Be it Ordained by the Mayor and Council of the City of weridian, Ada County, State of Idaho: SECTIOl\T 1. For the pur pose of this Ordinance the following words and phrases shall haie the meaning respectively asoribed to them as follows: (a) VEHICLE -- Every device in, upon, or by which any person or pr'operty is or may be transported or drawn upon a street or hieh- way, except devices moved solely by human power or used exclusively u~~n stationary rails or tracts; for the purpose of this Ordinance a bic\lcle or a ridden animal shall be deemed a vehiole. "'(b)' AU'I'HORIZED SlJEhGENCY VEEICLE -- Vehicles of the JTire De- partment, Police Department and such ambulances /:lnd emergency ve- hicles as may be designated or ~uthorized by the Chief of Police. (c) RIGHT-OF-'.VAY -- The privilege of the immediate use of the roadway. (d) STOP -- Means the complete cessation of movement. (e) "PARK 8R PARKING -- The standing of a vehicle, whether occunied or not, otherwise than teloporarily for the Durnose of Bnd while actt~ely engaged in loading or unloadine goods, m~rchandise or Dersons. - (f) 'l'RA?FIC -- Either persons or vehicles wilile usinf, any street or sidewalk for the purpose of travel. (g) PJ':RSDN __ Shall mean every natural per-son, firm, co-partner- ship association or corporation. (h) DRIVER -- Every person who drives or is in actual physical control of 8 vehicle. (i) P3DESTHIAN -- Any person afoot, including infants in a carriaBe heingpushed or T)1:11ed by a person. (j) STR.EET, EICH';,rAY, on rWAD.'il;'Y -- Shall be used interchan€:',eably and shall mean the entire width of every way or place open to the public, as a matter of right, for public vehicular travel; provided that "Street" or"Roadway" shall not include alley and -y,]here the word "alleu'l is used it shall mean every way or place intersecting a block and open to the public, as a matter of right, for public vehicular travel. (k) 3ID3,'.,'ALK -- 'That portion of a street between the curb lines or lateral lines defining v~hicular traffic, and the adjacent property lines and intended for pedestrian travel. ~ 1) IlT1ER3BCT ION -- 'The area embr'ac ed wi thin the }nolon@,c~ t ion or connection of the lateral curb lines, or, if none, t~en the lateral boundary lines of the inters8cting highways, or the area withi~ which vehicles traveline'; on differ'ent highways may COlue into c:..:nflict. (m) eRO':)':;, -,',-ALK -- That portion of a street included within the prolongation or connection of the lateral lirss or sidewalks at inter- sections, or any portion of a street distinctly indicated for pedestrian crossing or traffic ,by lines or: other "markings · SECTION 2. For the purpose of the regUlation and c::ll1tI'ol of traffic upon the streets of ~eridian, there is hereby established a restricted vehicular district and the Chief of police is hereby 8~thorized and directed to designate LTLrnediately, and from time to ti.Jle hereafter as is deelned necessary for the control of traffic,'all streets and parts of streets to be included whithin said district, and to design8te the hours and limits of time of parking within such district, and for such purpose the Chief of Police is also hereby authorized~Bnd directed to erect and place such signs within such districts as shall ~ive notice of the various hours and times of parking within such district. SECTION 3. The'Chief of police is hereby authorized to desi~n8te3uch through streets, stop streets, one-way-streets, safety zones, places where parking is prohibited, and no U turn intersections, in and upon the streets of Aeridian as shall be deemed necessary for the regulation and control of t raff ic, and shall cause anpropria t e signs, s1 '"'nals or other traffic devices to be place~ and maintained upon such streets to give notice thereof. S3CTION 4. The Chief of police is hereby authorized and directed to d-esignate load ing and unloading zones , within said restricted vehicular district, and no persbn shall stop, stand or park a ve- hicle, within or at said designated zones, for any 9urpose of length of time other than for the expeditious and actual loadiGg or li~-- loading of passengers, ~naterials, goods or merchandise, provided, that in places where, and at hours when, parking for the loading 88 2. or unloading of ~Bterials, goods, or merchandise is permitted, Drivers of vehicles may"back into the curb to take on or discharge loads, provided further, that the driver of such vehicle must first procure a per~it therefor from the Chief of Police, such loading zones hall not be applicable between the hours of 7 P.M. and 8 A.M. nor on Sundays or holidays. SECTION 5. No regulations prescribed under authority of Section 2, 3, and 4 of this Ordinance shall beco~e effective unless and until the Chief of Police sh~ll have shown and designated all such regulations and the