That the Applicant's property is not specifically included in a defined neighborhood as designated in the Meridian Comprehensive Plan but is located between Old Town and the Eastern Industrial Review Area; that it is concluded that the property is in compliance with the Meridian Comprehensive Plan since the proposal is in large part similar to the development of the Old Town area and with the development of Danbury Fair Subdivision and therefore the Application is in conformance with the Comprehensive Plan and does not conflict with the Rural Areas policies. 12. That in the Rural Area section of the Cornpr•ehensive Plan it does state that land in agricultural activity should so remain in agricultural activity until it is no longer economical to exclude orderly growth and development. 13. That proper and adequate access to the property is available and will have to be maintained, however Phase I will have to be developed before Phase II to meet the Fire Department's comments. 11. That the Applicant's property is not specifically I included in a defined neighborhood as designated in the Meridian Comprehensive Plan but is located between Old Town and the Eastern Industrial Review Area; that it is concluded that the property is in compliance with the Meridian Comprehensive Plan since the proposal is in large part similar to the development of the Old Town area and with the development of Danbury Fair Subdivision and therefore the Application is in conformance with the Comprehensive Plan and does not conflict with the Rural Areas policies. 12. This will be a totally piped system and should deliver water much better than what they have been used to. Giesler: Do any of those homeowners have a system in their property right now that this would need to be hooked into or? Loveless: We will coordinate the location of those valves to wherever their entry point is now. Yerrington: What size of line will you have for this water? Loveless: Minimum size would be 12, but more than likely a 15. One other thing I need to point out, over on the NE corner there at the sharp turn in W. 5th Street there's a landlocked parcel of ground there. We are designing two sewer services into that parcel because under your ordinance that piece of ground could support two separate lots under a variance for your frontage reduction so we are going to be stubbing out two four inch services into that parcel to accommodate any future development on that piece of ground. Crookston: On the lots that are going to back up to the alley, the listed square footage on those lots does that not include the alley? Loveless: No it does not include the alley. Crookston: For instance in Block 1, Lot 4, just visually comparing that lot with say Lot 8 of Block 3, Lot 8 of Block 3 is approximately 5 1/2 feet wider and it's about seven feet shorter just visually comparing the drawing those don't compute. STEVEN GREGORY: REQUEST FOR CLARIFICATION OF REQUIREMENTS FOR IMPROVEMENTS ON MAWS ADDITION: Kingsford: Mr. Gregory Gregory: Mayor and Council, regarding improvements on Locust Grove and Pine, the subdivision went back and forth at several stages whether there was curb/gutter/sidewalk required on the street, whether there was berming required, what was required exactly. The Final plat was approved and signed by the City not requiring berming or bonding for fencing or anything else and we assumed that's what the final requirements were. There was nothing in the Final requirements as they were turned in. In phase 2 we were required to bon for the fence on the north boundary and we built a fence on the north boundary. That would have been normal and we would have accepted that, and there would not have been a problem, but I'm not sure that 9 months after the fact when, I don't know exactly, I've never been in this position where 9 months later after somebody buys a home the neighbors are complaining and want the developer to go back and re-develop what they have purchased for themselves. Do you have any questions you can ask of me, I might be able to refresh your memory on? ., Meridian City Council December 7, 1993 Page 14 Kingsford: I think what Mr. Gregory is asking is relief from Mr. Forrey's letter stipulating as to what Mr. Gregory has to do, am I right? Gregory: Yes, correct. Kingsford: any questions of Council? Council approved as Mr. Gregory indicated there was some discussion as to whether it was going to be an arterial or not and whether there was face and so on. The plat was approved by the Council with berm, as to what showed up on the plat I couldn't tell you but our minutes in terms of researching what was approved at the Council it was with berm. Gregory: And that was without improvement by the Highway District, improving the road, and we were actually planning on improving the kind of no man's land at that time and would have been very easy when they cut the roads, to have them cut the roads and place the berm at that time. Its a great deal more expensive to come in later after homes are built and curb/gutter/sidewalk is built and put the ground in for a berm or something else. It is very inexpensive at the time you are building the subdivision to cut the roads and place a berm. Kingsford: I think what Mr. Forrey is asking though was a fence, if I'm not mistaken? Forrey: That is correct. Kingsford: Recognizing that is impossible to make a berm with the narrow land that you have now. The meeting that was held with the landowners they stipulated