on plan),
Other than the above-mentioned changes, the approved landscape plan is not to be altered without prior written
approval of the Planning Department. No field changes to landscape plan permitted; prior written approval of
all material changes is required. Prior to final inspection and sign off for this project,, a written certificate of
completion shall be submitted to the Planning Department, prepared by a landscape architect, landscape
designer or qualified nurseryman responsible for the landscape plan upon completion of the landscape
installation. The Certificate of Completion shall verify that all landscape improvements, including plant
materials and sprinkler installation, are in substantial compliance with the approved landscape plan.
Site Plan: The Site Plan prepared by Teal Architects, P.A., labeled sheet Al -1, is approved (stamped
"Approved" on January 25, 2008by the Meridian Planning Department) with the following changes (see
redline changes on site plan):
1) Per UDC 11 -3C -5C and 11 -3C -6G install a minimum one park bike rack near the entrance.
2) Install ADA signage on th2 west side of the parking area as appropriate(see redlines on plan);
3) Install a drop-off/pick-up area only sign on the west side of the garage (see red.fines on plan);
4) The proposed basketball area is not approved with this CZC and shall not be installed (see
redlines on plan).
Ex . cept for the changes mentioned above, the approved site plan is not to be altered without prior written
approval of the Planning Department.
Elevations: The Elevations prepared by LKV Architects, labeled Sheet A-5.1 are approved with no changes
from the Planning Department.
Alternative Compliance: Teal Architects, P.A., has requested alternative compliance from UDC standard I I -
3C -6B, which requires 1 parking space for every 500 square feet of gross floor area for non-residential uses in
a residential district. The applicant would be required to construct 12 total parking spaces on this site. The
applicant has requested to construct 8 total parking stalls in lieu of the 12 required stalls. UDC 11-3C-7AI
allows for the director to approve an alternative if there are convenient pedestrian connections between
separate properties and the properties/uses are within 1,000 feet of each other. The site provides pathways and
sidewalks to the neighboring residential subdivision and is within 1,000 feet of the neighboring residential
properties. Therefore, the Director has approved the applicant's alternative compliance request.
Irrigatio : An underground, pressurized irrigation system must be installed to all landscape areas per the
approved specifications and in accordance with UDC 11 -3 A- 15.
Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with
the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the
Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the
existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11 -
3B -10-C.5.
Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-3B. Project
engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to the
Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA
and signed accessible.
Curbin : Per UDC 11-313-51, all landscape areas adjacent to driveways, parking lots, or other vehicle use
areas, must be protected by curbing, wheel stops, or other approved protective devices. C urbing may be cut to
allow for storm water runoff.
Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed
prior to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3: 1, shall be fully . vegetated, and
shall be designed in compliance with UDC 11-313-11 and UDC 11-3A-1 8.
Lightin : Lighting shalt not cause glare or impact the traveling public or neighboring development and
comply with lighting standards as defined in UDC 11-3A-11.
Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in
compliance with UDC 11 -31).
Trash Enclosure: All dumpster(s) must be screened in accordance with UDC -1 1-3A-12. Trash enclosures
must be built in the location and to the size approved by SSC.
Handicqp-Accessibilily: The structure, site improvements and parking areas must be in compliance with all
federal handicap -accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any
changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be
submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of
Occupancy. All changes in occupancy need to comply with the requirements of the Building Department. It is
unlawful to use or occupy any building or structure until the Building Official has issued a certificate of
occupancy. A certificate of occupancy or temporary certificate of occupancy is obtained from the Building
Department (208) 887-2211 after inspections are complete and the field inspection record is returned to the
Building Department.
Plan Modifications: Except for the changes mentioned above, the approved Site Plan, Landscape Plan stamped
"Approved" on January 25, 2008, and Elevations, and are not to be altered without prior written approval of
the Planning Department. No significant field changes to the site or landscape plans are permitted; prior
written approval of all changes is required.
Note: If the plat for the subdivision in which this property lies has not been recorded, all subdivisio n
improvements shall be installed prior to occupancy of the first structure in the subdivision.

