CC - Relinquishment - Vacation and Relocation of Easement Recording requested by and when recorded return to: SPACE ABOVE THIS LINE FOR RECORDER'S USE ONLY VACATION AND RELOCATION OF EASEMENT THIS VACATION AND RELOCATION OF EASEMENT is made this 101 day of 2023, by #48 Highline Lateral Water Users Association, an unincorporated Idaho association operating pursuant to Idaho Code § 42-1301 (the"Association"). RECITALS A. Shamrock Foods Company, an Arizona corporation ("Owner"), is the owner of certain real property in Meridian,Ada County,Idaho, legally described and depicted in Exhibit A. attached hereto and incorporated herein by this reference("Property"). C. The Property was recently reconfigured as part of a Property Boundary Adjustment in order to facilitate construction of a building on the Property.The Property Boundary Adjustment is referenced as City of Meridian file no.PBA-2023-0010,memorialized by the Record of Survey recorded as Ada County Instrument No. 2023-059739 on October 20, 2023 and included in Exhibit A. B. The Property remains subject to a 10'-wide Irrigation Easement ditch benefitting:the Association, originally depicted on the Treasure Valley Business Center subdivision plat, recorded in the records of Ada County, Idaho as Instrument No. 8603923 on January 23, 1986, filed in Book 53 of plats at pages 4790 through 4792 (the"Irrigation Easement"). D. The Irrigation Easement is being relocated,consent to which was given by the Association recorded as Ada County Instrument No.2023- on .Association now desires to vacate the prior platted Irrigation Easement in order to facilitate construction by Owner on the Property. VACATION NOW, THEREFORE, in consideration of the recitals above, which are incorporated herein, the Association hereby vacates, releases and terminates all right, title and interest in the prior Irrigation Easement and does further hereby declare that any right,title or interest it may have in the prior Irrigation Easement are hereby released to Owner. RELOCATED EASEMENT Owner hereby confirms to Association a relocated easement which runs east and west along the southwestern corner of the Property, north and south along the western boundary line of the Property, east and west along the northwestern boundary of the property,and then north and south to the northern property boundary of the Property, for the installation, operation, maintenance, repair, and replacement of the VACATION AND RELOCATION OF EASEMENT(HIGHLINE)-PAGE 1 OF 6 relocated irrigation ditch, as finally installed. The easement shall be ten (10) feet in width regardless offences, or other obstructions. The relocated easement will be as depicted in Exhibit B.
