ORDINANCE NO., 164
AN ORDINANCE SETTING FORTH CERTAIN ACTIONS WHICH CONSTITUTE MISDEMEANORS IN THE CITY
OF MERIDIAN, NOW HAVING THE STATUS OF A FIRST CLASS CITY, IN THE COUNTY OF ADA,
STATE OF IDAHO.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA
COUNTY, IDAHO:
_ WHEREAS, the City of Meridian has been changed from the status of a
second-class city to the status of a first-class city by the 1967 Legislature of
the State of Idaho; and
WHEREAS, the Mayor and City Council desires to establish the certain
actions which constitute misdemeanors in the City of Meridian as a first-class city;
Section 1. The following shall be deemed the certain actions which con-
stitute misdemeanors in the City of Meridian as a first-class city:
AID IN ESCAPE: It shall be unlawful for any person to aid or assist any'
person to escape from lawful confinement or to assist any person to escape from the
custody of any peace officer. -
AID TO AN OFFENSE: It shall be unlawful for any person, in any way or
manner, to aid, abet, counsel, advise, or encourage any other person in the commis-
sion of such offense hereby defined.
ARSON: It shall be unlawful for any person to commit arson which is hereby
defined as to maliciously and deliberately set fire to or burn or cause to be burned,
o~ aid, counsel, or procure the burning of any dwelling or other valuable property
either of himself or others.
ASSAULT OR BATTERY: It shall be unlawful for any person to commit assault
or battery which is hereby defined as any wilful and unlawful use of force or vio-
lence upon the person of another.
~EER, PROCURING OR SELLING TO MINORS: It shall be unlawful for any person
to prooure, sell, or give away any beer to any person under the age of twenty (20)
years or for any person under the age of twenty (20) years to purchase, attempt to
purchase or otherwise procure, consume, or have in his possession any beer.
CONCEALED WEAPONS: Any person excepting peace officers who shall carry
any slingshot, or any concealed deadly weapon within the City shall upon conviction
thereof, be liable to the general penalty clause of this code. ~
DEPOSITS OF INJURIOUS MATERIAL ON THOROUGHFARES: It shall be unlawful for
any person to deposit, place, or allow to remain in or upon any public thoroughfare
any material or substance injurious to persons or property."
DISORDERLY CONDUCT: It shall be unlawfu+ for any person to engage in any
illegal or improper diversion or to use insulting, indecent or immoral language, or
to be guilty of any indecent, insulting, or immoral conduct or behavior.
DISORDfltLY DANCE }U~LLS: It shall be unlawful for any person to keep a
dance hall where lewd or disorderly persons assemble together for the purpose of
dancing.
DISORDERLY HOUSES; It shall be unlawful for any person to keep a dis-
orderly house or place of business, or to allow, permit, or suffer in any house or
place or building kept, used, or occupied by him within the limits of the City any
drunkenness, quarreling, fighting, unlawful games, or riotous or disorderly conduct.
DISTRIBUTION OF OBSCENE LITERATURE: It shall be unlawful for any person
to exhibit, pass, give or deliver to another any obscene, lewd, or indecent book~
pamphlet, picture, card, print, paper, writing, mold, cast or figure or to have same
in his possession.
DISTURBING THE PEACE: It shall be unlawful for any person, wilfully,
maliciously, intentionally, or unnecessarily, to disturb the peace and quiet of
another or of any neighborhood or family or religious congregation or other assembly
by loud or unusual n9ises or indecent behavior or by offensive or unbecomi~g con-
duct for any person to threaten, quarrel, fight or provoke an assault or battery or
curse or swear or utter any obscene or vulgar or indecent language in the presence
of another.
DRUNKENNESS: It shall be unlawful for ~ny person to be found drunk, in-
toxicated, or underfue influence of intoxicating liquor upon any public thorough-
fare or other public place.
