Eagle Road Dear Planner: The Owner is requesting the approval to construct a 6,960 square foot retail building at the address mentioned above. The project will consist of one retail building for multi tenant use. No tenants leased the building at this time. The site is located on Eagle Road and Presidential just behind the Washington Trust Bank. The Owner is proposing to access to the site from Presidential and the private drive that is along the west boundary of the site. The Owner has shown a location for a future drive up window. It would be located along the south end of the building. One row of parking stalls would need to be deleted if the drive up window were approved through the Conditional Use process. An additional landscape island would be add to separate the drive aisles from the cars waiting at the drive up window. The building exterior will consist of stucco and bfick in earth tone colors. The building will have multiple entries on the west side that are covered by a building overhangs. The building has varying roof lines to break up the mass and provide architectural interest. The building also has exit doors on the east side. These will be used mainly for emergency exit and service to the shop space. There is a little extra concrete on the west side to allow for sidewalk sales. The landscape will be well done and will be compatible with the rest of the buildings in the area. Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or enforcement of the ACHD Policy Manual. a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged the applicant for the processing of appeals, to cover administrative costs. b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary of Highway Systems, which must be filed within ten (10) working days from the date of the decision that is the subject of the appeal. The notice of appeal shall refer to the decision being appealed, identify the appellant by name, address and telephone number and state the grounds for the appeal. The grounds shall include a written summary of the provisions of the policy relevant to the appeal and/or the facts and law relied upon and shall include a written argument in support of the appeal. The Commission shall not consider a notice of appeal that does not comply with the provisions of this subsection. c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of the filing of the notice of appeal to reply to the notice of the appeal, and may during such time meet with the appellant to discuss the matter, and may also consider and/or modify the decision that is being appealed. A copy of the reply and any modifications to the decision being appealed will be provided to the appellant prior to the Commission hearing on the appeal. d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal will be noticed and scheduled on the Commission agenda at a regular meeting to be held within thirty (30) days following the delivery to the appellant of the ROWDS Managers reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal and the reply shall be delivered to the Commission at least one (1) week prior to the hearing. e. Action by Commission: Following the hearing, the Commission shall either affirm or reverse, in whole or part, or otherwise modify, amend or supplement the decision being appealed, as such action is adequately supported by the law and evidence presented at the hearing. There are center landscape medians on Presidential Road abutting a portion of this site. • Pine Avenue Is currently Improved with 2 travel lanes and a center turn lane, bike lanes, and curb, gutter, and sidewalk abutting the site. The construction of Pine Avenue was recently completed between Cloverdale and Eagle. The road Is constructed a 5 -lane roadway, but Is currently only striped for 3 lanes. When volumes warrant, the road will be re -striped for 5 lanes. F, 04 f us Eagle Road is currently Improved with 4 travel lanes, a center turn lane and curb, gutter, and detached sidewalk abutting the site. There Is a traffic signal at the intersection of Eagle and Pine. 8. Existing Right -of -Way Presidential Road currently has 70 to 80 -feet of existing right-of-way abutting the site, Pine Avenue currently has 98 -feet of existing right-of-way abutting the site. Eagle Road currently has 140 -feet of existing right-of-way abutting the site. Eagle Road is under the jurisdiction of the Idaho Transportation Department 9. Existing Access to the Site The site currently has two driveways on Presidential Drive, one located on the west property line and one located approximately 80 -feet west of the east property line. Both driveways are in alignment with driveways on the north side of Presidential Drive. The site also has three driveways currently on Pine Avenue: a right-in/right-out driveway 175 -feet east of Eagle Road, a full access driveway 340 - feet east of Eagle Road, and a full access driveway 620 -feet east of Eagle Road. The driveways on Pine and on Presidential were constructed In accordance with the approval of Presidential Subdivision. 10. She History The District reviewed this site as part of a conditional use permit in 1998 for a 74 -acre retail development (MCUP-17-98). Subsequently, the District reviewed this site as part of Presidential Subdivision in August 2000. The proposed driveways are In accordance with the previous approvals for Presidential Subdivision. 11. Capital Improvements Plan/Five Year Work Program There are currently no projects within this area that are scheduled In the District's Five Year Work Program or Capital Improvements Plan. B. Findings for Consideration Right -of -Way Presidential Drive District policy requires 54 -feet of right -&-way on Industriallcommerdal roadways (Figure 72 -Fl B). This right-of-way allows for the construction of a 34ane roadway with curb, gutter and a 5 -foot wide detached concrete sidewalks. Presidential Drive currently has between 70 to 80 -feet of rfght-of-way abutting the ske. The existing right-of-way is suffident no addNonal right-of-way will be required to be dedicated with this application. Pine Avenue District policy requires 70 -feet of right-of-way on collector roadways (Figure 72 -FIB). Thisright-of- way width allows for the construction of a 3 -lane roadway with curb, gutter, 5-11bot wide detached sidewalks and bike lanes. Pine Avenue currently has 98 -feet of right-of-way abutting the sife. The existing right-of-wayis sufflcient no addNonal right-of-way will be required to be d"cated with this application. 