RE: Lots 11 & 12, Block 7, The Oaks North No. 1 —Easement Vacation
Dear Planning Staff,
Toll Southwest LLC hereby applies for an easement vacation application for Lots 11 and 12 of Block
7 of The Oaks North Subdivision No. 1. Lot 11 (Parcel No. R6206952525) is located at 5662 W
Daphne Dr,Meridian, ID 83646, and Lot 12 (Parcel No. R6206952545)is located at 5684 W Daphne
Dr, Meridian, ID 83646. Both lots are located in the SW 1/4 and the W 1/2 of the SE 1/4, of Section 28,
Township 4 North, Range 1 West, Boise Meridian, Ada County, Meridian, Idaho. These lots
originated when The Oaks North Subdivision No. 1 final plat was recorded as instrument number
2020-011612 on January 291h, 2020. These lots were subsequently adjusted as a result of a Property
Boundary Adjustment application (PBA-2023-0015), which was approved on November 9th, 2023.
These lots are zoned in the R-8 (medium-density residential) zoning district.
The Easement Vacation is being requested to vacate the permanent easement for public utilities,
pressure irrigation, and lot drainage over the five (5) feet adjacent to any interior side lot line, which
was established by the recorded final plat for The Oaks North Subdivision No. 1. The
beforementioned easements have been re-established as a result of the approved Property Boundary
Adjustment and subsequent recording of a quitclaim deed,which formally established a new property
boundary. The vacation of these easements will allow for the construction of a single-family
residential home.
