AN ORDINANCE REGULATING AND CONTROLLING THE COLLECTION, STORAGE DISPOSAL, AND TRANSPORTATION OF WAS'I'E, REFUSE, RUBBISH AND GARBAGE WITHIN THE CITY OF N~RIDIANt ADA COUNTY, IDAHO: - FIXING PENALTIES FOR VIOLATION: REPEALING TITLE VII CHAPTER III REVISED AND COMPILED ORDINANCES 011' THE CITY OF MERIDIAN 1955, AND SUBSTITUTING THEREFOR THE PROVISIONS OF 'I'HIS ORDINANCE. BE IT ORDAINED BY THE MAYOH AND CITY COUNC IL OF THE CITY OF MERIDIAN, ADA COUNTY t IDM 0 : Section 1. That Chapter III of Title VII Revised and Com- piled Ordinances of the City of Meridian, Ada County, Idaho, is hereby repealed, and there is hereby enacted the following ordi- nances to be designated Title VII, Chapter I as follows: "7-301: Definitions A. The Term "waste" shall mean unwanted solid, Liquid or gaseous materials. .. B. The Term "refuse" shall mean solid wastes, including garbage and rubbish. C. The Term "garbage" shall include all putrescible waste, except sewage and body waste, including waste .accumulated of animal, food or vegetabie matter, and including waste that attends thepreparation, use, cooking, dealing in or storing of meat, fish, fowl, fruit and vegetable, and shall include all of such -- wastes or accumulations or vegetable matter of residences, restau- rants, hotels and places where food is prepared for human consump- tion. The term "garbage" shall not include recognized industrial byproducts. D. The.Term "rubbish" shall mean refuse other than garbage (tin cans, bottles, ashes, paper, pasteboa~d, cardboard, or'wooden boxes, brush, leaves, woods, and cuttings from trees, lawns, shrubs, and gardens or other easte materials produced in norman course of everyday living.) . . E. The Term "person" shall mean any person, firm, partnership, association, institute or corporation, and in the plural as well as singular. F. The Term.s "owner" and "occupant" wherever herein used may~ be used interchangeabl~, and shall mean every person in possession, charge or in" control of any dwelling, . flat, rooming house, or any eating palce, show, pl~ce of business, manufacturing or business establishment where garbage or other refuse is created or accumulated. ,G. The Term "inspector" shall mean the authorized employee or employees of Meridian having the duty of the enforcement of this regulation. I H. The Term "collector" wherever herein used shall mean the person holding a license or a contract with Meridian and thereby authorized and designated by Meridian to collect, handle, transport and dispose of refuse. 7-)92: Responsible Authority The City Council shall appoint a person vr persons who shall be responsible for the enforcement of the provisions of this ordinance and other duties as the City Council may prescribe. Said person or persons so appointed shall work under the direction of the City Council and in coordination with the Health Officer or his authorized representative.. 7-)03: Linense - Refuse Collection There is hereby established a system of refuse collection, transportation and disposal. It shall be unlawf,ul for any person to engage in the business 01' collecting, transport.ing, hauling, or conveying any re1'use over the streets or alleys of Meridian, or to dmmp or dispose of the same, unless and until such person is licensed therfor, or has a contract therefor. 7-)04: Use of the Collection S~stem 224 Ordinance No 80. Every owner and occupant of premises within the prescribed limits of this regulation should use the refuse collection and disposal system "herein provided and shall deposit or cause to be deposited in accordance with this regulation all rubbish.and garbage'th~t is of such nature that it is perishable, or may de- compose, or mqy be scattered by wind or otherwise, which is accumulated on such premises.. 7-305: refuse accumulation - Unlawful It shall be unlawful for any person to permit or to suffer to accumulate in or about any yard, lot, place or premise, or upon any street, alley. or sidewalR:adjacent to" such lot, yard, place or premise~ owned or 'occupied by' such person, any garbage or refuse so as to. cause such yard, 'lot; premise, or the street, 'alley or sidewalk adjacent thereto, to be or remain in such condition as to cause or create a nuisance' or offensive odor or atmosphere, or thereby to be or to become, or cause or create, a'p~blic nuisance. 7-306: Burning, Dumping - Unlawful I No person shall burn, incinerate, bury, dump, collect, re- moveor in any other manner dispose 01" rubbish or garbage within the limits of Meridian except as prOVided by chapter IV, Section 6-401 and 6-403 of the Meridian Code. No person shall throw, dis- card or deposit any rubbish, garbage, or refuse in or upon any . ~ street, alley, sidewalk or vacant groun, or in or upon any canal, irrigation'ditch, drainage ditch or other water course. 