3 0 C4 -D 0 t�'q Eagle ftoad Eagle Road is under the jurisdiction of the Idaho Transportation Department. The applicant Should contact ITD to determine what Improvements and access points will be approved on Eagle Road. 2. Street Sections Presidential Drive District policy 7202.8 and 72 -Fl B, requires roadways abutting commercial developments to be constructed as a 40 -foot street section with curb, gutter and 5 -foot concrete sidewalk within 54 -feet of right-of-way. Presidential Ddve is fully Improved with vertical curb, gutter, and a concrete sidewalk No additional improvements to the roadway are required with this appricatlon. Pine Avenue District policy 72 -Fl B requires collector roadways to be constructed as a 46 -foot street section with vertical curb, gutter and 5 -foot detached (or Moot attached) concrete sidewalk within 70 -feet of right- of-way with parking prohibited on both sides. Pine Avenue is full Improved with venlical curb, gutter, and a concrete sidewalk. No additional improvements to the roadway are required with this applicaffon. Eagle Road Eagle Road Is under the jurisdiction of the Idaho Transportation Department. 3. Driveways Location District policy 72+4 (1) requires driveways located on collector roadways near a signalized Intersection to be located a minimum of 175 -feet from the signalized Intersection for a full -access driveway and a minimum of 85 -feet from the signalized intersection for a right-in/right-out only driveway. District Policy 72-F4 (2) requires driveways located on collector roadways near a stop controlled Intersection to be located a minimum of 150 -feet from the Intersection for a full -access driveway and a minimum of I I 0 -feet from the intersection for a right-intright-out only driveway. The previously approved and now constructed driveways meet policy. The previously approved driveways are as follows: On Presidential Drive: • A full -access driveway located on the west property line. • A full -access driveway located 80 -feet west of the east property line. On Pine Avenue., • A rlght-in/right-out driveway located 175 -feet east of Eagle Road. • A ftill-access driveway located 340 -feet east of Eagle Road. • A full -access driveway located 620 -feet east of Eagle Road. No additional driveways are approved with this application. With the approval of the driveways for Presidential Subdivision, the applicant was required to Install a raised median on Pine Avenue from the stop bar at Eagle Road to a point 50 -feet east of the first driveway on Pine Avenue. The median has not yet been constructed, and will be required with this 4 0 (- ,a 0 ce application to ensure that the first driveway on Pine Avenue east of Eagle Road Is a right-Intright-out driveway as was previously approved. A median Island shall be Installed In Pine Avenue, on the South side of the center turn lane, from the stop bar at Eagle Road to a point 50 -feet east of the driveway that is located 175 -feet east of Eagle Road. Aid% District policy 7207.9.3 restricts commercial driveways with dally traffic volumes over 1,000 vehicles to a maximum width of 35 -feet. Most commercial driveways will be constructed as curb -cut type facilities if located on local streets. Curb return type driveways with 15 -foot radii will be required for driveways accessing collector and arterial roadways. Wflh the previous approval of Presidential Subdivision, ag of the driveways were restricted to 30 -feet In widih. Aff of the d4voways have been constructed as 30-1hot wide driveways. Paving Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to pave the driveway Its full width and at least 30 -feet Into the site beyond the edge of pavement of the roadway. A# of the driveways wift be required to be paved their full width and at least 30 -feet Into the sNe Cross Access The applicant has proposed to provide cross access to all of the lots within the development by means of a 30-fbot wide driveway that bisects the property north to south. The District is supportive of this due to the fact that five of the lots will not have frontage on a publicly maintained road. 5. Other Access Other than the access that Is Specifically approved with this application, direct lot access to Presidential Drive and Pine Avenue is prohibited and notes of this should be required on the final plat C. Special Recommendation to the City of Meridian Lots 3 through 7 do not have frontage on a publicly maintained road. The applicant has proposed a 30 -foot wide driveway bisecting the property from north to south that would provide access to these lots. ACHD recommends that a note be placed on the plat stating that the driveway provides permanent CrOss-access to those lots. D. Site Specific Conditions of Approval Comply with requirements of ITD for Eagle Road frontage. Submit to the District a letter from ITD regarding said requirements prior to District approval of the final plat or issuance of a building permit (or other required permits), whichever occurs first. It has been determined that the applicant's proposal for a driveway intersection on Pine Avenue, located approximately 180 -feet (measured property line to near edge) east of the west property line will not be approved with this application. In August 2000 this site was approved as part of Presidential Subdivision. With that subdivision application three access points on to Pine Avenue were approved. Those were located at 1175 -feet (rig ht-inlright-out), 