S:~yline Development Co. is requesting annexation into the City of Meridian of 12.7 acres of property located on the east side of Linder Road approximately 1,800-feet south of Franklin Road. The requested zoning designation of R-4 will allow construction of a single family residential subdivision of approximately 50-lots adding 500 vehicle trips per day to traffic on Linder Road.. 2. .Linder Road is a section line road that currently has 50-feet of right-of-way and is improved with 24-feet of pavement. The 2000 Urban Functional Street Classification Map designates Linder as a collector roadway. The District requires a mini- mum of 90-feet of right-of-way on section line roads in an urban area, width sufficient for 5 traffic lanes, and 5-foot sidewalks. The ultimate right-of-way will be acquired when a specific development is submitted. The developer will be required to construct 5-foot sidewalk. Other requirements may be imposed as determined by the size and. layout of a specific 3evelopment plan. 3. The ACRD Capital Improvement Plan indicates that Linder is ap- proved for use of Road Impact Fee funds to increase its capaci- ty; therefore, Road Impact Fee offsets may be given for con- struction of the roadway improvements along Linder and, for right-of-way dedication in addition to what exists now. This planned development will accelerate the need for Joint School District No. 2 to construct additional classrooms and/or to adjust school attendance boundaries. Meridian Schools do not have excess capacity. Nearly every school in the district is beyond capacity. The Meridian School District supports economic growth for Idaho and specifically the district's area, but such growth produces a need for additional school construction. We ask your support for a development fee statute on new home construction or a real estate transfer fee to help offset the costs of building additional school facilities. If this support is lacking then we ask that additional residential development be denied. Residents of the new subdivision cannot be assured of attending the neighborhood school as it may be necessary to bus students to available classrooms across the district. C-oun-cil Members-; -____ In action taken by' the "Meridian Planning & Zoning Commission on November 9, 1993, a request, by Edward A, Johnson, for annexation of a parcel of land on Linder Road was approved and forwarded for- your final action, .Included in the Planning & Zoning approval is a requirement to pipe the entire length of the Kennedy Lateral, as it borders or crosses the proposed annexation. We respectfully request a variance be granted from this requirement for the following reasons; 1. The Kennedy Lateral is quite large in this area and would, likely .require a pipe approaching 6-feet in diameter. The cost of installing such a large pipe would run approximately $80.00 per foot or more. Resulting in a cost-well over $100,000 for this parcel, which is almost as much, per acre, as tte cost of the property in that area. 2. The lateral is largely the boundary of ,this property, with property owned by other parties on the north side. The exact boundary line is down the center of the ditch. Requiring us to pipe the ditch is an unfair burden on us and no cost, to the other property owners. 3. Fencing, of such- large laterals seems to be a very reasonable al ernative. They are allowed in .other. jurisdict-ions and have proven to be ,.very effective. Large pipe sizes do .not preclude adventuresome ..children from venturing inside.. 4. If the present policy is strictly adhered to, the result will be a substantial depreciation of land ealues where such water courses exist. Development on 'such parcels will likely be bypassed in favor of other parcels without major-negative situations. If such costs are added to some land (because of laterals), and not to others, and the lateral land is bypassed, the safety question is not dealt with now, but merely being postponed to a later date. This appears to be a public policy that has a negative affect on orderly growth for the present. -- - __ __ - -- -_b:-_-dome other jurisdictions allow water courses to be used as "water amenities" under certain conditions. This policy has proven to be popular with people who want a stream of water in their back yard and can be a very attractive addition to a neighborhood. Requirements for this option include an engineered formula that considers the depth of water and the velocity of flow. If a stream qualifies in this way, a 4 to 1 slope is required along the edge that allows anyone to exit the water easily. This option should be given some consideration as it would fit many situations in the Meridian area. Included in the Planning & Zoning approval is a requirement to pipe the entire length of the Kennedy Lateral, as it borders or crosses the proposed annexation. We respectfully request a variance be granted from this requirement for the following reasons; 1. The Kennedy Lateral is quite large in this area and would likely require a pipe approaching 6 feet in diameter. The cost of installing such a large pipe would run approximately $80.00 per foot or more. Resulting in a cost well over $100,000 for this parcel, which is almost as much, per acre, as the cost of the property in that area, 2• The lateral is largely the boundary of this property, with property owned by other parties on the north side. The exact boundary line is down the center of the ditch. kequiring us to pipe the ditch is an unfair burden on us and no cost to the other property owners, 3. Fencing of such large laterals seems to be a very reasonable alternative. The,v are allowed in other jurisdictions and have proven to be very effective, Large pipe sizes do not preclude adventuresome children from venturing inside. 