CORDER ~'~Zj~'9 ~, ~ DAVID NAVARRO ~ BOISE, IDAHO FEE .DEPUTY 2OOOAP 13 PH 1:37 0280q3 BY COUNCIL MEMBER 77 AN ORDINANCE OF THE CITY OF MERIDIAN, IDAHO, AMENDING SUBSECTIONS A, B, C, AND D OF SECTION 1 OF CHAPTER 7 OF TITLE 8 MERIDIAN CITY CODE TO PROVIDE FOR THE DELETION OF CITY HALL BY THE ADDITION OF PARKS AND RECREATION DEPARTMENT, PROVIDING FOR ADDITIONAL LANGUAGE FOR REFUSAL TO VACATE SHELTER; AND TO PROVIDE FOR A NEW SUBSECTION E RELATING TO PARK HOURS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO: SECTION 1- That section 1 of Chapter 7 of Title 8 Meridian City Code, be, and the same is hereby amended to read as follows: 8-7-1' PICNIC SHELTERS: A. Reservation Fees: The Mayor and City Council, by Resolution, shall adopt fees for the use of parks facilities in order to recover some of the costs of the City to process various applications and a portion of the maintenance costs of the picnic shelters, picnic tables, softball fields, and parks of the City. Application Required; Record Kept: Persons, associations, corporations, and other entities, desiring to use the Meridian park picnic shelters shall apply at the Parks and Recreation Department for the use of a picnic shelter, reserve a time of use of a picnic shelter, if their requested time is available, and pay the appropriate fee; the Parks and Recreation Department shall keep a record of the scheduled times and fees paid for reservations. Co Reservation Required; Removal From Shelter: If persons, associations, corporations, and other entities, using a picnic shelter have not reserved the time and paid the appropriate fee, and are using the picnic shelter at a time that has been reserved for another person, association, corporation, or other entity, if they refuse to vacate the shelter, they shall be removed from the shelter, either by City park employees or by the Police Department and they may be cited for trespass. Do Reservation List Maintained At Shelter: A list of reservations for a particular picnic shelter shall be maintained at that particular shelter to inform the public who has reserved the picnic shelter and the time, or times, for which the shelter has been reserved; if the reservations have been removed from the picnic shelter the list maintained by the Parks and Recreation Department shall still be controlling. Eo The parks of the City of Meridian shall be open and available for use from 7:00 o'clock A.M. to 12:00 o'clock midnight and all people shall vacate the City parks no later than 12:00 o'clock midnight. Picnics shall end at 9:00 o'clock P.M. which gives picnic users of the parks time to clean up and vacate the park. SECTION 2: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 3: VALIDITY: The Meridian City Council hereby declares that any section, paragraph, sentence or word of this Ordinance as adopted and amended herein be declared for any reason to be invalid it is the intent of the Meridian City Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any portion as may be declared invalid. SECTION 4: DATE OF EFFECT: This ordinance shall be in full force and effect within one (1) month after its passage, approval and publication, according to law. WHEREAS, Pursuant to Idaho Code, 50-302, the City of Meridian is required to make, and may make, all such ordinances, by-laws, rules, regulations and resolutions not inconsistent with the laws of the state of Idaho as may be expedient, in addition to the special powers in Title 50, Idaho Code, granted, to maintain the peace, good government and welfare of the City and its trade, commerce and industry; and WHEREAS, Meridian City Code § 8-7-1 A provides that the City Council shall set fees for use of parks facilities; and WHEREAS, it is in the best interest of the City of Meridian to establish reasonable fees for the reservation of Park facilities in the City of Meridian to preserve the peace and tranquility of the parks, prevent overcrowding of the facilities, to provide funds for the maintenance of the parks, and to recoup some of the costs that the City incurs as a result of processing the applications for reservations. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF MERIDIAN, IDAHO: 1. That the fees set forth herein and adopted are reasonable and reflect, as closely as reasonably possible, some of the costs of the City to process the various RESOLUTION- 1 reservations of Meridian io and a portion of the Park maintenance costs. That there are hereby adopted the fees set forth below for the reservation Park facilities including the period of time set forth, as follows: Park Shelter Reservation Storey Park 0 to 50 people $30.00 Additional people $15.00 per each 50 Additional tables $ 3.00 each with maximum of 8 12 tables are located in and around each shelter. Maximum of 200 people (Block A-10 AM to 3PM / Block B- 4PM to 9PM) Tully Park 0 to 150 people Additional people Additional tables 20 tables are located in the shelter. $60.00 $15.00 per each 50 $ 3.00 each with a maximum of 8 Maximum of 300 people (BlockA-10 AM to 3PM/ Block B- 4PM to 9PM) Off Peak Hours Tully Park shelter available Monday through Thursday (excluding holidays) from 10 AM to 3 PM at a reduced rate of $45.00. All other rules apply. * Maximum time on grass is 4 hours; event holder is responsible for any turf damage. Vendor must supply generator to inflate jumping toys. RESOLUTION - 2 The above reservation fees are for a five (5) hour period of time. Additional fees of $10.00 for each piece of amusement equipment will also be assessed for space used outside the shelter, e.g. tents, astro jumps, canopies, etc. No such equipment will be permitted unless proof of insurance in limits acceptable to the City is submitted by the supplier of the equipment at the time a reservation is made and verified no later than ten (10) days before the reservation. Dunk tanks will are not allowed. B. Softball Field Reservation $8.00 per hour C. Alcohol Permits Groups wishing to serve alcoholic beverages to their guests must comply with all City and State laws and must obtain a permit. The cost of the permit is $20.00 and will cover one six hour period only. D. Refunds Reservation fees may be refunded if requested in writing at least ten (10) days prior to the date reserved. A processing fee of $5.00 will be deducted from the reservation fee. Reservations may be canceled less than 10 days before the date but no refund will be given. Events canceled by inclement weather will entitle the reservation holder to reschedule the reservation at no additional charge. RESOLUTION - 3 E. Additional Fees Additional fees may be assessed if any park property is damaged, or if Parks & Rec Dept. employees must conduct excessive cleanup. The fees charged shall be based on the estimated cost of repairs or the hourly wage of the employees (including fringe benefit costs) whose extra duty is required.
