213 Fire Prevention Code 92 ORDINANCE NO. 213 AN ORDINANCE ADOPTING THE FIRE PREVFJNTION CODE, ALLOWING SELF-SERVICE STATIONS, IMPOSING REGULATIONS THEREON AND PROVIDING PENALTIES FOR THE VIOLATIONS THEREOF. BE IT ORDAINED BY THE MAYOR AND CI1'Y COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:- Section 1. ADOPTION OF FI~E ~REVENTION CODE: The fire prevention code is adopted for the purpose of regulating and governing conditions hazard9us to life and property from fire. The Fire Prevention Code, 1970 Edition, as recommended-by-theAmerican Insurance Association, is hereby adopted. Said fire prevention code, three (3) copies of which shall be on file at all times in the Office of the Clerk of the City of Meridian, shall be made a part of this code aR if set out jn length herein. Section 2. MODIFICATIONS: Said Code is hereby adopted with the following modifications: Section 16.75e(2) is modified to read as follows: Automatic~nozzels with latch- open devices. Tn lieu of being held open by hand, an approved automatic nozzle may be used for dispens-ing- Class I liqtlid into the fuel tank of an vehicle. Such a nozzle shall have the latch-open devise as an-lntegral part-of the assembly and shall shut off the liquid reliably and positively'when the gasoline tank is filled, when it falls from the filling neck of an automobile tank, when it is subject to rough usage such as dropping or lack of proper lubrications-, or when an auto- mobile is driven away while the nozzle is still in the tank. A competent attendant shall be in the immediate vicinity of the vehicle being -filled by such an approved nozzle; provided that self-service stations shall be governed by the provisions of Section. 16.75e(1).- . Section 3. ADDITIONS: There is added her~to Section f6.75g to read as follows: Section 16.75g Regulations for self-service stations. (1) REMOTE CONTROL ROOM: Where dispensing units are controlled from a remote station, a control room, so located that the operator will normally have a clear and unobstructed view of all pump islands, and of any pump.noz~le while in operation by a self-service patron, shall be provided. - r ~ <__ (2) UNATTENDED DEFINED: For the purposes of this Chapter, the -wo~_d "unattended" is hereby defined to mean the failure of the vendor of Class-I'Liqui-d,- ~r ~~~is authorized agent or employee, to be present at the actual physical-site or-;~ location of the dispensing devise of such liq~id at all tirries wh:i,.le $uch qeyjJ,e is in operation. ~ (3) COMMUNICATION SYSTEM:, Where dispensing units are controll~d .from a remote station, a two-way communiCation system of public address type ~hall b~provided to facilitate direct and individual communication between thecontrol~_ro~ and each pump island. -- ". (4) ATTENDANTS: There shall be not less than one attendant of at. least 16 years of age, mentally and physically qualified, on duty at all times while the station is open to the public, whose principal function, while the self-service gasoline dispensing equipment is in use, is to supervise the dispensing of gasoline by the self-service customer. (5) INSTRUCTION OF ATTENDANTS: All attendants shall be thoroughly instructed in the operation of the public address system, where required, the fire exting- uishing apparatus, the operation of the dispensing units and safety regulations for the dispensing of Class 1 liquids. 'rhe diBpensing units shall be shut-off when patrons do not follow instructions. (6) AUTOMATIC SHUT-oFF NOZZLE: Every self-service gasoline pump shall be pro- vided with an automatic shut-off nozzle, with a latch-open devise, and with a vacuum operated valve so designed and constructed as to automatically shut off before gasoline overflows. Such nozzle shall be maintained in proper and effec- tive operating conditions at all times. (7) AUTOMATIC LOCKING DEVICE: Each dispensing unit for Class I liquids shall be provided with an automatic locking device that prevents the re-use of the unit after the hose has been replaced until the unit has been manually un- locked. A computing pump that automatically prevents re-use until are-set device is operated may be approved as complying with the provision of this section. (8) I~CKING DISPENSING UNITS: Each dispensing device for Class I liquids at a self-service station shall be kept locked or otherwise maintained inoperable at 8.11 times that tl1e station j s unattended. (9) SPECIAL SAFETY PRECAUTIONS: Each self-service station shall be equipped with sufficient "No Smoking" signs as to be readily observed by patrons from any point within the dispensing area. The operator must refuse service to any customer who is smoking, or who appears for any reason to be unable or incompe- tent to operate the self-service equipment. (10) PUMP ISLANDS: A driveway of not less than 16 feet shall be provided between pump islands and between any pump island and building. Not more than 4 pumps shall be placed on one island. (11) DRIVEWAYS: Sufficient clearance shall be allowed as an exit driveway that will permit cars to leave the premises without interfering with service or in- coming cars. Where oil windshield and air Bervices are available, separate areas shall be provided and located 60 not to interfere with entry or exit of cars. (12) STATION SURFACE: The entire area of any station near the pump island and buildings on where it is likely that a Class I liquid might be spilled shall be surfaced with cement, blacktop or some other surface sufficiently hard that it can be washed with water under pressure in the event that a Class I liquid is spilled. I I 93 Continued ORDINANCE NO. 213 Section 4. ADDITION: There is added hereto Section 1.15 which shall provide as follows: (a) PENALTIES. Any person who will violate any of the proV1sJ.ons of this code hereby adopted or fail to comply therewith, or who shall fail to comply with an Order of the Fire Chief or Fire Inspector within a reasonable time or who shall violate or fail to comply with an Order made thereunder,_ or who shall build in violation of any detailed at~tement of specifications or plans sub- mitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken or which-shall-fail to comply with such Order as affirmed or modified .by the City of Meridian Or by a Court o'fcompetent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance respectively, be ~uilty of a misdemeanor, punish- able by a fine of not more than Three Hundred Dollars ($300.00) or by imprison- ment~forl-not more than thirty (30)- days or by both such fine and imprisonment. The imposition of one penalty for any violation shall not excuse the violation or permit to continue; and all such persons shall be required to correct or remedy -such violation or defect wi thin a reasonable time; and when not otherwise specified, each ten (10) days that prohibited conditions are maintained shall constitute a separate offense. (b) The application of the above penalty shall not be held to prevent the enforced removal or prohibited conditions. (c) Unless otherwise shown the reasonable time for compliance with any order of the Fire Chief or Fire Inspector shall be pre sume d- to be ten (10) days. Section 5. All former ordinances or parts thereof conflicting or inconsistant with this ordinance and provisions thereof or of the code hereby adopted are hereby repealed. _ Section 6. VALIDITY: The City of Meridian hereby declares that should any section, paragraph, sentence, or word or this Ordinance or of the Code hereby adopted be declared for any reason to be invalid, His the intent of the City that it would have passed all other portions of this Ordinance independant of the elimination here from or any such portion as may be declared invalid. WHEREAS, there is an emergency therefor, which emergency is declared to exist, this Ordinance shall take effect and be in force from and after its passage, approval and publication as required by law.
