ORDINANCE NO. 101
AN ORDINANCE JvIAKING IT UNLAWFUL TO PRACTICE HYPNOSIS BY ANY PERSON
OTHER THAN LICENS3D AND QUALIFIED DOCTORS OF MEDICINE, DENTISTRY
AND PSYCHOLOGY; DEFINING TERNS AND PRESCRIBING THE PENALTY FOR
VIOLATION.
BE IT ORDAINED BY THE V1AYOR AND CITY COUNCIL OF THE CIrry OF
HERID IAN, ADA COUNTY, IDAHO: -
SECTION 1. It shall be unlawful to apply or' [:,0 use hypnosis
for stage or parlor entertainment or for public demonstrations.
The use or application of hypnosis shall be limited to licensed and
ijualified doctors of medicine, dentistry and psychology, provided
however, that the use of hypnosis by qualified and licensed psycho-
logists shall be done only under thesuperviGion of a licensed
doctor of medicine.
SECTION 2. DEFINlT IUN OF TERNS. The term "doctor of medicine",
and "doctor of dentistry" as herein used shall be in accordance
wIth the standards required by Tit.le 5/~, Chapter IS and Title 54,
Chapter 9, Idaho Code. The term "psychology" and Psycho1igist"
as herein used shall be in accordance with the standards reql~ired
b;y a ph. D. degree in Clinical Psychology granted by an accredited
university meeting the requirements of the American Psychological
Association. The term "qualified" as herein used shall mp.."l.n in
addition to the requirements above stated that the d9ctor of medi-
cine, dentistry and psychology shall have received ins-t~ruct.ion in
the use and application of hypnosis equiva.lent to an accredited
university lecture and laboratory course together with the success-
ful supervised application of hypnosis to a minirrlum of twenty-five
cases. The term flhypnosis" as herein used means a condition or
state of selective hyper-suggestib~~itybrought about in an
individual (SUbject) through the uce of certain specific psychological
or physical manipulations of thi~ ~ndividual by another person
(hypnotist) as cecognized and accepted by the medical, dental and
psychology proffessions.
SECTTON 3. PENALTY. Any person violating the provlslons of
this ordinance shall be deemed guilty of a misdemeanor.
Passed by the City Council and approved by the Mayor of the
City of l-feridian, Ada County, Idaho, this 1st day of June, 1959.
