Site/Landscape Plan: The site/landscape plan prepared by Harvest Design, on January 17, 2008, labeled Sheet LS-1, is approved (stamped "Approved" on January 18, 2008 by the Meridian Planning Department) with the following change: 1) Per UDC 11-4-3-27F, all street-facinsr elevations shall have landscaping along their foundation The foundation landsca in shall meet the followin minimum standards: a The landsca ed area shall be at least three 3-feet wide; b) For every 3 lineal feet of foundation, an evergreen shrub having a minimum mature height of 24 inches shall be slanted; and c) Groundcover plants shall be planted in the remainder of the landscaped areas The approved plan (with redlines) is not to be altered without prior written approval of the Planning Department. No field changes to the plan are permitted; prior written approval of all material changes is required. Prior to final inspection and sign off for this project, a written certificate of completion shall be submitted to the Planning Department, prepared by a landscape architect, landscape designer or qualified nurseryman responsible for the landscape plan upon completion of the landscape installation. The Certificate of Completion shall verify that all landscape improvements, including plant materials and sprinkler installation, are in substantial compliance with the approved landscape plan. Elevations: The proposed elevations substantially comply with those approved with CUP-06-030 and UDC 11-4- 3-27E.The Elevations prepared by Performance Engineers [Sheet S-3, dated 6/7/07 (stamped approved on 1/24/08)] are approved with no changes from the Planning Department. Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the approved specifications and in accordance with UDC 11-3A-15. Protection of Existin Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval ofprotection/relocationmeasures forthe existingtrees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11-3B-10-C.5. Parkinmg The proposed parking areas shall be paved and striped in accordance with UDC 11-3C and 11-3B. Project engineer/architect shall certify that the number and size ofhandicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed accessible. Curbing: Per UDC 11-3$-SI, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Sidewallcs: All sidewallcs shall be constructed in accordance with 11-3A-17. Sidewallcs shall be constructedprior to occupancy. Drainat?e: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18. Li tin :Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11. Si a e: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance with UDC 11-3D. Trash Enclosure: The applicant states that trash will be taken to the curb and that a trash enclosure will not be provided on the site. If a dumpster is provided in the future, the dumpster(s) must be screened in accordance with UDC-11-3A-12. Trash enclosures must be built in the location and to the size approved by SSC. Handica -Accessibili :The structure, site improvements and parking areas must be in compliance with all federal handicap-accessibility requirements. ACRD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACRD requirements, a new site plan shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. All changes in occupancy need to comply with the requirements of the Building Department. It is unlawful to use or occupy any building or structure until the Building Official has issued a certificate of occupancy. These single level 4-plexes will be built by Vacation Village Villas, LLC and marketed as Village Villas to buyers who are attracted to this central Meridian location and the low maintenance, luxury features of this particular condominium project. The community will not be age restrictive but these 2 bedroom units should have little appeal to buyers with growing families. Developers believe their homes will primarily attract retirees, empty nesters and professionals working in the immediate area. This multi-family development was broadly supported by neighbors in the adjoining single family residential communities at public hearings. Conditions of Approval 1. PLANNHVG TIEPARTMENT 1.1 ANNEXATION AND ZONING COMMENTS (AZ-06-047) 1.1,1. The annexation legal description submitted with the application (prepared on February 17, 2006 by D. Teny Peugh, PLS) shows the property as contiguous to the existing corporate boundary of the City of Meridian. 1.2 SITE SPECIFIC REQUIItEMENTS-PRELIlVTiNARY PLAT (PP-06-049) 1.2.1 The preliminary plat labeled as Sheet 1 of 1, prepazed by Engineering Solutions, LLP, dated October 3, 2006 is met approved and ahall be revised per the wnditions stated in Exhibit B of this staff report. All comtnents and conditions of the accompanying Annexation and Zoning (AZ-06- 047) and Conditional Use Permit (C[JP-06-030) applications shall also be considered wnditions of the Preliminary Plat (PP-06-049). 1.2.2 The landscape plan prepared by Glancey Rockwell & Associates, on October 2, 2006, labeled Sheet #LS-1 is approved with the following modifications/notes: a. Per UDC 11-2B-3, provide a 20-foot wide landscape buffer along the west, north, and east property boundaries adjacent to the existing singlo-family residential uses in compliance with the standards listed in UDC 11-3B-9C, Landscape Buffers to Adjoining -sea. b. A 10-foot wide landscape street buffer is required along E. Magic View Drive and the local public streets within the development per UDC 11-3B-7B. Trees are required at one per 35 lineal feet within the street buffer. Fencing is prohibited within this buffer but may e allowed at the interior edge of the buffer. AH landscaping must comply with UDC 11- B: Landscaping Requirements. Where. the applicant has submitted a preliminary landscape plan and where staff has reviewed such plan, the landscaping shall be consistent with the preliminary plan with modifications as proposed by staff. The preceding modifications and notes should be shown on a revised landscape plan submitted with the final plat application(s). 1.2.3 ~rovide 6-foot tall vinyl fencing along the west, north, and east boumdary of the development and 3-feat tall wrought iron fence with stucco pilasters along the south boundary, as proposed. The fencing along E. Magic View Drive shall be constrncted on or beyond the interior edge of the street buffer. A detailed fencing plan shall be submitted upon application of the final plat. If permanent fencing is not provided before issuance of a building permit, temporary construction fencing to contain debris shall be installed around the perimeter. Perimeter, common open space, and micro-path fencing shall be designed according to UDC 11-3A-7. 1~ The applicant is required to vacate or improve the northern portion of the unopened right-of--way of the current cul-de-sae of E. Magic View Drive at the southeast property line as the cul-de-sac will no longer be needed if B. Plans will need to be approved by the appropriate irrigativnldtainage district, or lateral users association (ditch owners), with written approval or non-approval submitted to the Public Works Department. If lateral uses association approval can not be obtained, alternate plans will be reviewed and approved by the City Eggineer prior to final plat signature. 1.2.9 Maintenance of all common areas shall be the responsibility of the Homeowners' Association. 1.3 GENERAL REQUI1tEMENTS-PRELIMINARY PLAT (PP-06-049) 1.3.1. A detailed landscape plan, in compliauce with dre landscape and subdivision orclinanee and as noted in this report, shall be submitted for the subdivision with the final plat application(s). 1.3.2. Sidewalks shall be installed within the subdivision and on the perimeter of the subdivision pursuant to UDC 11-3A-17. 1.3.3. All areas approved as open space shall be free of wet ponds or other such nuisances. All stormwater detention facilities incorporated into the approved open apace are subject to UDC 11- 3A-18 and shall be fully vegetated with grass and trees. Sand, grovel or other non-vegetated surface materials shall not be used in open apace lots, except as pemtitted under UDC 11-3B. Where the applicant has submitted a preliminary landscape plan and where staff has reviewed such plan, the landscaping shall be consistent with the preliminary plan with modifications as proposed by staff. If the stormwater detention facility cannot be incorporated into the approved open space and still meet the standards of UDC 11-3A-18, th® the applicant shall relocate the facility. This may require losing a developable lot or developable area. It is the responsibility of the developer to comply with ACHD, City of Meridian and all other regulatory requirements at the time of final construction. 1.3.4. A written certificate of completion should be prepared by the landscape arehiteet, designer, or qualified nurseryman responsible for the ]aadscape plan upon completion of the landscape installation.