et'fective date thereof', upon a map to be kept and t18intained at the Police Department at a location open to the pu~lic, and such regulations and the map showing such regulation, must f'irst be approved by the City Council by a motion duly passed. Such map shall be prepared by the City Engineer, and copies ,thereof shall be kept at the offices of the City Engineer and City vlerk. PA}(]{ING SSCTION 6. The Chief of Police is heI"E::by authorized to cause lanes I" or marking to be painted or placed upon the curbs and/or upon the streets,_ designating the parking space for each vehicle, which said lanes or markings shall be so painted or placed as to show either " parallel or diagonal parking at such places. It shall be unlawful, where such spaces are designated, to park any vehicle aCI'OSS any -such lane or markings or to park any vehicle in such position that the same shall not be entirely within the space so designated by such lanes or markings. Where such spaces al'e not designated, it shall be unlawful to parle except when headed with, the traffic, parallel vd th the edge. of the curb, or other street boundary and wi th the curb sid e edge of' the vehicle within twelve (12) inches of the curb or other street boundary. SECTION 7. When signs are erected or Il1arkings.Il1ade giving notice of the length of time of parkings at Mny spac~, no person shall pErk a vehicle thereat for longer than the lenath of time so designated by said signs; parking shall be deemed ended only by the I'emovel of the praked vehicle to a distance at least one blaock therefrQm. SECTION 8. All street spaces between parking spaces upon a street are reserved for moving traff'ic and it shall be unlawful to park thereon or to park otherwise than in this Ordinance provided. SECTION 9. It shall be unlawful to park any vehicle in any alley or in the entrance to any alley, except for the expeditious and actual loading or unloading of passengers, materials, goods or merchandise. SECTION 10. All vehicular and pedestrian traffic facing the "STOP" devise shall stop before entering the nearest crosswalk at an inter- section or at such other point as may be indicated by a clearly visible line, and no vehicle or pedestrian"racing such device shall enter onto the crosswalk or cross such street, except asprov ided in Section 12 or this ordinance. SECTION 11. All vehicles must be brought to a co~nplete stop before passing any stop sign or entering upon an arterial or through street, and no vehicle shall enter into an arterial or through street except cautiously and shall yield the right-ot-way to vehicles not so required to stop and which are in the intersection or are approach- ing at a lawful speed so closely as to constitute an irrunediate hazard. TURNING ..AT IN'l'h:RSEC'l'IONS S1j;CTION 12. The dr i vex - of a v ehic Ie int ending to m.ake a turn to the left at an intersection, shall approach the intersection On the left I side of the driver's right half of the roadway, and shall yield the right-at-way to any vehQcle ap?roaching from the opposite direction which is in the intersection or so close thereto as to constitute an immediate hazard. Such driver shall, before turning, signal as required by the statutes of the State of Idaho, and shall keep on the driver's right half of the intersection and roadway. The driver of" a vehicle intending to make a tUI'n to the I'ight at an intersection, shall approach the intersection on the right side of the driver's right half of the roadway, and before turning s-hall sigEal as required by the statutes of the State of Idaho. Right-hand turns may be made against a red light upon the vehicle being brought to a complete stop before entering onto the crosswalk, and betore or while proceeding such drivar shall give the ri ght -of way to vehicle s lawfUlly in the intersection and to pedestrians traversing the cross- walk or proceeding with the green light who are hereby declared to have the super ior right-of -way. All turns shall be made with due caution and circumspection, and s~bj,ect ~9, the superior rights-of-way . provide~ by t~lis ordinance. S~C1ION~. YIELDING RIGHT-OF-WAY SECTION 14. Where traffic control signals are not in place or not in opperation, the driver of a vehicle, except upon an arterial or through street, shall yield the right-of-way to any pedestrian crossing the street within any crosswalk. SECTION 15. No pedestrian shall cross any street except upon the crosswalks thereof. SECTION 16. No vehicles shall travel or park upon any sidewalk, pro- vided that vehicles illay cross sidewalks at authorized curb cuts and at alleys. SECTION 17. Any vehicle entering or leaving a curb or parking space shall yield the right-of-way to moving vehicles, and the friver of any vehicle before starting, stopping or turning from a direct line of travel, shall first see that such