PLANNING DIVISIONā€”Development Agreement Modifications: 1. The applicant agrees to enter into a new development agreement. a. The applicant will comply. b. The applicant will comply. c. The applicant will comply. d. We respectfully request that the noise abatement berm and wall be constructed in its entirety when a phase is platted adjacent to I-84. The applicant will be installing a 9-foot-high berm that requires a significant amount of fill material. We need time to generate excess dirt for the construction of the berm. We are coordinating with Hawkins Company to utilize any excess material generated by their primary retail building. The first phase will not provide enough material for the berm and would require the import of material, generating significant truck trips in the downtown area, and which is very costly. e. We request removal of the condition requiring completion of the Linder Road overpass prior to the issuance of an occupancy permit for the multi-family portion of the development.The development plan identifies Phase 1 as 54 single-family lots that will generate 553 vehicle HADocuments\2022\220721 Tanner Creek Subdivision\RecsResponsCC.doc Meridian Mayor and City Council November 20, 2023 Page 2 trips per day, and Phase 2 (152 multi-family units)will have a traffic generation of 1,017. The two phases will have a combined daily trip generation of 1,570. This low number does not even meet the threshold for an existing local street,which can handle 2,000 vehicle trips per day. We do not believe that a delay of the second phase is warranted considering the traffic generation. The total traffic generated by Tanner Creek at full buildout is only 22 percent of the traffic generated by the proposed Hawkin's commercial development. Tanner Creek should not be restricted considering the traffic generation of the proposed uses. 2. Preliminary Plat: a. The applicant will comply. b. The applicant will comply. c. The applicant has been working with Hawkins Companies to create a greenbelt, multi-use pathway and interconnecting plazas that provide for a safe and attractive pedestrian experience. Vehicular access over Ten Mile Creek will detract from the pedestrian-friendly design of the overall development. Waltman Lane is a collector roadway and should accommodate the vehicle interconnectivity. The Planning and Zoning Commission was supportive of the pedestrian connection and the preservation of the multi-use pathway and integrated plaza concept. We respectfully request that the City Council waive this requirement. 3. The landscape plan will be revised as requested. 4. The applicant will comply. 5. The applicant will comply. 6.
