We have reviewed staff comments for the Planning & Zoning Commission meeting of
November 2, 2023, and have the following responses:
CITY/AGENCY COMMENTS & CONDITIONS
A. PLANNING DIVISION — Development Agreement Modifications:
1. The applicant agrees to enter into a new development agreement.
a. The applicant will comply.
b. The existing unimproved right-of-way for Corporate Drive south of
Ten Mile Creek is 54 feet in width. ACHD is requiring the applicant to
construct a 30-foot-wide street section with 3-foot-wide gravel shoulders.
There is not enough right-of-way to construct a 40-foot-wide collector
street section with 10-foot-wide detached sidewalks on both sides. That
would require 76 feet of right-of-way and no area for storm drainage
retention. The applicant respectfully requests the street section required
be consistent with the ACHD requirements. The applicant may be able
to install a 5-foot-wide sidewalk on one side if storm drainage facilities
can still fit within the 54 feet of right-of-way.
c. The applicant will comply.
d. We respectfully request that the noise abatement berm and wall be
constructed in its entirety when a phase is platted adjacent to I-84. The
applicant will be installing a 9-foot-high berm that requires a significant
amount of fill material. We need time to generate excess dirt for the
construction of the berm. The first phase will not provide enough
material for the berm requiring the import of material which is very
costly and will generate significant truck trips in the downtown area.

2. Preliminary Plat:

c. The applicant has been working with Hawkins Companies to create a
greenbelt, multi -use pathway and interconnecting plazas that provides
for a safe and attractive pedestrian experience. Vehicular access over
Ten Mile Creek will detract from the pedestrian -friendly design of the
overall development. Waltman Lane is a collector roadway and
should accommodate the vehicle interconnectivity. We will request
that the City Council waive this requirement.
3. The landscape plan will be revised as requested.
