01-920 AZ Silverstone Corporate 01-001 (101074954)~,~JA COUNTY RECOROER J, DAVtO NAVARRO BOISE, IDAHO 2 tll JL 26 PPI 2:36 RECORDED- REOUEST OF MERIDIAN ?.T~ '~..~ FEE ~ DEPUTY~ qfl, , 0107h95k CITY OF MERIDIAN ORDINANCE NO. 01- AN ORDINANCE FINDING THAT CERTAIN LAND TO BE KJNOWN AS SILVERSTONE CORPORATE CENTER THE LOCATION OF WHICH LIES CONTIGUOUS OR ADJACENT TO THE CITY LIMITS OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO; AND FINDING THAT THE OWNER HAS MADE A REQUEST FOR ANNEXATION IN WRITING TO THE COUNCIL; AND THAT SAID LAND BE ANNEXED TO THE CITY OF MERIDIAN AND ZONING DESIGNATED COMMERCIAL BUSINESS DISTRICT (C-C) AND GENERAL RETAIL AND SERVICE COMMERCIAL DISTRICT (C-G); AND DECLARING THAT SAID LAND, BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW, BE A PART OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF MERIDIAN, IDAHO; AND DIRECTING THE CLERI( OF THE CITY OF MERIDIAN TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREAS TO BE ANNEXED WITH ADA COUNTY RECORDER, AUDITOR, TREASURER AND ASSESSOR, AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO, PURSUANT TO IDAHO CODE SECTION 50-223 AND SECTION 63-2215. BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO: SECTION I. FINDINGS:That the following described land is contiguous and adjacent to the City of Meridian, Idaho, and that the City of Meridian has received a written request for annexation to the City of Meridian, Idaho, by the owner of said Property to-wit: ANNEXATION AND ZONING ORDINANCE (AZ-01-001) 1 Community Business (C-C) Property: A parcel of land being a portion of the West 1/2 of the Northwest 1/4 of Section 2 I, Township 3 North, Range 1 East, Boise Meridian, Ada County, Idaho. Said parcel is more particularly described as follows: Commencing at the Northwest Corner of said Section 2 i, said Corner being the POINT OF BEGINNING; thence, South 00014'50'' West 1,807.29 feet along the section line, being the centerline of South Eagle Road; thence, South 89°45'10'' East 425.00 feet to a point on a curve; thence 471.24 feet along said curve to the left, said curve having a radius of 300.00', a delta of 90°00'00'', and a long chord bearing North 45014'50" East 424.26 feet; thence, North 00014'50'' East 281.04 feet to a point on a curve; thence, 146.36 feet along said curve to the left, said curve having a radius of 300.00 feet, a delta of 27°57'10'', and a long chord bearing North 13043'45" West 144.91 feet; to a point on a curve, thence 617.60 feet along said curve to the right, said curve having a radius of 300.00 feet, a delta of 117°57' 10", a long chord bearing North 31 ° 16' 15" East 514.17 feet, to a point on a curve; thence, 471.24 feet along said curve to the left, said curve having a radius of 300.00 feet, a delta of 90°00'00'', and a long chord bearing North 45014'50" East 424.26 feet; thence, North 00014'50'' East 333.56 feet to a point on the section line of said Section 21, said line also being the centerline of West Overland Road; thence along said section line North 89013'50'' West 1255.05 feet to the POINT OF BEGINNING. ANNEXATION AND ZONING ORDINANCE (AZ-01-001) - 2 Said parcel contains 36.6 acres, more or less. General Retail And Service Commercial (C-G) property: A parcel of land being a portion of the West 1/2 of the Northwest 1/4 of Section 21, Township 3 North, Range 1 East, Boise Meridian, Ada County, Idaho. Said parcel is more particularly described as follows: Commencing at the Northwest Corner of said Section21, thence South 00°14'50" West 1,807.29 feet along the section line, being the centerline of South Eagle Road to the POINT OF BEINNING; thence, South 89°45'10'' East 425.00 feet to a point on a curve, thence 471.24 feet along said curve to the left, said curve having a radius of 300.00', a delta of 90°00'00'', and a long chord beating North 45014'50" East 424.26 feet; thence, North 00014'50'' East 281.04 feet to a point on a curve; thence, 146.36 feet along said curve to the left, said curve having a radius of 300.00 feet, a delta of 27°57'i0'', and a long chord bearing North 13043'45" West 144.91 feet; to a point on a curve, thence 617.60 feet along said curve to the tight, said curve having a radius of 300.00 feet, a delta of 117°57'i0'', and a long chord bearing North 31°16'15'' East 514.17 feet, to a point on a curve; thence 471.24 feet along said curve to the left, said curve having a radius of 300.00 feet, a delta of 90°00'00'', and a long chord bearing North 45014'50" East 424.26 feet; thence, North 00014'50'' East 333.56 feet to a point on the section line of said Section 21, said line also being the centerline of West Overland Road; thence along said section line South 89°13'50" East 77.45 feet; to a point on the east line of said West lA of the Northwest 1/4; thence, leaving said section line, ANNEXATION AND ZONING ORDINANCE (AZ-01-001) - 3 South 00°13'16" West 2654.36 feet along said east line to the southeast corner of said West %; thence North 89°07'33" West 1333.74 feet to a point on the section line of said Section 21, said line also being the centerline of South Eagle Road; thence along said section line North 00°14'50" East 844.62 feet to the POINT OF BEGINNING. Said parcel contains 44.6 acres, more or less. SECTION 2: That the above-described real property be, and the same is hereby annexed and made a part of the City of Meridian, Ada County, Idaho. SECTION 3: That the real property herein by this ordinance annexed to the City of Meridian hereinabove described shall be zoned Commercial Business District (C-C) and General Retail and Service Commercial District (C-G). SECTION 4: That the City Engineer is hereby directed to alter all use and area maps as well as the official zoning maps, comprehensive plan and all official maps depicting the boundaries of the City of Meridian in accordance with this ordinance. SECTION 5: The zoning designation set forth in Section 3 of this ordinance is subject to the terms and conditions of that certain Development Agreement by and between the City of Meridian and the owner of the land described in Section i dated the /746 day of J~[~ , ~ool , and that the uses are to be developed under the planned unit development process and conditional use permit process. ANNEXATION AND ZONING ORDINANCE (AZ-01-001) - 4 SECTION 6: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 7: This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. SECTION 8: The Clerk of the City of Meridian shall, within ten (10) days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries of the City of Meridian, including the lands herein annexed, with the following officials of the County of Ada, State of Idaho, to-wit: the Kecorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this ordinance and map with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code §63-2215 and §50-223.