7-307: Refuse. Containers .. It shall be the duty or every owner or occupant or any plaoe where garbage or rUbbish is created or accumulated to at all times keep or cause to be kept portable appurtenances consisting of metal or other approved type of container~for the deposit,therein of rubbish and'garbage, and, except as otherwise provided, to deposit or"cause to be deposited all rubbish. and garbage therein~ All garbage shall, before deposit in suoh can, be, wrapped. in paper or other material so as to prevent the escape'of liquids there-from.. All such containers shall be water tight, not easily corrodi- ble, rodent and fly proof, and shall be equipped with handles and a close fitting lid.. . Such containers shall not be less than 20~ gallons capacity or more than 32^gallons capacity. The containers shall not be of less than 30 guage metal or the equivalent, and be hop-dipped after fabrication to insure non-leaking cans or a can that is guaranteed by the manufacturer, and so'labeled, to be leakpro~f regardless of manufacturing processes. Such lid shall not be removed except when necessary to place garbage and rubbish in such container or to take the. same therefrom. Whenever ~i~bage or rubbish is placed therein or taken thererrom, such lid shall be replaced by the person placing or taking therrrom such garbage or .ruboish. Such containers shall be kept' in a sanitary condition, whith the inside and outside thero!' washed at such times as to keep the same 1'ree and clean 01' all accwnu-lated grease and decomposing material and so that no odor nuisance shall exist. All garbage or refuse cans shall be kept in a place accessi- ble to the collector, provided that in the case or isolated dwellings or places 01" business or wheore reasonable access cannot be had by a truck, the cans may be kept in such places as may be agreed upon by the owner and collector, or at such place as. may be designated by the inspector. 7-308: Collection PeriOd I Collectors shall collect rubbish and garbage from each customer or such collector at least t~ice each week Tor the six months period May 1 Through October 3~, and at least once e8ch week for the remaining months of the year, or as provided. Persons not retaining the services or a licensed collector shall be bound by the ~rovisions OT this section as it pertains to rrequency of disposal; furthermore, all other sections shall be in foroe where a"pplicable. Collectors shall Tollow the traveled portion or striets and alleys, or the ~egular ~81ks Tor pedestrians while on private property, and shall take care in the loading of such rubbish and garbage so that none or the material to be collected is left either upon the private property or the streets and alleys. The collector shall return the container with all contents re- moved and replace the lid thereon; Ordinance No 80 Cont'd 225 7-309: RUbbish - Special Handling Rubbi sh consist ing only 01' cara board, or wooden boxes, brush, leaves, weeds and cuttings rrom trees, lawns, shrubs, and garden, may be kept separately without depositing in such containers pro- viding that bulk materials, such as leaves shall be in a can, bOX, sack, or receptacle ror ease or loaaing ana that brush and etc. shall be tied in bunales. Compost piles may be maintained ror rertilization purpose, and-matter used 1'01' pertilization purposes only may be transported, kept, and used. Nothing in this s~ction' shall be construed so as to permit the violation or any ordinance, or any rule or ~egulation or the rire department or Meridian. 7-310: License ror Collector I Collectors engaged in the business 01' haUling, conveying or transp~rting rubbish or garpage ror hire over upon the streets or alleys within Meriaian shall have a valid license therefor issued by Meridian. Application for such license shall be made in writ- ing upon a form to be provided by the city clerk. The application shall show the name, telephone number and street address of the applicant, number of vehicles to be operated by the applicant in such business, and such other pertinent information as may be re- quired by tJ:'is chapter or as the City Council may from time to time require. Whenever a new or different vehicle, other than as shown in such application, is used or operated insuch business, such person shall furnish ilnmediately such information to the city clerk. 7-311: License - Expiration If the City Council shall so order, the city clerk shall issue a license to the applicant, which license shall be issued for the calendar year and shall expire on the 31st of December of the year in which issue, provided, that the license fee shall 'be-payable by the month as in this chapter provided. No license issued under the provisions hereof may be transferred. 7-312: Vehicles I ,All Collectors shall furnish vehicles designed for the collection and hauling of garbage and rubbish. The Collectors shall keep such vehicles clean, sanitary, neatly painted and in good running order, and shall wash, clean and disinfect all such vehicles at least once a week. Each vehicle shall be equipped with a tight metal body~ or, if a wooden body, shall be metal lined so as to be water tight, and each vehicle shall at all times b~ provided with a suitable or other approved cover having eyelets. provided so that it may be securely fastened whenever required to retain dust and prevent scattering of rubbish or garbage. Each vehicle used for the collection and transportation of rubbish and/or garbage shall have the name and phone number of the owner painted plainly on both sides of such vehicle in letters not less than six (6) inches in height and four (4) inches in width in contrasting color so as to allow for easy reading and identificatior~ The provisions of this section shall not apply to any person COllecting and transporting rubbish and garbage solely from pre- mises of which such person is the owner. 