AMENDED ORDINANCE NO. 356
AN ORDINANC~ AMENDING TITLE VII, CHAPTER 5, ENTITLED SEWER USE OF THE
COMPILED ORDINANCES OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, BY
PROVIDING FOR A CORRECTION IN THE SECTION NUMBER, CHANGING THE SAME
FROM 7-551 TO 7-540.
WHEREAS. the City Council and the Mayor of the City of Meridian,
Idaho, have concluded that it is in the best interest of said City to
amend Title VII, Chapter 5, Section 7-551 by correcting the Section
number 7-551 to 7-540.
NOW-, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF MERIDIAN, ADA COUNTY, IDAHO,
Section 1. That Section 7-540 of Title VII, Chapter 5 is hereby
amended to read as follows: -
7-540 DELINQUENCY NOTICE. If a sewer user has not paid his
monthly charges by the tenth of the month~ it shall be
deemed delinquent, The City shall follow the procedure set forth in
5-133 of the Ordinances of the City of Meridian for termination of
water services, and shall cause the water supplied to said sewer user
to be turned off from the premi ses, the City taki ng noti Ge -that ,.without
water, the sewer system of the user cannot be used and shutting off the
water is the only way to prevent the use of the sewer for 'nonpayment;
provided, if the charges are not paid within the ten days after the
delinquency notice, an additional penalty of one dollar and fifty cents
($1.50) or fifteen percent.-tif charges due, whichever is greater, will be
added to the account. All delinquent charges or fees, as provided by this
Ordinance, not paid after the final determination of the sewer usersl account
shall be imposed as a lien against and upon the property or premises against
which such charge or fee is levied or assessed, and the City Clerk shall, at
the time of certifying the City taxes, certify such delinquencies together
with all penalties to the Tax Collector of Ada County, Idaho, and when so
certified the same shall be a lien upon the property and will be collectible
as other taxes.
All monies collected by the City Clerk under the provisions of this Section
shall be paid over to the City Treasurer in the same manner as is required
for the payme~t of other City monies.
Section 2. WHEREAS, ~here is an emergency therefor, which emergency is
declared to exist. this Ordinance shall take effect and be in force from and
after its passage, approval and publication as required by law.
PASSED by the City Council and approved by the Mayor of the City of
Meridian, Ada County, Idaho, this 7th day of July, 1980.