4. If the present policy is strictly adhered to, the result mill be a substantial depreciation of land values where such water courses exist. Development on such parcels will likel`r be bypassed in favor of other parcels without major negative situations. Fencing is much less costly and would not negatively affect the land value. This planned development will accelerate the need for Joint School District No. 2 to construct additional classrooms and/or to adjust school attendance boundaries. Meridian Schools do not have excess capacity. Nearly every school in the district is beyond capacity. The Meridian School District supports economic growth for Idaho and specifically the district's area, but such growth produces a need for additional school construction. We ask your support for a development fee statute on new home construction or a real estate transfer fee to help offset the costs of building additional school facilities. If this support is lacking then we ask that additional residential development be denied. Residents of the new subdivision cannot be assured of attending the neighborhood school as it may be necessary to bus students to available classrooms across the district. Provide statements of intended use of subdivision, dedications to the public and/or easements, together with a statement of location, dimension and purpose of such, and development features. 2. Vicinity map needs to show adjacent subdivisions with street names. 3. Plat map needs to show the streets and lot lines for adjacent subdivisions for orientation. 4. Verify the minimum lot square footage of any lot adjacent to an irrigation lateral or drainage ditch. These lots must contain a minimum of 8,000 SF excluding easements and/or rights-of--ways. 5. Identify (2) two foot contour lines with the elevation which they represent. Indicate the benchmark used for the contour lines. 6. Submit street and subdivision name approval letter from the Ada County Street Name Committee. 7. Clarify the proposed flow of the sanitary sewer system. Please refer to the memorandum from the City Engineer of 10/ 10/93 . 8. An additional 12" water main will need to be installed along this subdivisions frontage in Linder Road, and connected to the phase II. 9. Indicate any flood plain boundaries or the measures to reduce any boundary. 10. It is my recommendation that a stub street be extended to the undeveloped parcel along the northerly boundary, via extending Otter Way. 11. As mentioned in the City Engineer's memo of 10/10/93; Additional development in this area, including the continued development of Mallard Landing, may require construction of a water main in Waltman Lane to Meridian Road. Comprehensive Plan indicated a need to a combining school/park site in this general area which will be addressed in the development agreement including a impact fee to help acquire a future school or park site to serve this area. Comprehensive Plan designates future I-84 Linder Overpass. Development agreement will stipulate need for dedicated ROW as needed by ACRD and ITD for future road improvements. This property is served by two sewer drainage areas. The property south of the Kennedy Lateral must drain to the Black Cat Trunk B which is not yet developed. The northern portion can be served with existing sewer facilities. The Preliminary plat is confusing regarding sewer service and compliance with the sewer facilities plan. Final plat design must include a stub street to the north to access the northern property. A stub street should also be provided to the south for access and to allow development without conflicting with the future I-84 Overpass. Lots 1, 44, and 45 adjacent to Linder Road must be widened and buffered from Linder and the future I-84 Overpass and traffic noise. The Kennedy Lateral's easement is 55 feet overall: 20 feet to the left and 35 feet to the right facing downstream. This easement should be indicted on your final plat as it appears that you are using the easement area as part of your lots. It is recommended that a fence be erected along the banks of any Irrigation District facility or that the ditch be piped. The plans indicate that the subdivision's irrigation, which I assume is pressurized, is within the easement. Your plans indicate the crossing that was installed last spring. The. crossing appears to be adequate providing that headwalls are installed this fall. The riprap that is to be used at the inlet and outlet of this pipe should be 12 inch rock at a minimum. The plans also show that there will be storm water leaving the subdivision site. The problem is that Pacific Land Surveyors did not supply the District with any drainage calculations. The District will need to know where this water is going after it leaves The Landing Subdivision No. 7 as reviews were never done on The Landing Subdivisions No. 2, 3, 5, or 6. The discharge will more than likely end up back in the District's system so it is imperative that we get all of the necessary information. SKYLINE DEVELOPMENT COMPANY ANNEXATION AND ZONING A PORTION OF THE NORTHWEST 1/4 OF SECTION 13, T.3N., R.1W, B.M., ADA COUNTY, MERIDIAN, IDAHO FINDINGS OF FACT AND CONCLUSIONS OF LAW The above entitled annexation and zoning application having come on for consideration on October 9, 1993, at the hour of 7:30 o'clock p.m. on said date, at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, and the Council having heard and taken oral and written testimony and the Applicant appearing in person, and having duly considered the matter, the Planning and Zoning Commission makes the following: FINDINGS OF FACT 1. The general area surrounding the property is used predominantly for residences. 6. That the property is adjacent and abutting to the present City limits. That the property included in the annexation and zoning application is within the Area of Impact of the City of Meridian. 9. That the parcel of ground is included within the Meridian Urban Service Planning Area as the Urban Service Planning Area is defined in the current Meridian Comprehensive Plan and the proposed Comprehensive Plan. 10. That the Application requests that the parcel be annexed and zoned R-4 Residential; that the applicant indicated that the intended development of the property is for single family dwellings. 11. That the property is in the CINDER ACRES Neighborhood as set forth in Policy Diagram in the current Meridian Comprehensive Plan; that the property is not included specifically within a District designated in the proposed Comprehensive Plan; that the proposed Comprehensive Plan designates the area where the land in the application is located to be a mixed residential area; that under Housing Development on page 25 and 26 of the Current Comprehensive Plan, property inside the Urban Service Planning Area may be developed at greater densities than one dwelling unit per acre and it is the policy that a density of greater than 1 dwelling unit per 5 acres may not be exceeded outside of the Urban Service Planning Area. 12. That in the Rural Area section of the current FINDINGS OF FACT & CONCLUSIONS OF LAW - 3 Comprehensive Plan it does state that land in agricultural activity should so remain in agricultural activity until it is no longer economical to exclude orderly growth and development to maintain agricultural pursuits. 