ENCOURAGING DELINQUENCY: It shall be unlawful for any person, by any act
or neglect, to encourage, aid or cause a child to come within the purview of the
juvenile authorities; and it shall likewise be unlawful for any person, after notice
that a driver's license of any child has been suspended or revoked, to permit such
child to operate a motor vehicle during the period that such driver's license is
suspended.
ESCAPES: It shall be unlawful for any person convicted of any offense or
in lawful custody to escape or attempt to escape from custody.
FAILURE TO APPEAR: It shall be unlawful for any person receiving a traffic
ticket, summons, or any other document issued to him by a police officer or the police
judge of the City to fail to appear as directed on said ticket, summons or document.
FALSE PRETENSES: It shall be unlawful for any person to obtain any food,
drink, goods, wares or merchandise under false pretenses, or to enter any public place
and call for refreshments or other articles and receive and refuse to pay for the same,
or depart without paying for or satisfying the person from whom he received the food,
goods, wares and merchandise.

FRADULENTLY AVOIDING PATI~ENT OF ADMISSION FEES: It shall be unlawful for any"
person fradulently to enter, without paymen~ of the proper aillDission fee, any theatre,
ballroom, lecture, concert, or other place where admission fee~ are charged, provided
however, that nothing herein contained shall be deemed to prohibit or restrict the
free admission of police officers engaged in the performance of police duties to any
place of public entertainment or amusement.
:E'UHNISHING IvEAPONS AND OTHER ARTICLES TO PRISONERS: It shall be unlawful for
any person to furnish or attempt to furnish or take into jailor to deliver to any
prisoner therein confined, or in the custody of any officer, any weapon, tool, intox-
icating liquors, drug or other article without the consent of the officer in charge.
GENElli\L OFFENSE: It shall be unlawful for any person to commit any act or fail
to perform any requirement which is prohibited o~ required by State Law ,inso'far as
such Laws are applicable to municipal government.
GIVING ASSISTANCE TO POLICE OFFICER: It shall be unlawful for anymale citizen
over the age of eighteen (18) years to refuse or neglect to render assistance to any
police officer when called upon for such assistance or aid in the suppression of riot
or other unlawful assemblage or in the arrest of any person who has committed an
offense.
HOUSE OF PROSTITUTION: It shall be unlawful for-any person to keep or assist
in the keeping of a house of ill-fame or prostitution or knowingly to reside therein
or knowingly to rent, lease or permit any person to occupy any house or room owned,
leased or controlled by him for this purpose.
IHPEPuSONATING AN OFFICER: It shall be unlawful for any person to falsely re-
present himself to be an officer of the City or attempt to impersonate any officer,
or without authority, to perform any official act for or on behalf of such officer.
INDECENT EXPOSURE: It shall be unlawful for any person to appear in a state
of nudity or in any indecent or lewd dress or condition in any public place or in
any such place to make any indecent exposure of his or her person or private parts
thereof or the private parts of another or to conduct himself in a lewd or lascivious
manner or to appear in any such place in a dress not belonging to his sex.
KEEPING OF JUNK RESTRICTED: It shall be unlawful for any person to store or
keep any old articles or materials which may be classified as junk adjacent to or in
close proximity to any school house, church, public parks, public grounds, business
buildings or residences without first providing proper and tight buildings for the
storage of the same.
LE\~D COHABITATION: It shall be unlawful for any man or woman not being married
to each other, to live and cohabit together as man and wife, or lewdly and notoriously
to associate together.
LUG vJHEELS PROHIBITED: It shall be unlawful for tractors with wheels injurious
to pavement to be permitted upon the public thoroughfares unless the operator of such
vehicle shall first plank such street.
HALICIOUS INJURY TO PROPERTY: It "shall be unlawful for any person wilfully
and maliciously to injure, deface, mutilate, remove, pull down, break or in any mannner
interfere with or molest or secrete or destroy any real or personal property belong-
ing to or under the control of any person.
MINORS IN POOL HALLS: It. shall be unlawful for any person to permit any minor
under the age of eighteen (18) years-to frequent or loiter in a pool or billiard hall
where beer or intoxicating liquor are sold.