action can be ;nade in safety to other vehicles and to pedestrians. SECTION 18. The driver of any vehicle shall yield the right-of-way to authorized emergency vehicles when the latter are olerated with audible sipnal by bell, siren or whistle. SECTION lC9. Upon the approach of any authorized emergency vehicle giving audible signal by bell, siren or whistle, the driver of any other vehicle shall immediately drive such vehicle to a position as near'as possible and parallel to the curb on the driver's right-hand side, clear of any intersection, and shall stop and remain" in such position until the authorized emergency vehicle has passed, unless otherwise directed by a pOlice or traffic officer. It shall be un- lawful for the driver of any'vehicle, other than one on official business connected therewith, to follow any authorized emergency vehicle at a distance of less than one block. SECTION 20. No vehicle shall drive over or upon any fire hose unless directed to do so by a fireman or police officer. SECTION 21. The driver of any vehicle shall drive such vehicle upon the driver's right half of the street, except upon one-way streets or alleys, and except when such right half of the street is out of repair, or when passing or overtaking another vehicle as provided in Section 23 of this ordinance. SECTION 22. Where the highway or street is marked by traffic lanes, a vehicle shall be driven entirely within a single lane and shall not be moved out of such lane until such movement can be made with safety, and such movement shall be subject to the right-of-way of vehicles in other lanes. OVERTAKING VEHICLES SECTION 2). The driver of a vehicle overtaking another vehicle pro- ceeding in the same direction, shall drive to the left thereof at a safe distance and shall not again drive to the right until safely clear of' the overtaken vehicle, provided, that where the street is marked into traffic lanes, it shall be permissible for the overtaking vehicle to pass the .. overtaken vehicle in .~i ther the right or left hand lane. IIhe driver of a vehicle shall not drive to the left side of the center line of the stre in passing another vehicle proceeding in the same direction, unless such driver has 8 clear view and the left side of the street is free from oncoming traffic for 8 sufficient distance to permit such overtaking and passing to be completely made without irnpedirg the'safe operation of any vehicle approaching from the opposite direction, such approacl~+ine vehicle having the superior rieht-of-way. SECTION 24. The driver of an overtaken vehicle shall, subject to the orovisions of Section'22 and Section 23 of this ordinahce, give way to the driver's right, in favor of the overtaking v8hicle, 9nd shall not increase its speed until completely passed by the overtaking vehicle. SECTION 25. The driver of an overtaking vehicle shall give audible warning with 8 horn or other warning device before passing or atte_:!lpting to pass a vehicle ryroceeding in the same direction. SECTION 26. The driver of a vehicle shall not overtake and pass any other vehicle proceeding in the same direction at any railway crossing, nor at any intersection except such vehicles as are turning into other streets, and wxcept where traffic lanes are marked and subject to the provisions of this ordinance. ~ECTION 27. The driver of a vehicle shall not follow any other vehicle more closely than is reasonable and prudent, having due regard to the speed of such vehicles and traffic upon and condition of the street. DRIVlt\G SP~EDS SECTION 28. No person shall drive any vehicle, except emergency vehicles, at a greater speed than designated as follows: 1. In any pUblic park, 15 Miles per hour. 2. When passing a pUblic school building or grounds thereof, 15 Miles per hour. 90 4. 3. Vifhen approaching wi thin 100 feet of a bridge or intersection, 20 miles per hour. 4. Upon any arterial or thraugh street, except as otherwise he~in limited, not less than 20 miles per hour nor more than 30 rules Der hour. . 5. On all other streets and alleys in Meridian, 20 miles per hour. 6. No Derson shall drive an autompbile, motor vehicle or motor- cycle, "vi th a ge:soline or other explosive mixture as a motor -power within the:.city limits' of', the:City-of'meridian without a muffler't.hereon sufficient tb deaden.