13. That the proposed Meridian Comprehensive Plan, under Land Use, Residential Policies, 2.1U states as follows: "Support a variety of residential categories (urban, rural, single-family, multi-family, townhouses, apartments, condominiums, etc. ) for the purpose of providing the City with a range of affordable housing opportunities." 14. That the proposed Meridian Comprehensive Plan, under Land Use, Rural Areas, 6.3 c., it states as follows: "Within the Urban Service Planning Area development may occur in densities as low as 3 dwellings per acre if physical connection is made to existing City of Meridian water and sewer service and the property is platted and subdivided . .' 15. That the proposed Meridian Comprehensive Plan, under Land Use, Rural Areas, 6.4, it states as follows: "Residential development is allowed in the rural area provided that said development does not exceed the Rural Residential Agricultural density, unless it is inside the Urban Service Planning Area and City sewer and water is provided, when Low, Medium and High density residential may be considered. That the Planning Director, Wayne Forrey, commented that the R-4 request complied with the proposed Comprehensive Plan; that the Plan indicated a need for a combination school/park site was needed in this area; that annexation could be condition on a development agreement including an impact fee to help acquire a future school or park site to serve the area; that the proposed FINDINGS OF FACT & CONCLUSIONS OF LAW - 5 Comprehensive Plan designates a future I-84 overpass as Linder and freeway and a development agreement should deal with future improvements for that. 22. That the R-4 Residential District is described in the Zoning Ordinance, 11-2-408 B. 3. as follows: "R-4) Low Density Residential District: Only Single Family Dwellings shall be permitted and no conditional uses shall be permitted except for Planned Residential Development and public schools. The purpose of the (R-4J District is to permit the establishment of low density single-family dwellings, and to delineate those areas. where predominately residential development has, or is likely to occur in accord with the Comprehensive Plan of the City, and to protect the integrity of residential areas by prohibiting the intrusion of incompatible non-residential uses. The (R-4) District allows for a maximum of four ( 4 ) dwelling units per acre and requires connection to the Municipal Water and Sewer systems of the City of Meridian." 23. The Meridian School District submitted comment and such is incorporated herein as if set forth in full; its comment was that there is no excess capacity in the schools of the District and that residents of the new subdivision could not be assured of attending the neighborhood schools; the School District asked for support for a development fee or a transfer fee to help offset the costs of building additional schools. 24. That in 1992 the Idaho State Legislature passed amendments to the Local Planning Act, which in 67-6513 Idaho Code, relating to subdivision ordinances, stated as follows: "Each such ordinance may provide for mitigation of the effects of subdivision development on the ability of political subdivisions of the state, including school districts, to deliver services without compromising quality of service delivery to current residents or imposing substantial additional costs upon current residents to accommodate the proposed subdivision."; FINDINGS OF FACT & CONCLUSIONS OF LAW - 6 • • that the City of Meridian is concerned with the increase in population that is occurring and with its impact on the City being able to provide fire, police, emergency health care, water, sewer, parks and recreation services to its current residents and to those moving into the City; the City is also concerned that the increase in population is burdening the schools of the Meridian School District which provide school service to current and future residents of the City; that the City knows that the increase in population does not sufficiently increase the tax base to offset the cost of providing fire, police, emergency health care, water, sewer, parks and recreation services; and the City knows that the increase in population does not provide sufficient tax base to provide for school services to current and future students. 25. That pursuant to the instruction, guidance, and direction of the Idaho State Legislature, the City may impose either a development fee or a transfer fee on residential property, which if possible would be retroactive and apply to all residential lots in the City, because of the imperilment to the health, welfare, and safety of the citizens of the City of Meridian. 26. That Section 11-9-605 C states as follows: "Right-of-way for pedestrian walkways in the middle of long blocks may be required where necessary to obtain convenient pedestrian circulation to schools, parks or shopping areas; the pedestrian easement shall be at least ten feet (10') wide." 27. That Section 11-9-605 G 1. states as follows: "Planting strips shall be required to be placed next to incompatible features such as highways, railroads, commercial or industrial uses to screen the view from residential properties. such screening shall be a minimum of twenty feet FINDINGS OF FACT & CONCLUSIONS OF LAW - 7 • (20') wide, and shall not be a part of the normal street right of way or utility easement;" 28. That Section 11-9-605 H 2. states as follows: "Existing natural features which add value to residential development and enhance the attractiveness of the community (such as trees, watercourses, historic spots and similar irreplaceable amenities) shall be preserved in the design of the subdivision;" 29. That Section 11-9-605 K states as follows: "The extent and location of lands designed for linear open space corridors should be determined by natural features and, to lesser extent, by man-made features such as utility easements, transportation rights of way or water rights of way. Landscaping, screening or lineal open space corridors may be required for the protection of residential properties from adjacent arterial streets, waterways, railroad rights of way or other features. As improved areas (landscaped), semi- improved areas (a landscaped pathway only), or unimproved areas (left in a natural state), linear open space corridors serve: 1. To preserve openness; 2. To interconnect park and open space systems within rights of way for trails, walkways, bicycle ways; 3. To play a major role in conserving area scenic and natural value, especially waterways, drainages and natural habitat; 4. To buffer more intensive adjacent urban land uses; 5. To enhance local identification within the area due to the internal; linkages; and 6. To link residential neighborhoods, park areas and recreation facilities." 