'MOLES'rrNG FIHE APPARATUS: It shall be unlawful for any person to" handle,
molest, use, carry away, injure, or destroy any apparatus or property belonging to
the Fire Department or fire'system of the City for any other purpose than-the preven-
tion or suppression of fires and drill of the Fire Department.
HUFFLER: UNNECESSARY NOISE: It shall be unlawful for any :person to operate a
motor'vehicle which shall not at all times be equipped with a muffler upon the eTI1aust
thereof in good working order and in constant operation to prevent excessive or un-
usual noise and it shall be unlawful for any person operating any motor vehicle to
use a cut~out, by-pass or similar muffler elimination appliance.
NUISANCES DEFINED: Anything which is injurious to the health or morals, or
indecent or offensive to the sense or an obstruction to the free use of property so
as to interfere with the comfortable enjoyment of life or property is declared a nu-
isance and as such shall be abated.
OBSCENE CONDUCT: It shall be unlawful for any person to urinate or stool in
any place open to the public view, or to be guilty of any'lewd, lascivious or ob-
scene conduct or to sing any lewd or obscene song, ballad or otherwQrds in any
public place or any other place where other persons are present or indecently to
exhibit any animal. .
PETIT LARCENY: It shall be unlawful for any person to commit petit larceny
cW1ich is hereby defined as a larceny when the property talcen is of a value of less
than sixty dollars ($60.00)
PROSTITUTION: It shall be unlawful for any person to pursue or advertise in
any manner her vocation as a prostitute or for any person to advertise the profess-
ion of a prostitute or solicit for a prostitute.
RIOT: It shall be unlawful for any person to fail or refuse immediately to
disperse upon an order to do so by a police officer, when two (2) or more persons
are assembled ~irthe purpose of disturbing the peace or for the purpose of commit-
ting any unlawful act.
SALE OF CIGAR~TTES OR TOBACCO TO MINORS: It shall be unlawful for any person
- to sellar give away, directly or indirectly, to any person under the age of eighteen

(18) years any cigarettes, tobacco, or any compounds of tobacco used in filling
up or making up of a cigarette or to give or sell any cigarette papers to
minors.
SWINDLING: It shall be unlawful- for any person, who by color or aid of any
sleight of hand performance, or by fraud or by fraudulent scheme, cards, dice or
device, to win for himself or for another any money or property or a represent-
ative of either.
TRESPASSING: It shall be unlawful for any person to take down any fence or
to let down any bars or to open any gate in or on the property of another without
the consent of the owner, occupant or person in charge thereof.
UNLAWFUL ASSEMBLY: It shall be unlawful for two (2) or more persons to
assemble together for the purpose of disturbing the peace or for the purpose of
committing an unlawful act and not to disperse upon the command of an officer so to
do.
VAGRANCY: It shall be unlawful for any person without visible means of
support and the physical ability to work not to seek employment or labor, or to re-
fuse to work when employment is offered him, or for any person to seek alms as a
business, or for any person to roam about from place to place without any lawful
business, or for any idle or dissolute person or associate of kno1rm t~:!.ieves to
wander about the streets at a late and unusual hour of the the night, or to lodge in
any other place than is kept for lodging purposes without the permission of the
owner of property or the person in possession thereof; or for any person to consort
habitually with common prostitutes, habitual drunkards, or any user of narcotics.
- WILFUL CONCEALMENT or GOODS, 'dARES OR MERCHANDISE: Whoever without authority,
wilfully conceals the goods, wares, or merchandise of any store or merchant while
still upon the premises of such store or merchant shall be in violation of this Code.
Goods, wares or merchandise found concealed upon th~ person shall be prima facie
evidence of a wilful concealment.
Section 2.' WHEREAS, there is an emergency therefor, which emergency is hereby
declared to exist, this Ordinance shall take effect and be in force and effect from
and after its passage, approval and publication as required by law.
Passed by the City Council and approved by the Mayor of the City of Meridian,
Ada County, Idaho, tIus 12th day of June, 1967.
