Stacy,
Thank you for taking my call and the discussion today.
th
We are requesting a continuation of this project until the December 7 P&Z hearing.
Couple of items to clarify:
1. I had asked you about the buffer along I-84 – On further inspection of the drawing, it appears that our 50’ buffer
was mislabeled and that there is in fact no easement. Please disregard my request to you about the pathway
being located outside the easement.
2. I still need some direction on the requirement for the berm in the 50’ buffer. I am unable to locate
section 3.07.01.C of the TMISAP as referenced in 2.3.h. of the conditions of approval.
th
It is our intent to provide you updated plans addressing your comments by the 10 of November – hopefully that
provides time for you to prepare the staff report for the December 7 Meeting.
1
These updates will include:
- Better labeling of the required buffers and cross sections at each road showing their relation to the adjacent
roads and rights of way.
- Updating the pathways and associated landscape to meet the requirements stated in the report, including
required landscaping in the I-84 buffer and along both sides of the pathway.
- Revising the layout of the site buildings to provide more retail presence on Vanguard as requested.
- Adding the required centrally located plaza and public art (the historic preservation monument) to the site.
- Revising the Vanguard street section (and detached 10’ sidewalk) to be consistent with the ACHD staff report
requirements.
Thank You,
David A. Bailey P.E.

Good Afternoon Katie,
Given the numerous outstanding issues with this project, it may be in the best interest of the Applicant to
request a continuance. This would allow time to address the outstanding issues prior to presenting the
project to Commission, potentially leading to a more favorable outcome.
Sincerely,