30. That Section 11-9-605 L states as follows: Bicycle and pedestrian pathways shall be encouraged within new developments as part of the public right of way or as separate easements so that an alternate transportation system (which is distinct and separate from the automobile) can be provided throughout the City Urban Service Planning Area. The Commission and Council shall consider the Bicycle-Pedestrian Desian Manual for Ada County (as prepared by Ada County Highway District) when reviewing bicycle and pedestrian FINDINGS OF FACT & CONCLUSIONS OF LAW - 8 • pathway proviso 1. That all Planning Act and of been met, including within 300 feet of .ons the the the the within developments. CONCLUSIONS procedural requirements of the Local Ordinances of the City of Meridian have mailing of notice to owners of property external boundaries of the Applicant's property. 2. That the City of Meridian has authority to annex land pursuant to 50-222, Idaho Code, and Section 11-2-417 of the Revised and Compiled Ordinances of the City of Meridian; that exercise of the City's annexation authority is a Legislative function. 3. That the Planning and Zoning Commission has judged this annexation and zoning application under Section 50-222, Idaho Code, Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances, the Meridian Comprehensive Plan, as amended, and the record submitted to it and things of which it can take judicial notice. 4. That all notice and hearing requirements set forth in Title 67, Chapter 65, Idaho Code, and the Ordinances of the City of Meridian have been complied with. 5. That the Commission may take judicial notice of government ordinances, and policies, and of actual conditions existing within the City and State. 6. That the land within the proposed annexation is contiguous to the present City limits of the City of Meridian, and the annexation would not be a shoestring annexation. 7. That the annexation application has been initiated by the FINDINGS OF FACT & CONCLUSIONS OF LAW - 9 • • Applicant with the consent of the titled owners and the annexation is not upon the initiation of the City of Meridian. 8. That since the annexation and zoning of land is a legislative function, the City has authority to place conditions upon the annexation of land. Burt vs. The City of Idaho Falls, 105 Idaho 65, 665 P.D 1075 (1983). 9. That the development of annexed land must meet and comply with the Ordinances of the City of Meridian and in particular Section 11-9-616, which pertains to development time schedules and requirements, and 11-9-605 M. which pertains to the tiling of ditches and waterways. 10. That this Application has been submitted prior to the adoption of the proposed amendment to the Meridian Comprehensive Plan; that as a condition of annexation the Applicant, and titled owners, must agree that the proposed Meridian Comprehensive Plan, once adopted, shall apply to the land and any development. 11. That since the Applicant's property is in the CINDER ACRES NEIGHBORHOOD of the CURRENT Comprehensive Plan, the annexation and zoning Application is in conformance with the Comprehensive Plan and do not conflict with the Rural Areas policies; it further is in compliance with the proposed Meridian Comprehensive Plan. 12. That the requirements of the Meridian City Engineer and of the Ada County Highway District, Settlers and Nampa & Meridian Irrigation District, if submitted shall be met; the comments of the Meridian Planning Director shall be addressed in a development FINDINGS OF FACT & CONCLUSIONS OF LAW - 10 • • Agreement. 13. That all ditches, canals, and waterways shall be tiled as a condition of annexation and if not so tiled the property shall be subject to de-annexation. 14. That the Applicant will be required to connect to Meridian water and sewer and resolve how the water and sewer mains will serve the land; that the development of the property shall be subject to and controlled by the Subdivision and Development Ordinance; that, as a condition of annexation, the Applicant shall be require#d to enter into a development agreement as authorized by 11-2-416 L and 11-2-417 D; that the development agreement shall address the inclusion into the subdivision of the requirements of 11-9-605 C, G., H 2, K, L and the comments of the Planning Director, Wayne Forrey; that the development agreement shall also address noise buffering from I-84; that the development agreement shall, as a condition of annexation, require that the Applicant, or if required, any assigns, heirs, executors or personal representatives, pay, when required, any development fee or transfer fee adopted by the City; that there shall be no annexation until the requirements of this paragraph are met or, if necessary, the property shall be subject to de-annexation and loss of City services, if the requirements of this paragraph are not met. 15. That proper and adequate access to the property is available and will have to be maintained. 