7-313: Vehicles - In&pection The inspector shall regularly, at such times artd places" to - be designated by him, and at least quarterly, inspect vehicles designed for the purpose of the collection and transportation of such rubbish and garbage and shall certify his approval or dis- approval as to compliance with the provisions or this ordinance. From and after the approval date of this ordinance, no person sh- all use or operate any vehicle for the collection or transportation of rubbish and garbage unless such vehicle is- approved by the inspector. Any person hauling his own garbage or rubbish shall provide suitable coverings in order to prevent scattering or blowing or loss of the material being transported. 7-314: Collection - Business Houses To insure the health of the inhabitants of Meridian, the City Council of said city hereby ordain that premises and businesses,- such as, but not limited to, restaurants, grocery stores, hospitals, butcher shops and establi~hI?-ec.r:~s ~h~rEiin l~.r~e accumulations of ~ 226 Ordinance No 80 Cont'd garbage occur, are nuisances to the extent that the same should bej and are hereby in the manner and methodhereiriatterprovided, de- signated as a separate class of premises for the collection and disposal of garbage and rubbish ~nd the same shall be deposited, separately in suitable cans and containers. From and after the effective date of this ordinance, the inspeotor shall designate such' premises wherein large accumulations of garbage occur and shall notify the owner of such premises of such designation. From and fter such notirication by the inspector, all. rUbbish and garbage accumulated upon such premises shall be deposited separately, in approved containers for garbage as provided in section 9. The City Council shall require a special type of vehicle or equipment for the collection and transportation of garbage from : premi ses designated. under the provisio,'1s b'f this sectiOn 'and' shE'll enter into a contract with, or shall designate, the collector for such garbage. It shall be unlawful for any person, except the collector so designated by the City Council to collect, or to haul or transport garbage, from any premises so designated under the provisions or this section. I 7-315: City Disposal Site For the purpose or the protection and preservation of the health and welfare of the inhabitants of Meridian there is hereby established at such'places and locations as the City Council may from time to time designate by motion or order, a place t"or the dumping and depositing of rubbish and garbage, and any such,place or location shall be known and the same is hereby designated, as the city disposal site. The inspector shall have the authority of a police officer, to enforce all ordinances, rules and regula- tions governing the city disposal site. Until $uch time as the City Council of Meridian designates such pl~ces or locations as official disposal sites, the places or locations jointly designated as the official disposal sites by the Ada County Cornnissioners shall be the only approved disposal sites used by the residents of Meridian. " The site or the city disposal site shall be chosen with regard to drainage and topography for the operation of a sanitary landfill. All rubbish and garbage deposited at the city disposal site shall be covered with alternate layers of earth. The exact method of earth fill, ana amount and depth of layers of earth, and regulations f'or rodent and pest con~rol shall be prescribed by the inspector, in cooperation anq agreement with ,the health authorities, for each city disposal site oas the site for the same is designated. 7-316: City Disposal Site - Rules and Regulations All persQns transporting rubbish or garbage to the city dis- posal site shall dump the same at the places or spots designated by the inspector for that purrose. The inspector is hereby autho- rized to make rules and regulations in cooperation and agreement with the health authorities designating the manner of and hours and limits or time of dumping or depositing rubbish and garbage at the city disposal site, and no person shall dump or deposit rubbish or garbage in violation thereof, providing that before such rules and regulations become effective, appropriate signs shall be placed at or upon the premises of the city disposal site giving notice of such rules and regulations. I 7-317: Permit No collector shall haul or transport any rUbbish or garbage from Me~idian except to the designated city disposal site, pro- vided that, upon application to.Clty Council, the City Council may permit, or may contract for, rubbish or garbage, or both, to be hauled or transported to such other location as may be desig~ nated by the City Council. 7-318: Inspection No person shall deny the inspector the right of ingress or egress to any premises for the purpose of inspecting all places, and containers where rubbish or garbage is accumulated or kept. 7-]19: License - Revocation Any license issued under the provisioIls, of' thlo. c~lapt,~r I I Ordinance No 80 Cont'd. 227 May be revoked, or a renewal thereor denied, by the City Council for any violation of this chapter. 7-320: License Fee All Collectors under the provisions of this chapter shall pay a license fee or $ 12.50.per month per truck. 7-321: Penalty Any person violating the provlslons 01' this chapter shall be deemed guilty of a misdemeanor.
