To Whom It May Concern:
Attached for your review is our application and associated material concerning City of Meridian Certificate
of Zoning Compliance approval of the proposed Gramercy Retail Buildings 100, 200, 300 and 400. The
materials include site plan, photometric site plan, Sanitary Service Company Approval, landscape and
building plans, and elevations, and this narrative fully explaining the proposed use of the property.
Collectively all of this information explains our design of the retail shell buildings as well as the site.
The project site is on the south side of Overland Road, directly west of EI Dorado Business Park on either
side of S. Wells Avenue. The site is currently vacant. We have~been given a CUP for the proposed
master plan of the entire development, but these applications only deal with the north portion of the site
on either side of S. Wells Avenue Block 1, Lots 3, 4, 5 and fi and Block 2 Lots 3, 4, 5 and 6 on the
submitted plat}. The site will be accessed from a traffc light controlled intersection at S. Wells and aright-
inonly atthe west side of block 1, lot 3. The site will exit through the S, wells intersection and aright-out
only east of block 2 lot 3.
The retail core buildings front to S. Wells Avenue and are accessed by a pedestrian corridor. This
pedestrian corridor is enhanced with variations in the sidewalk pavers and patterns, planters, trees,
benches etc. Parking is located to the rear of the retail buildings with fully landscaped parking islands that
include pedestrian paths directing foot traffic to the central core of the development.
The facades of the buildings are staggered both front to back and in height. We have varied of entrances
to give each entrance its own identity and create a more urbanlpedestrian experience. The buildings
include several styles of steel, cloth and framed canopies, trellises and covered entrances. The buildings
materials will be brick, arriscraft stone, and stucco with base material changes, and designer style door
pulls. All together the retail buildings will establish a cohesive pedestrian oriented retail core.
Exterior wall lighting fixtures have been selected. The locations for the wall fixtures are shown on the
architectural elevations at each facade. Parking light locations are shown on the site plan as well as the
monument sign lighting. Cut sheets for all fighting are included.
All utilities are underground.
The Building Design Objectives of Building Mass; Proportion of Building; Relationship of Openings in the
Buildings; Relationship of Exterior Materials; and Colors in general can be viewed in the attached
graphics. All mechanical equipment is concealed by the design of the parapet.
All roof drainage will be handled through internal drains and overflow lines. 1Norking with The Land
Group, our Landscape Architect and Civil Engineers, all storm water drainage will be handled on site.
This site offers a wonderful opportunity and we are excited with the functional and aesthetically pleasing

3. DEFINITIONS: For all purposes of this Agreement the following words,
terms, and phrases herein contained in this section shall be defined and interpreted as herein
provided for, unless the clear wntext of the presentation of the same requires otherwise:
3.1 "CITY": means and refers to the City of Meridian, a parry to this
Agreement, which is a municipal Corporation and government
subdivision of the state of Idaho, organized and existing by virtue of
law of the State of Idaho, whose address is 33 East Idaho Avenue,
Meridian, Idaho 83642,
3.2 "OWNER/DEVELOPER": mesas and refers to Kenai Partners,
LLC, whose address is 6223 N. Discovery Way, Boise, Idaho 83713,
the party developing said "Property" and shall include any subsequent
owners and/or developer(s) of the "Property".
3.3 "PROPERTY": means and refers to that certain parcel(s) of
"Property" located in the County of Ada, City of Meridian as
described in Exhibit A describing the parcels to be annexed and
zoned R-15 (High Density Residential District) and C-G (General
Commercial District) attached hereto and by this reference
incorporated herein as if set forth at length.
4. USES PERMITTED BY THIS AGREEMENT:
4.1 The uses allowed pursuant to this Agreement are only those uses
allowed under "City's" Zoning Ordinance codified at Meridian City
Unified Development Code which are herein specified as follows:
Construction and development of a Certificate of Zoning
Compliance shall be submitted to the City of Meridian prior to a
future development in then-X5, and C-Gxones, and thepertinent
provisions of the Ciey of Meridian Comprehensive Plan are
applicable ro this AZ 06-02X application.
4.2 No change in the uses specified in this Agreement shall be allowed
without modification of this Agreement.
5. CONDITIONS GOVERNING DEVELOPMENT OF SUBJECT
PROPERTY:
5.1. "Owner/Developer" shall develop the 'Troperty" in accordauce with the
following special conditions:

1. All future uses shall not involve uses, activities, processes, materials,
equipment and conditions of operation that will be detrimental to any
persons, property or the general welfaze by reason of excessive
production of traffic, noise, smoke, fumes, glare or odors.
2. That all future development of the subjectproperty shall be consistent
with the owner/developer's conceptual plan unless otherwise
modified by other provisions of the Development Agreement.
3. That all future development of the subject property shall be
constructed in accordance with Ciry ofMeridian ordinances in effect
at the time of development,
4. That all future uses and lots on this site shall conform to the District
Regulations and Allowed Uses contained in the Unified Development
Code (i7pC), is effect at the time of development.
5. That the owner/developer will be responsible for all costs associated
with the sewer and water service extension.
6. That any existing domestic wells and/or septic systems within this
project will have to be removed from their domestic service, per City
Ordinance Section 5-7-517, when services are available from the City
of Meridian. Wells may be used for non-domestic purposes such as
landscape irrigation.
7. That development of the residential and commercial lots, along with
the orientation and relationship to the street, particulazly the auto
court, shall comply substantiallywifh the submitted sample elevations
and materials list in Exhibit A of the staffreport for the hearing date

