ORDINANCE NO. 229
AN ORDINANCE AMENDING ORDINANCE NO. 197 OF THE REVISED AND COMPILED
ORDINANCES OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO DEALING WITH DRIVING
WHILE UNDER INFLUENCE OF LIQUOR IN AND FOR THE CITY OF MERIDIAN.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN,
ADA COUNTY, IDAHO:
Section 1. That Section 10-138: (B) 2 and 3 of the Revised and
Compiled Ordinances of the City of Meridian, be, and the same are hereby
amended as fo11~ws:
10-138:
(B) 2. If there was at the time in excess of five hundredths per
cent (O.O~) but 1es8 than U. eight hundredths per cent (0.08;6) by weight
of alcohol in the defendant's bloOd, such fact shall not give rise to any
pres)umption that the defendant was or was not under the influence of
intoxicating liquor, but such fact may be considered with other competent
evidence in determining the guilt or innocence of the defendant;
3. If there was at the time .-- eight hundredths per cent (O.O~)
or more by weight of alcohol in the defendant's blood, it shall be presumed
that the defendant was under the influence of intoxicating liquor;
WHEREAS, there is an emergency therefor, which emergency is hereby
declared to exi~t, this Ordinance shall take effect and be in force and
effect from and after its passage, approval and publication as required
by law.