340 -feet, and 620 -feet east of Eagle Road. When this site was re -subdivided in 2004 as Reagan Subdivision the three access points on to Pine Avenue previously approved with Presidential Subdivision were proposed and approved with the development application. That staff report and plat note states "that other than the access that is specifically approved with this application, direct lot access to Pine Avenue is prohibited". Because of the two prior staff reports and plat notes for both Presidential Subdivision and Reagan Subdivision restricting access to Pine Avenue no additional access to Pine Avenue will be allowed. Presidential Drive cuffently has between 70 to 80 -feet of right-of-way abutting the site. Thsexisting right-of-way Is sufficient, no additional nght-of-way will be required to be dedicated with this application. Pine Avenue District policy requires 70 -feet of right-of-way on collector roadways (Figure 72-F1B). ThIsright-of- way width allows for the construction of a 3 -lane roadway with curb, gutter, 5 -foot wide detached sidewalks and bike lanes. Pine Avenue cuffently has 98 -feet of night -of -way abutting the site. The existing right-of-wayls sufficient, no additional fight -of -way will be required to be dedicated with this application. 3 EagIg Road Eagle Road is under the jurisdiction of the Idaho Transportation Department. The applicant should contact ITD to determine what improvements and access points will be approved on Eagle Road. 2. Street Sections Presidential Drive District policy 7202.8 and 72 -Fl B, requires roadways abutting commercial developments to be constructed as a 40 -foot street section with curb, gutter and 5 -foot concrete sidewalk within 54 -feet of right-of-way. Presidential Drive is fully Improved with vertical curb, gutter, and a concrete sidewalk. A/c additional improvements to the roadway are required with this application. Pine Avenu District policy 72 -Fl B requires collector roadways to be constructed as a 46 -foot street section with vertical curb, gutter and 5 -foot detached (or 7 -foot attached) concrete sidewalk within 70 -feet of right- of-way with parking prohibited on both sides. Pine Avenue is full improved with vertical curb, gutter, and a concrete sidewalk. No additional improvements to the roadway are required with this application. Eagle Road Eagle Road Is under thejurlsdiction of the Idaho Transportation Department. 3. Driveways Locatign District policy 72-174 (1) requires driveways located on collector roadways near a signalized intersection to be located a minimum of 175 -feet from the signalized Intersection for a full -access driveway and a minimum of 85 -fest from the signalized Intersection for a right-in/right-out only driveway. District policy 72-F4 (2) requires driveways located on collector roadways near a stop controlled intersection to be located a minimum of 1 50 -feet from the Intersection for a full -access driveway and a minimum of 11 0 -feet from the intersection for a right-In/rIght-out only driveway. The previously approved and now constructed driveways meet policy. The previously approved driveways are as follows: On Presidential Drive: • A fullaccess driveway located on the west property line. • A full -access driveway located 80 -feet west of the east property line. On Pine Avenue: No additional driveways are approved with this application. With the approval of the driveways for Presidential Subdivision, the applicant was required to install a raised median on Pine Avenue from the stop bar at Eagle Road to a point 50 -feet east of the first driveway on Pine Avenue. The median has not yet been constructed, and will be required with this 0 0 application to ensure that the first driveway on Pine Avenue east of Eagle Road Is a right-inlright-out driveway as was previously approved. A median Island shall be Installed in Pine Avenue, on the south side of the center turn lane, from the stop bar at Eagle Road to a point 50 -feet east of the driveway that is located 175 -feet east of Eagle Road. Width District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles to a maximum width of 35 -feet. Most commercial driveways will be constructed as curb -cut type facilities if located on local streets. Curb return type driveways with I 5 -foot radii will be required for driveways accessing collector and arterial roadways. With the previous approval of Presidential Subdivision, all of the driveways were restricted to 30 -feet In width. AN of the driveways have been constructed as 30 -foot wide driveways. Pavina Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to pave the driveway its full wldth and at least 30 -feet into the site beyond the edge of pavement of the roadway. AN of the dtiveways will be required to be paved their full width and at least 30 -feet into the site. 4. Cross Access The applicant has proposed to provide cross access to all of the lots within the development by means of a 30 -foot wide driveway that bisects the property north to south. The District Is supportive of this due to the fact that five of the lots will not have frontage on a publicly maintained road. C. Special Recommendation to the City of Meridian Lots 3 through 7 do not have frontage an a publicly maintained road. The applicant has proposed a 30 -foot wide driveway bisecting the property from north to south that would provide access to these lots. They would like to move the building from the center of the site west along the access road. In addition they would like to add one office building of approximately 8,000 square feet along the east side of the site. This revision will provide a better buffer for the residential use on the east side. As a result we have attached revised drawings for you review. The project will consist still consist of one retail building for multi tenant use but there will be a future phase of one office building. The site is located on Eagle Road and Pine Street just east of the Metro Car Wash.