to a fence at this point. Gregory: Well, they also stipulated to funds in excess of a fence over a berm, which I felt is very. Kingsford: Of course that fund would be based on the cost of doing it, before you construct it. Gregory: Which building a berm at that time they we constructing the roads would have been basically free, because they have to take the dirt out of there and place it somewhere and they can place it in a strip or a berm for free. I would be willing to work with the homeowners and meet them half way and pay half of the cost of the fence if .that would be agreeable with the homeowners and the others involved. Kingsford: Mr. Forrey has met with them, maybe you could address that Mr. Forrey. Meridian City Council December 7, 1993 Page 15 Forrey: Mr. Mayor, members of 'the Council, Mr. Gregory, we had a meeting on November 15 and I believe there were 7 of the property owners in Maws Addition that attended that meeting. We discussed 3 alternatives and this is kind of thorny because the subdivision is now built as Mr. Gregory indicated, so it is a little bit difficult to go back and place a berm now that the right of way and curb/gutter/sidewalk. One thing we did point out at that meeting is that during the public hearing at the preliminary plat, which got into the Findings of Fact at the Planning and Zoning Commission and which was the basis of your approval of the Final Plat those same Findings of Fact and Conclusions of Law of the developers representative Mr. Pat Tealy indicated there would be 2 items a landscaped berm and curb/gutter/sidewalk. So there might have been some confusion Mr. Gregory, in the negotiations with the Highway District early on but ultimately it was approved by the City with the understanding that there would be both a 4 foot landscape berm and sidewalk facilities. Now we only have sidewalk and no berm . Looking at all that the neighbors agreed that a fence was probably a most doable remedy. And in the Findings of Fact the berm was mentioned as a screen and a buffer to the collector status of Pine and Locust Grove. So in this case the neighbors felt like the fence would accomplish that the screening from those higher traffic roadways. Their feeling was, and I agree with this, if the developer was going to put in something that had value certainly it would have been much less expensive at the time the road was built I grant that but there is a value to the dirt and there is a value to the landscape charge, whatever that value is that should have been placed in the subdivision. So if we could get a landscape architect or a contractor to estimate. that cost that is what the neighbors felt was a workable solution, whatever that cost is apply that to a fence, if that value is greater than the cost of the fence than that money could be given to the homeowners association to do more landscaping and beautify their subdivision. And that is our request right from the homeowners that have invested. That is the solution that is the basis for my letter to Mr. Gregory, I asked him to give me an indication if he would proceed on that basis and I haven't received and I guess we're at least communicating and that is positive, we need to get to a solution. Kingsford: Were you at that meeting Mr. Gregory with the homeowners? Gregory: I showed up a half hour early and nobody was here so I left, and no I was not. Kingsford: What is your recommendation Mr. Forrey? .. Meridian City Council December 7, 1993 Page 16 Forrey: Mr. Mayor, members of the Council, we have 7 property owners that have invested money and we have Findings of Fact and Conclusions of Law your approval was based upon that, I think we have done the right thing. We have contacted people we are working with Mr. Gregory we have outlined a solution I think we need to stick to it. The neighbors have agreed a fence would suffice for a screening effect so minimally there needs to be a fence in their opinion. Any extra funds maybe moved, I don't know if that is appropriate, there is not a neighborhood association organized at this point Mayor to handle those extra funds if there any, but there are people who don't have a fence that were promised that there would be a buffer to those roadways and I think it is important that we provide that and I think my letter is a mechanism to get that accomplished. And I think there are some property owners here, several, they might have some input too Mayor. Kingsford: Does Council have any questions of either the property owners of Mr. Gregory? Corrie: Mr. Gregory, you are completely in disagreement to put a fence up, I mean by your self now? Gregory: No, (inaudible) Corrie: Okay, you don't want to pay all of it. I understand what you are saying, however I do agree with the City Planner its in our Laws and Conclusions I think that we approved under the condition the berm would be there, and the berm is not there I agree with the solution the City Planning Director has said that we should find out what that berm should have cost and apply that to a fence. I think homeowners deserve something here, I understand what you are saying but also I understand that the homeowners bought that property with the thought that there was going to be a berm there and I personally think that the fence should be put up by you and I don't know how the other Council feels but if we approve something and its not done then I think that it should be done. We can't put the berm in there now as you see but