16. That these conditions shall run with the land and bind the applicant, the titled owners, and their assigns. FINDINGS OF FACT & CONCLUSIONS OF LAW - 11 • • 17. Johnson, or Ted Johnson, President of Land Developers Edward A. Johnson was sworn by the Attorney. Crookston: It gives me pleasure to swear in an ex-judge. Johnson: Thank you Mr. Crookston, the application we have tonight • Planning and Zoning October 12, 1993 Page 29 gentlemen is an application for an annexation of 12.46 acres, I believe the number is I'm sorry I'm a little bit unprepared tonight, because this came up without much notice to me, and I'm very depending on your sketches tonight. But the annexation request is for a little larger parcel than what we're proposing as a subdivision for the reason that Mr. and Mrs. Calhoun, John and Colleen Calhoun, who are here tonight, would like to annexed on the remaining property that they're going to retain. Our proposal with them is to purchase a ten acre parcel from them that would be adjoined on the east by property we already have, we already own and have a preliminary plat approval on in the Landing project, this would be this particular proposal would be Landing #7. It would be consistent with or a little larger than what we already have in the existing first five or six spaces of the Landing subdivision. The lots are a little larger and they're footages are probably a little larger, the access on Linder Road it would be what I understand from long standing that there has been a desire to extend Waltman Lane to the west to commute to Linder Road, and this would accomplish that purpose. Our proposal here would amount to about 52 lots in the 14.45 acres that would be a composite of the ten acres we would be purchasing from the Calhoun's. At about 4.5 acres from existing ground that we've already had zoned from before . Johnson: What's that density work out to? Johnson: The density is just a little over 3.5 Johnson: That's excluding the ten acres of that property? Johnson: Yes, that does not include the development property. Johnson: Most of the R-4, is that what you're saying? Pretty close to R-4 itself? Johnson: That's correct, I had a chance to read Mr. Forrey's letter of comments this evening, and there are a couple of things there I think we need to talk about. As you know this land(end of tape) As you know the Landing project has been going on now for about 3.5 years, and in that effort over a period of time we have worked with all the agencies including the Highway District and the City to determine just how that interior project was to be serviced. And the attempt for a long time on our part was to use Waltman Lane and going east, but there was some resistance to that • • Planning and Zoning October 12, 1993 Page 30 so there was a discussion here in this room as a matter of fact, between the ACHD people, City Engineer, myself and other interested parties there was quite a large crowd talking about what could be done to service that, the idea was that we would try to provide another access off to Linder Road or in some other direction and it's been foretoitness that we've been able to work on that, where e could out to Linder Road through the Calhoun property. That however presents a problems, I see Mr. Forrey's comments having to do with the sewer I know the long range plan for the Calhoun property and any property on the west side of the kennedy Lateral, is to flow by gravity to the west, we would propose to put in attempt with a list station at Linder Road and come back into our system that would be a distance of about 600 feet into a facility we already have oversized to allow that to happen. And that would be crucial to our application and for annexation because without the sewer we wouldn't be able to go forward. Johnson: Excuse me where would the lift station be located? Johnson: It would be located on the eastern most portion in the intersection of the roads that come in from Landing #6, do you want me to point that on the map? Johnson: Yes if you would please. Johnson: Well this station would be down here and pump to an existing sewer now Johnson: So the station is right off Linder Johnson: Yes, it would pick up onto the sewer and be very handy when this sewer is removed it could flow on by gravity to the west when there is someplace for it to be handled. We do have a lift station in phase 1 of the Landing which handles phases 1, 2, nd 3 or a portion of it, actually the portion to the west to the eastern portions of those are gravity flow and the western portions had to be lifted back up to the manhole furtherest to the west. We see this to be a similar kind of an application it would make the need is to do that on a temporary basis. And we would furnish of course the pumping unit. The question Mr. Forrey raised is relative to schools and parks, is something we've already been concerned about, and interested in working with. About three years ago we had some conversation with the School District and again two years ago and we find when we finally platted the remainder we started with three • • Planning and Zoning October 12, 1993 Page 31 phases, and then we came back and did the remaining portion of that probably about 65 acres. And in that conversation, those conversations, we'll offer a school site in that area and we wanted to do so we could plan with it not have it interrupt it. Well two years ago or maybe a year and a half the School District indicated to us that they were no interested in a site in that location. Johnson: Yes I remember that conversation. Johnson: The reason was is the Highway I-84 cuts us off from the south, they'd like to have a place that's more central than this, and that's from the premise we're going to operate now for a couple years. We do have a park in the next phase, at the eastern most portion of this phase touches the edge of this park, it's about a 3 acre park that would be centrally located in the middle of the project we privately owned and maintained, we've done that in many of our projects and find them to be a good addition to the neighborhood. I need to raise the issue of the Kennedy Lateral again, I've heard a lot of conversation about it here tonight, we do intend to pipe the Kennedy Lateral through the lots that abut the, the lateral goes through the eastern tail of this project. We would like to the that but we would prefer not to the that which goes through on west for the reason that they, the Calhoun's own to the middle of it, somebody else owns the other half and it would be very handy as we've done in other jurisdictions, just to fence that out so that the last two feet of the property but is not part of the subdivision and would be protected from access to anyone who wanted to be in the part of the lots and the other part of it is the other side of it is the lateral is a nursery a greenhouse where commercial activity goes on and this is a residential kind of place along that section of the Kennedy that's where the