~the sound of the explo- sions'and such muffler shall not be disconnected or cutting out while such automobile, motor vehicle or motorcycle is being operated within the li,~ni ts of l',iIeridian. . SECTION 29. No driver shall drive a vehicle between vehicles com- prising a' funeral, parade or other authorized procession while such vehicles are in ,~ot ion. ,sECTION 30. Whenever a street is in 5, dangerous condition, or is being ,1. . repaired, or is hazardous for the travel of vehicles upon such street, the Chief of' Police shall have authority to prohibit vehicles and/or pedestrians from crossing or traveling upon such street, and it shall be unlawful for any person to refuse to comply c,,:ith any order. of a pOlice Officer, sign, signal or direction goven in compliance with thi s Sect ion. - SECTION 31. No person having control or charge of' a vehicle, shall allow such vehicle to stand on any'street or highway unattended without stopping the motor of said vehic le, and where necessary to prevent rolling ~irst effectively setting the brakes thereon. SECTION 32. It shall be unlawful for the driver of any vehicle to drive the same upon any street or highway when such vehicle is so loaded as to obstruct the view of the driver to the f'ront or sides thereof, or to interfere with the driver's control of' the driving mechanism of the vehicle. SECTION 33. It .8hall be unlawful to permit any anLnal used for vehicular purposes to be left unattended upon a street, alley or other public place unless such animal is securely tied to an Object adapted for such purpose. AC C ID;~N'l' S SECTION 34. Whenever any vehicle is involved in an accident resulting in injury to or death of any person, or resulting in any injury to property, the driver shall immediately stop such vehicle at the scene of such accident, or as close thereto as possible, and shall exhibit his operator's or driver's license to the person struck or to the driver or occupants of any vehicle collided with, or if i.Qipossible to do so, tben to some person at the scene of the accident. SECTION 35. The driver of any vehicle imvolved in injury or death to any person, or resulting in injury or damage to property, shell within twenty-four (24) hours make a detailed report of such accident to the Police Department of Meridian. ,sECTION 36. No person shall drive any vehicle upon the streets or highways within the corporate limits of lVleridian, unless such driv.er is in possession of' an operator's or chauffeur's license required by the laws of the State of Odaho. . SECTION 37. The provisions of Sections 49-540 to 49-548, inclusive of the Idaho Code, and all provisions thereof and all amendments thereto, to the date of-the passage hereof, shall be applicable to and shall apply to Iv1eridian, and it shall be unlawful and punishable as I' herein provided to violate any provision hereof within the corporate limits of Meridian. SECTION 38. It shall be unlawful for any person who is an habitual user of narcotic drugs or any person who is intoxicated or under the influence of intoxicating liquor, or narcotic drugs, to drive any vehicle u-pon any street or highway within Meridian. . SECTION 39. It shall be unlawful for any person to drive any vehicle upon the streets or highways carelessly and heedlessly in wilful or wanton disregard of the rights or safety of others, or without due caution and circumspection or at a speed or in a manner so as to endanger or be likely to endanger any person or property. 3ICYCLB::S &:fO'TORCYCIJ'3;S S~CTION 40. No person riding in or upon any bicycle shall attaeh.such bicycle to any other moving vehicle. SECTION 41 The driver of any vicycle shall drive such bicycle as near the right-hand curb as possible, and persons operating bicycles shall not ride more than two abrea st.' Vvhen passing any other vehicle, except vehicles patked at the curb, drivers of bicycles shall drive only in a single file. SECTION 42. A person operating a biCYCle or motorcycle shall not .ride other than upon and astride the permanent and regular seat attach~d thereto, nor shall any person operating a bicycle or Dlotorcycle carry I I 91 5. any other person upon such bicycle or motorcycle than upon a firmly attached and regular seat thereon. . SECTION 43. No person shsll operate a bicycle or motorcycle without keeping at least one hand upon the handle bar. SECTION 44. All bicycles shall be equipped with 8 I'ed flas,,> reflector, 0 at least one (1) inch in diameter, which shall be so attached to the rea of such bicycle as to be visible from the rear. SECTION 45. The driver of any bicycle shall, between the hours from one-half hour ~fter sunset and one-half hour before sunrise display a light on the forward part of the bicycle, said light to be stationary and to have illwllination equal to that produced by a one and twenty- five hundredth volt electric bulb and battery. GECrDIB 46, Every bicycle shall be equipped with a brake which will enable the operator to make the braked wheel skid on a dr-y level clean pavement. It shall be unlawful to park any vehicle on city streets when such vehicle is loaded with any material ~hat is offensive to human smell. PENAL'.i I~S SECTION 48. Any person viOlating-the provlslons of this ordinance shall be deemed guilty of a rnisdemeanor, and upon conviction therefor shall be fined not less than j~l.OO nor more than $300.00.