I think the fence would be proper its not going to be that big of a cost and that is my feeling (End of Tape) but these people bought in that property thinking what they were going to get and they didn't get that. I understand that, but I don't think the value of the fence should be that high that you wouldn't put it in so that is where I'm coming from . Gregory: Pardon me for interrupting, the fence was never represented, the people bought the property and the lots as is, it was never represented by the developer or development that there would be a fence built on the property. It was never represented by myself that there would be a fence there or that there would be Meridian City Council December 7, 1993 Page 17 berm there, it was never represented either way, they bought the property as is what they got and I did not represent either one. I was unaware that there was a requirement for a berm. Corrie: i misunderstood along the line I thought that your representative was here stated that there was going to be a berm there now is that incorrect? Was he your representative? Gregory: He was my engineer that is correct. And generally in the period of negotiation if something is required, when you go to have the plat signed off you are required to put a bond at that time such as the fence on the north boundary, which I put up the bond and put up the fence, its completed the bond is released and the fence is paid for. It is just a matter of due course and if it would have been required on the fist phase and completed the lots would have sold for a great deal lower than $16,000 a piece, the lots would have been a lot more valuable with a fence than $16 , 000 , you sell the lots for $16,000 and then come back and say I want a fence and a berm I want this and that. If I buy a Pinto at the car dealership and then go back and want a Lincoln,t he Lincoln is a lot more valuable. I mean if you get a fence and a berm and this and that if you buy it as is that is what you get. Corrie: I guess I have a question for the Counselor, can we make him put a berm in there? Crookston: The representation was that there was going to be a berm, and that is what the Findings are based upon . I think it makes sense to work a substitution because of the requirements of what ACHD did. Gregory: I have tried to compromise and tried to work with. Crookston: Maybe we could have another meeting? Corrie: I don't know, if that would be apropos to the developer and the people and maybe, I think its something that should be worked out however to the satisfaction to both parties. Kingsford: Well it seems to me that what has happened here is the Council approved something and it wasn't built and if that wasn't specific on the plat it is still in the minutes and its still in the approvals, that was never changed by the Council. To me it ought to be done that way, and since it not realistic to make a berm it would be too steep you would never get grass to stay on it, but there ought to be a remedy in terms of screening, because that was the intent both in P&Z and Councils. That ought to take place if the developer wants to work with the Planner on the type of a fence and that sort of a thing, I think that ought to take place i •.r Meridian City Council December 7, 1993 Page 18 but there needs to be something in place there on both of those streets. Council concur, do we need a motion, I think the direction has been given by the Planning Director and that will stay unless there is a motion to appeal of Mr. Gregory. I wanted to let you know that I have a listing for the attempt to sell the Creamery, this time, I understand it has been attempted often before or at least once before. I've been in the area, I've been here for 5 years I didn't know its history, its interesting to learn but I have accepted that challenge and I hope I can do it. I'm just here this evening to outline for you my current marketing methods and to answer any questions that you might have that I could answer and I invite your comments and suggestions or subsequent calls to me regarding issues or thought you might have. If I may Mr. Mayor I'd like to distribute a few things so you folks can see what I'm speaking about. Okay, before you is a bit of data I will be sending to selected certified commercial investors in the major cities of the pacific northwest. So we have a 60,000 square foot building sitting in the center of city basically over 2 acres and I would any questions, comments of things you might have to say. I expect that you might really see that as a possible obstruction to what you would like to do in your city and I'm certainly open to anything I can do relative to making the best use of this property as owned by the people I work for, the listing agent and creating something there that would be good for your city. Section 2. That the property shall be subject to de- annexation if the owner or his assigns, heirs, or successors shall not plat the property as submitted by Applicant and designate on the plat that only single-family dwellings shall be allowed, construct water and sewer line extensions to serve the property, and construct streets to and within the property, meet the requirements and conditions of the Findings of Fact and Conclusions of Law and of this Ordinance; if Applicant fails to meet these conditions the property shall be subject to de- annexation, which conditions subsequent shall run with land and also be personal to the owner. Section 3.