maintenance road is maintained for the maintenance of the whole lateral it's on the north, and on the east where it makes a curve. So our application would be to the Council that we would be allowed a variance on that portion which we only own half the right of way, I can't control the other half. I believe those are the major points that I have gentleman, it's one of those things that we think is a positive thing for the community in that it provides better access and opens up ground that's already zoned in close proximity to the city with a great deal of effort having been put in to this project the last couple two to three years, well a lot of input all we're trying to do is satisfy all those agencies that we've dealt with that you've suggested. • Planning and Zoning October 12, 1993 Page 32 Johnson: That's a lot of fun trying to do that isn't it? Have you had any recent discussion with the school? I know this was a couple of years ago regarding the site, have you talked to them say within the last couple of months? Johnson: Mr. Chairman I could be fececious and say yes because I talked to them late this afternoon, but I didn't know this was an issue anymore because we've been working on our other site in a different part of the county, but I have not raised the issue nor has he. ` Johnson: Could you comment for me on surface water and drainage I understand there has been some problems out in the adjacent areas with the high water table. Johnson: There is a high water table Mr. Chairman, our approach to that has been to lay an additional line along side of the sewer a perforated line that carries off and drops the water table quite a little bit, and drops it to the point where the crawl spaces are not directly affected if they're anywhere close to the sewer line. Johnson: Have you actually done that in part of your other development or do you have any success with that. Johnson: Yes Mr. Chairman that's what we've done in every part of the development because of the very issued you raised. It's more costly but we feel that handles, it drops that water table down to where we prefer to have it. Johnson: Okay, any questions for Mr. Johnson? Charlie? Rountree: How close are you to the Interstate? Johnson: We about border the Interstate on the south. Rountree: You have individual lots bordering the Interstate with home sites within 50 or 60 feet? Johnson: Mr. Chairman, Mr. Rountree we have them backing up against the Interstate in one of the later phases but we know that FHA requires a 50 berm and we're going to have to fudge it a little bit, move the streets to the north we just learned that recently but their will be a buffering along the Interstate for the noise and traffic control, or at least just the noise of it. Rountree: You indicated that you're going to improve access it seems to me like its going to aggravate the problem on Linder on the corner of Linder and Franklin with traffic congestion. • Planning and Zoning October 12, 1993 Page 33 Johnson: Mr. Chairman, Mr. Rountree that is the very question we're addressing here in this room about a year ago. The question was how do we handle that and there were people who were concerned about the access onto Linder at Franklin then. And ACHD said all that up to this point we'll handle it but by putting in a four way stop. When it goes beyond that another hundred homes or something like that, we'll put in a centi-four, and they said that will handle it easily. Johnson: I believe it was another 100 or 200 homes I don't remember, any other questions? Crookston: I just have one question on your drawing here Mr. Johnson, on I guess it's block 7. I don't know if there's blocks on there or not. Lot 2 it's a double frontage lot. Johnson: Mr. Chairman may I step over there and see that map? Crookston: This lot right here. That's a real hard thing to deal with because the individual owner doesn't know which is going to be his backyard and which is his frontyard and which he can fence and he's going to want to fence to the street, which our ordinances do not allow, I just reference that is very difficult to deal with. Johnson: Mr. Chairman, Mr. Crookston, I understand what you are saying exactly we don't like double frontage lots any better not as well as you do I'm sure that's the case and we've developed something like 3,000 lots in the last 25 years. We try to avoid them but in this situation I think the better approach is to deal with people who can handle that in the covenant so that they still meet the criteria of the city, not having fences clear out into the street which we don't like either but it's a matter of question if we have to cut our price on that one and let somebody come in there and have a nice backyard and it isn't fenced then that's what we're going to have to do. Because I don't see how to use that strip otherwise. Crookston: Thank you. Johnson: Any other questions of Mr. Johnson? Rountree: Is this graphic out here your proposed subdivision plat it seems rather confusing to me, you've got some lines cutting through the middle of lots and you've got some lots renumbered, .. • • Planning and Zoning October 12, 1993 Page 34 you've got some lots that obviously don't make the minimum square footage you have the lot that Wayne just pointed out is a problem lot, you don't show curb/gutter and soil block on Linder. Johnson: Mr. Chairman, Mr. Rountree, I recognize what you're saying is true and we'd had a whole dog and pony show here tonight if I had known just a little bit ahead of time but I know until this morning, I'm sorry. Crookston: Well it is only and annexation and zoning, we were just interested in that. Johnson: And let me assure you Mr. Rountree that we've made every effort to meet that requirement in fact the engineering sketch that he has drawn for this subdivision shows 8,000 or more feet on every lot. Rountree: Well lot #35 doesn't meet the requirement if you take away the square footage for the lateral easement it's right at 8,000 now and and there is certainly more than 9 square feet at the lateral easement. Johnson: Mr. Rountree we can adjust that, there are some over there that are about 9.000 that lot can move when we get ready to Rountree: I just wanted to point out that whatever we do this evening really this is not a factor because of what you have is strictly conceptual. I think there are going to be