With this letter I am requesting approval of the parking as shown on the Site Plan
submitted with the Certificate of Zoning Compliance request, in lieu of the twelve you
suggested may be required.
The submitted Site Plan shows eight parking spaces, including one accessible space.
Section 11 -3C-7, of the Meridian City Code, allows for Alternatives to on site parking as
noted below:
A. Shared uses
a. The site is connected with paved pedestrian walks thought-out. These paths
lead to the Club House
b. This Club House will be used by the subdivision residents who all live within
1,000 feet.
C. The Users will establish there own operating hours for the Club House.
d. The Users have their own private parking at their dwellings. A sign at the
drop off entrance to the Club House will direct the users to the parking for
those who need parking.

Item #1 The fence around 3 sides of the swimming pool is 6 ft. high tubular steel and
the fence on the east side is solid vinyl. Details of each fence type is shown
on attachments to this letter.
Item #2 The entrance off Rio Vista Way is for cars and pedestrians.- The circular
driveway will provide a drop-off and pick-up area for Club -House users.
Note: The site plan transmitted with this letter shows directional arrows on
the pavement and a sign at the entrance.
Item #3 The Police Department's requirements included locking of the swimming
pool area gate and site lighting both of which are shown on the revised site
plan.
Item #4- The existing block wall will remain. The concrete block wall is in good shape
with a stucco finish on both sides and a brick cap continuous along the top.
Item #5 Transmitted with this response, is a letter requesting an alternative to your
suggested number of twelve parking spaces the on site. Eight plus one

SITE SPECIFIC CONDITIONS (Conditional Use Permit)
Applicant shall meet all of the requirements of the preliminary plat as a condition of the
Conditional Use Permit.
2. A condition of the CUP/PD shall be that the applicant participates in any road
infrastructure agreements in the North Meridian Planning Area negotiated with ACHD
and shall faithfully perform the terms of such agreement or agreements.
A minimum 10 -foot setback from the Rio Vista Drive right-of-way is required for the
existing wall on Lot 1, Block 5. Prior to issuance of a Certificate of Zoning Compliance
for the clubhouse lot, the applicant shall meet with the Meridian Police Chief or his
designee on site to determine the proper lighting, fence height, gates and surveillance
monitoring around the clubhouse. Submit written approval of said Police Department
approval with the Certificate of Zoning Compliance for the clubhouse.
4. All development shall comply with die Americans with Disabilities Act and the Fair
Housing Act including the community clubhouse.
5. The applicant shall provide/construct the following amenities within the subdivision:
a. Over 10% of the gross area as open space; and
b. A community clubhouse with restroorns and a swimming pool.

Item #1 The fence around three sides of the swimming pool is 6 ft. high tubular steel. Wrought Iron is
seldom used any more; however, the appearance is similar. The fence on the east side will be 6 ft. high
solid vinyl.

I have a few questions regarding the CZC application:
• Is the fencing around the swimming pool going to be 6 -foot wrought iron? The site designates steel and I
just need confirmation;
• Is the entrance off of Rio Vista Way for pedestrians or for vehicles? The entrance appears to be large
enough to accommodate vehicles. Can you please clarify?
• I have attached a condition of approval requiring written approval from the Police Department. Can you
please provide this? Also, the condition refers to an existing block wall. Is the existing block wall being
removed?
• And lastly, UDC 1 1 -3C -6B requires 1 parking space per 500 s.f. of gross floor area for nonresidential uses.
So, 6144 / 500 = 12 and the plan shows 9 (including ADA spots). However, the UDC does have a provision
for alternative compliance — see code section 11 -3C-7 for alternative compliance. I would need a narrative
requesting the alt. compliance (the checklist is on our website). The administrative review application
submitted with the CZC is absolutely fine for both the CZC and the alt. compliance. The fee for alt.
compliance is $100.00
Please call me if you have any questions. I am out a few days for the holiday, but I will be back on Thursday.
