Landscaping: The Landscape Plan prepared by Anthony & Maria Reyna, dated June 22, 2006, is approved (stamped "Approved" on Juiy 7, 2006 by the Meridian Planning Department) with no changes. However, see the notes on the landscape plan. The approved landscape plan is not to be altered without prior written approval of the Planning Department. No field changes to landscape plan permitted; prior written approval of all material changes is required. Site Plan: The Site Plan prepared by Anthony & Maria Reyna, dated June 22, 2006, is approved {stamped "Approved" on July 7, 2D06 by the Meridian Planning Department) with no changes. The approved site plan is not to be altered without prior written approval ofthe Planning Department. Alternative Compliance: The applicants, Anthony & Maria Reyna have requested alternative compliance from UDC standard 11-2A-7, which requires a 20 foot landscape buffer along collector Streets {Pine Avenue) and from UDC standard 11-3B-7C3B, which requires one (1) tree per thirty- fivelinear feet. The required buffer would decrease the required parking standard per UDC 11-3 C- 6B and would create an unavoidable hardship to the site. Also, the existing tree on site is we11 established and large enough to accommodate for 2 trees. In lieu of the required buffer width and the additional required tree, the applicant has proposed a 6 foot tall solid vinyl fence along the southern boundaries and the eastern boundary of the front yard. The fence will enhance the appeal of the front yard of the property. Therefore, the Director has approved the applicant's alternative compliance request per UDC ].1-5B-SB2a. Elevations: The Elevations submitted by Anthony & Maria Reyna, are approved with no changes from the Planning Department. Day Gare standards, UDC I 1-4-3.91ists specific criteria for day care facilities that serve children. The applicant shall comply with the following: • In determining the type of day care facility, the total number of children cared for during the day and not the number of children at the facility at one time, is the determining factor. The operator's children are excluded from the number. • On-site vehicle pickup, parking and turnaround areas shall be provided to ensure safe discharge and pickup of clients. • The decision-making body shall specify the m aximum number of allowable clients and hours of operation as conditions of approval. • The applicant or owner shall secure and maintain a Basic Day Care License from the State of .Idaho Department of Health and Welfare-Family and Children's Services Division. • In residential districts or uses adjoining an adjacent residence, the hours of operation shall be between 6:00 a.m. to 11:00 p.m_ This standard may be modified through approval of a Candztional Use Pexxnit. • All outdoor play areas shall be completely enclosed by minimum six-foot {6') non-scalable fence to secure against exit/entry by small children and to screen abutting properties. The fencing material shall meet the swimming pool fence requirements of the Building Code in accord with Title 10 of the Meridian City Municipal Cade. • Outdoor play equipment over six feet (6') high shall not be located in a front yard or within any required yard. • Outdoor play areas in residential districts adjacent to an existing residence shall not be used after dusk. Taxi ation: An underground, pressurized imgation system must be installed to all landscape areas per the approved specif cations and in accordance with UDC 11-3A-15. Curbing: Per UDC 11-3B-SI, aTl landscape areas adj acent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing maybe cut to allow for storm. water runoff. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B- 10, coordinate with the Parks Department Arbarist (Elroy Huff, 8$8-3579) fax approval of protection/relocation measures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11-38-10-C.5. Parkin: The proposed parking areas shall be paved and striped in accordance with UDC 11-3B. Project engineer/architect shall certify that the number and size of handicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed "Van Accessible". Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to occupancy. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fiilly vegetated, and shall be designed in compliance with UDC 11-3B-I 1 and UDC 11-3A-1$. Fencing: Any required or proposed fencing shall be installed with current fencing standards as defined in UDC 11-3A-7. ACRD Acce tance: All impact fees, if any, shall be paid prior to the issuance afa building pernut. If arty changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning Department staff for approval prior to the issuance of a building permit. Certificate of Occu anc : All required improvements must be complete prior to obtaining a Certificate of Occupancy. A written certificate of completion shall be prepared by the landscape architect, landscape designer or qualified nurseryman responsible for the landscape plan upon completion of the landscape installation. The Certificate of Completion shall verify that all landscape improvements, including plant materials and sprinkler installation, are in substantial compliance with the approved landscape plan. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy. Plan Modifications: Except for the changes mentioned above, the approved Site Plan, Landscape Plan stamped "Approved" on July 7, 2006, end Elevations, and are not to be altered without prior written approval of the Planning Depari~xxent. The on site location of little Prints Childcare will 6e at 711 W. Pine Ave. This location will consist of 3 parking stalls with one being an ADA parking stall. The front yard will be reconstructed to a child play area that will consist of play stna.ctures not taller then 6' tall and a tetherball corner for alder after school children located in the back yard. These play areas will be fully enclosed by a 6' no scalable fence to make sure that children are confined from leaving and subjected to unfamiliar surroundings. There will be a 20' buffer i.n the front of the lot that I ask my tapered down to a 14' buffer to f t adequate parking for the childcare center. In return I will provide a 6' no scaleable vinyl fence to enhance the front area of the properly. I also ask you to allow me to use only on tree in the 20' Iandscaped buffer, due to the size of the tree that already exists_ This is a 42' by 20' landscaped buffer with a Maple tree that is about 100' tall and 100' in radius. The ACRD Commission will not hear this item unless the site plan is changed in such a manner as to require Commission review. However, ACRD receives many calls from neighbors of day care centers concerning the volume of traffic and the number of parked vehicles near existing day care centers. Each parent typically makes two round trips per day (i.e. four one-way trips). The Institute of Transportation Engineers (ITE) data shows that typical day cares created 4.52 vehicle trips per day per student. The proposed 20 student facility can be expected to generate 90 total vehicle trips per day. All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACRD Ordinances unless speci£cally waived in writing by the District.