significant adjustments. Johnson: Good point, thank you Charlie. Anyone else? Thanks Ted, anyone from the public that would like to address the Commission on this issue, anyone else? Any comments from you Mr. Forrey? Forrey: Thank you Mr. Chairman, members of the Commission and Ted, I can clarify one point, in the last two months Dan Mabe and the School Board have been re-evaluating the school siting needs so I don't know two three years ago that might have been the case where they didn't anticipate a school site in this section but now they do. And so somewhere in this area in the future they'd like to have a school site. Now they didn't specifically ask that it be in this project but just so you know that's why the comment is there. ~. • Planning and Zoning October 12, 1993 Page 35 Johnson: I understand that conversation is still valid because there is a need in that area but they were focusing a little further south north on Linder and across the street. Forrey: Correct, and that's still the site in that area. As far as the sewage issue and the drainage, I wish Gary was here i think that is something Gary has to work out with that lift station and the capacity. And he eludes to that in his comments. That piece of property is in two different drainage areas so it will require a pump station and then as an interim solution and as a long term in the Black Cat trumping, okay that's it. Johnson: Yes I have, I believe we reviewed them last time, the main issue that came up was the sewer which had not been addressed or information given to Gary but since the engineer and Gary have met on at least a couple of occasions to my knowledge, reviewed that and I believe that complies with Gary's conditions. Tolsma: There is also one in there about the school park site. Kingsford: These are Mr. Forrey's comments not Mr. Smith's. Johnson: We do recognize that the area is (inaudible) a school site in that particular location, that general area. Tolsma: I think we handled the stub street to the north, Gary Fores property. Johnson: Correct, and per Gary's request we have made that a 50 foot right of way. ACRD only required a 40, we have complied with Gary's wishes and made that a 50 foot right of way. Tucker Johnson, 5635 North Eagle Road, was sworn by the Attorney. Johnson: Just by way of back ground on this particular project the Landing Subdivision there is a preliminary plat that is still in the a live state in the sense that we have perpetually been working on this particular plat. It became a requirement from I believe not only the City but Ada County Highway District to provide an additional access to some arterial road for traffic congestion purposes. We looked at Waltman Lane because of some difficulties with the intersection where it intersects the main boulevard through town. We redesigned it and have proposed the Landing No. 7 to come in to Linder Road and satisfied that need, to have another access in this particular project. We have met with the different agencies, ACHD and have come to agreement on some modifications to the original plat. If you have any questions I would be happy to answer them to the best of my ability. Kingsford: Any questions for Mr. Johnson? Tolsma: Do you agree with all the engineers comments? Johnson: I have read through the staff report and find nothing that is of an objectional nature from our side as we are currently working with the building department on such issues as the water flow which I have not run that computer model yet. And working with the engineering firms as to the sewer flow which will come out of Linder Road and down into the phase 2 of the Landing subdivision to provide the sewer facilities in that direction. Flores: On the number 7 I guess it is Landing I was not here at the Planing and Zoning hearing. I wrote a letter and gave it to Mr. Berg, I never did hear if that request was rejected or accepted, could anyone tell me whether it was or not? Kingsford: Mr. Johnson I think will speak to that, you are still sworn Tucker if you would come back up. Johnson: I was told the engineering firm that the Council had received the modified i • Meridian City Council March 15, 1994 Page 27 layout of the lots which addresses this gentleman's concern directly and providing a stub street 40 foot wide right of way I believe is what it is with that through ACHD with no parking space on this particular stub street. I certainly hope that what the engineers have told me is also what you have. As you can see there is that stub street going into his, which is your nursery operation. Kingsford: That meets your concerns then Gary. Johnson: That would give him access, he has a very narrow frontage on Linder Road. Kingsford: Right, I recall that discussion. at one point. Anything else Gary? Flores: Yes, the sewer is it going down Linder Road or is it coming in from a back slide and all services. Is it coming in from the east or coming down north and south on Linder? Kingsford: Could you address that Mr. Johnson please? Johnson: Certainly, the requirement is to provide water coming down extended south on Linder and the City's desire not to have any more lift stations the sewer will also come down Linder pending any potential elevations that have not been confirmed yet through the Power Engineering. The water is required to come down Linder and the sewer will also be a switch which will actually fit well into any development plans for him. Flores: I realize the water is already there but the sewer is not, what is your intent is to come down Franklin, down Linder all the way with the sewer? Kingsford: The sewer is coming from Franklin, how far does it go, where will the sewer be located? Johnson: I forget the name of the street but is the one closest to his property on the north, is it Pintail thank you, I don't five in that general vicinity. There is a manhole just as you turn off of Linder into Pintail one lot deep into the subdivision approximately 100 feet where the sewer services are, the manhole is located. So it would approximately be I believe it is about a rough estimate from the entrance of Landing 7 back to the manhole 500 feet perhaps I might be a estimating, but it is not all the way to Franklin. Flores: Sidewalks, are they going to continue from the original Landing to that or aren't they? I suppose that would be a question for the Highway District. Meridian City