9. That the maximum squaze footage of one single building without
design review shall be 60,000 square feet or a maximum of 40' in
height.
10. That the owner/developer shall coordinate with the Meridian Parks
Department and Nampa Meridian hrigation District to de&ne the
location of the multiuse pathway, bridge maintenance, and
landscaping along the Ridenbaugh Canal and along the western
property boundazy to the azea where the proposed R-15 zone
transitions to the C-G zone. The pathway shell then connect to the
proposed detached sidewalks along S. Kenai Way and continue
internally through the site to connect with E. Overland Road.
11. That the owner/developer shall comply with all design and
maintenance standazds as defined by UDC 11-3A-8 unless
specifically waived by the Meridian City Council.
12. That the owner/developer shall coordinate with the Meridian Parks
Department the transfer by dedication of the 2.035 acre addition to
Kiwaais Park. The owner/developer shall also be responsible for all
costs of dedication, construction, landscaping, and pathway
construction as agreed upon.
6. COMPLIANCE PERIOD/CONSENT TO REZONE:'Phis Agreement and
the commitments contained herein shall be terminated, and the zoning designation reversed,
upon a default ofthe "Owner/Developed' or "Owners/Developers" hcirs, successors, assigns,
to comply with Section 5 entitled "Conditions Governing Development of Subject Property'
of this agreement within two years of the date this Agreement is effective, and after the
"City" has complied with the notice and hearing procedures as outlined in Idaho Code § 67-
6509, or any subsequent amendments or rewdificationa thereof.
7, CONSENT TO DE-ANNEXATION AND REVERSAL OF
ZONING DESIGNATION:
"Owner/Developer" consents upon default to the reversal of the zoning
designatioa of the "Properly" subject to and waditioned upon the following conditions

Item 27: Public Hearing: PP 06-019 Request for Preliminary Plat approval of 101
single-family residential and multi-family residential lots with 6 common
lots in a R-15 zone and 32 commercial lots with 19 common lots in a C-G
zone for Kenai Subdivision by Kenai Partners, LLC -south of East
Overland Road and west of South Eagle Road:

Canning: Mr. President, Members of the Council, this is Kenai application. It extends
from the EI Dorado Subdivision all the way over to the Millennium Subdivision. So, it
brings in that whole RUT property that currently exists between the high school,
basically, and EI Dorado. The application includes annexation and zoning and
preliminary plat approval. The preliminary plat and annexation would allow a mix of
retail, restaurant, and office uses, as well as a mix of attached, detached, and
townhouse residences on approximately 77.66 acres. On the residential portion, which
is on the south side of the property, they would have a total of 220 residential units.
There would be 24 attached alley access properties, four detached alley access
properties, 64 quads on common drives or on flag lots, as discussed previously, and,
then, nine condo lots with approximately 128 units and this would be in an R-15 zone.
For the commercial portion on the northern half of the property, there would be a total of
32 commercial lots in a C-C zone and that is approximately 45.8 acres. The gross
residential density is 6.92 units per acre. The net residential density is 8.61 unit per
acre. There are over -- or approximately 500,000 square feet of commercial square
footage proposed and that would be 32 buildings, accounting for modifications as time
goes by. Due to the complexity of this project, staff does believe a development

Regard to nonresidential structures, the
applicant has not requested a maximum square footage of retail, restaurant, or office
spaces, so we would normally revert to what is allowed in the zone. Because it is the C-
Czone normally we would allow a structure to go up to 200,000 square feet and 65 feet
in height before design review is required. Because there are adjoining residential
properties to the south, we are recommending that that limit be brought back through
the development agreement to 60,000 square feet in area or a maximum height of 40
feet. With regard to residential structures, the applicant has shown several elevations
for both alley accessed and townhouses and detached single family; Staff s~p~Rs-
those elevations, but wanted a little better clarification through+~:#t~~ deval.~prne[1~,
agreement on the specific height, bulk, types of materials, and locations proposed for
each type to address the concerns of the adjoining property owners and, then, to
include that within the development agreement. Regarding pathways, there is currently
a condition that the pathway be brought along the western property boundary. That was
part of -- was included as part of the development agreement that they needed to
accommodate that. There was some discussion, either during the hearing or since the

fashion that is consistent with the comprehensive plan designation and does not
negatively impact nearbyproperties.
Staff believes that the Development Agreement should include the following
provisions:
Phasine Plan: Generally, the applicant anticipates the phasing plan to begin with
the commercial lots near the Overland Road including the park site with '/z the
residential products and then continue development to the south and east.
Construction is anticipated to reflect market demand and construction needs. Staff
is supportive of this request but believes that some of the amenities proposed with
the development should be constructed prior to the development build out.
The
commercial/office lots should include either a permanent easement or be
redesigned to include landscaping in common lots along Overland Road.
Non-Residential Buildines: The applicant has not requested a maximum square
footage of retaiUrestaurant/office spaces. Staff does not propose to limit the
applicant to allow greater flexibility for more marketable conditions. The
maximum square footage of one single building without design review shall be
60,000 square feet or a maximum of 40' in height. These standards are to mitigate
anticipated concern from adjoining residential uses.
• Residential Buildines: The applicant has shown several elevations for both alley
accessed residential, townhouses, and detached single family residential products.
Staff supports these elevations but would also support better clarification of the
