Broadway Avenue Suite 102 Meridian, Idaho 83642 RE: Shamrock Foods—Vacation Application Dear Planning Director: On behalf of Shamrock Foods,we submit this narrative as an attachment to the application to vacate a platted irrigation easement, generally shown as the blue dotted line in the map below (the"Platted Easement")on a parcel of land located at 1495 N.Hickory Ave,Meridian,ID 83642, also known as Ada County Parcel No. R8525102800, outlined in red in the map below (the "Property"). Vacation of the Platted Easement is necessary to facilitate construction of a new building on the Property (the "Project"). Background: - The Property is part of the Treasure Valley i9M 1 Business Center Subdivision, Phase 1, which was recorded in the records of Ada County on January 23, 1986 as Instrument No. 8603923 (the "Plat"). The Property was recently reconfigured as part of a Property Boundary Adjustment through the City of Meridian, _ approved in November 2023 under record no.PBA-2023- 0010. The Platted Easement was created by reference on the Plat; no other deed or instrument has been located in r public records or otherwise that contemplates its formation and no legal description of the easement area was found. The Platted Easement exists to provide for irrigation facilities benefitting the Highline Lateral Users Association ("Highline"). As indicated on the Plat, the easement is solely for irrigation purposes. It is solely owned by Highline and we have confirmed that Settlers Irrigation Company has no interest in this easement or the associated irrigation facilities. The existing facilities are being relocated to the western edge of the Property, generally depicted in yellow in the map above. Highline has consented to the relocation of the facilities, to the creation of a new easement to include the relocated facilities, and to the vacation of the Platted Easement as provided in the Vacation and Relocation of Easement and Consent to Relocation of Irrigation Easement and Irrigation Facilities, included in the application materials. This City of Meridian vacation is the remaining step necessary to relocate the easement and begin permitting and construction of the Project. We therefore request approval of this Platted Easement vacation consistent with the process set forth Meridian City Code Table 11-5A-2 for a vacation exempt per Idaho Code §50-1306A(5).