Council March 15, 1994 Page 28 Kingsford: Well, I'm sure it would be and also their engineer. Anyone else from the public that would like to offer testimony from the public on this issue? Seeing none I will close the public hearing. Council members. Morrow: I would like to have Wayne Forrey address the issue in his letter or his comments he says the preliminary plat is confusing regarding sewer service and compliance with the sewer facilities plan, can you enlighten us as to what you are referring to there. Forrey: Mr. Mayor and Councilman Morrow, one of the features that we included in the Comprehensive Plan was sewage drainage boundaries and that is based upon the City's facility plan which is a master drainage plan. The property under consideration is right here, right at the end of the pencil. The property that Mr. Flores owns is right here at the pencil the Landing No. 7 is right here. That gray line, it is a diamond line, this gray line right here is a drainage boundary. The property on the south of that line feeds into the Black Cat trunk which is not yet built. Morrow: That is the one that goes down Ten Mile Creek. Forrey: That is correct and the property on the north side Mr. Flores property would go into the existing sewer system that is in the Landing other phases and the line that he is referring to on Linder. So, I was confused when I looked at the plat because according to our facility plan that property is scheduled to flow into a future sewer line that is not yet built. Now, there are times when a property can sewer a few hundred feet either way of that line and there are times it can't. And I think Gary addressed that in his memorandum in November where he asked for clarification as to what the elevation of what the property was and how the sewer is going to flow. Gary, had you ever received anything from the engineers, so we are probably still as confused or needing the information as we were back in October. Morrow: So let me ask you this, the question here realty is can this sewer for this particular thing this particular property work as a gravity flow into the existing line or if it doesn't work as a gravity flow then there has to be a pump station or wait for the Black Cat interceptor is that right? Forrey: That is correct as I understand it. Kingsford: Well, we have had a policy for the developer to cross from one drainage area to another required Council approval and as a general rule we have not granted that. • Meridian City Council March 15, 1994 Page 29 Forrey: Did I miss anything Gary on that? I think at least that is how I interpreted the project. Smith: Right, that is correct. Mr. Mayor and Council members, Wayne hit on the point that we tried to stay within the drainage areas with these different sewer trunk lines and as Mayor Kingsford mentioned sometimes we do stray from one side to the other of these magic lines that are drawn on a piece of paper because of the ability to serve these areas and if they are in particular small areas we don't have a real problem with serving them capacity wise. The thing we want to watch is if we start taking property out of one drainage area allowing it to drain into a another drainage area and then when the sewer does become available for that particular drainage area this piece of property is gone and there is no ability for funding for either payback or LID purposes or whatever. This particular subdivision I had one discussion with the engineer and my comment to him was from my standpoint a lift station is not acceptable because of the fact it would be pumping into another lift station which then pumps into an exiting interceptor. When the Landing subdivision was designed a lift station was allowed and part of the reason for that lift station, the reason for that lift station was to allow service to extend to all of the Landing as preliminary plated. Now this piece was not part of that original preliminary plat, but it seems like all the way along we have been fighting gray on that sewer line as it was designed for the Landing. My only question to this particular development is how me what your elevations are, what your proposal is and I have not seen that. I have had one conversation with their engineer and I have not heard back from him other than my comments to him that the lift station from my standpoint was not acceptable. If the City Council tells me it is acceptable then that is what would happen but I just have a problem with pumping from one lift station to another. Morrow: May I ask you this question from a technical standpoint, if the grade is there and it is real marginal but at some point in the future when the. Black Cat interceptor is in is it difficult to push it through the Black Cat interceptor is that what I am understanding there. Are there no funds available or is there a possible solution there? Smith: Yes, Councilman Morrow, there is a possibility that a line could be stubbed out as it comes out onto Linder Road there could be a stub out of the manhole for future extension to the Black Cat trunk if that is the case. If it can sewer by gravity back to the Landing that has been developed then a stub could be provided at Linder Road where this subdivision has its access for future connection to the Black Cat trunk then that would just plug off and going into the existing Landing and then going on to the west into the Black Cat. 1 }, Meridian City Council March 15, 1994 Page 30 Morrow: So that is possible, but we can't make those decisions until we have the information from the engineer. Smith: That is correct. Kingsford: Any other questions from the Council? What is your pleasure? Morrow: Well I think from my perspective the issue of the sewer is very critical, it makes a determination whether this is a feasible project or not. And I am not comfortable making a decision subject to, there are several variables that can be worked through here dependant upon that engineering data from Skyline's engineer so that our engineer and staff have a better opportunity to determine what is doable and then provide us with that information so that we can make the decisions based on our alternatives. I don't see that information here. I think my personal preference would be to table, I don't like tabling things, to April 5th pending that information coming from Skyline's engineer so that we can make a decision.
