382 Resisting an Officer d38 ORDINANCE NO. 382 AN ORDINANCE AMENDING TITLE VIII. CHAPTER X. ENTITLED RESISTING AN OFFICER OF THE REVISED AND COMPILED ORDINANCES OF THE CITY OF MERIDIAN. ADA COUNTY. IDAHO. BY , ADDING TO SAID CHAPTER A NEW SECTION 8-1005 ENTITLED OBSTRUCTIONS IN THE PERFORM-:' ANCE OF DUTY. -. WHEREAS, the City Council and the Mayor of the City of Meridian. Idaho have concluded that it is in the best interest of said City to amend Title VIII, Chapter X, by adding thereto a new Section 8-1005, regarding obstructions in the perform- ance of duty of a police officer, or city employee, NOW, THEREFORE. BE IT ORDAINED BY THE MAYOR AND THE CITY OF MERIDIAN AND THE CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, Section 1. That the following Section 8-1005 shall become a part of Chapter X of Title VIII and shall read as follows: 8-1005 OBSTRUCTIONS IN THE PERFORMANCE OF DUTY: When any form of personal or real property causes a delay or obstructs any public officer or city employee from performing their duty, the personal or real property may be moved and/or impounded, as necessary or required to eliminate the resistance or obstruc- tion, at the owners', keepers' or tenants' expense. Section 2. WHEREAS, there is an emergency therefor, which emergency is de- clared to exist, this Ordinance shall take effect and be in force and effect from and after its passage, approval and publication as required by law.
