I think we are amenable to this; however, we would like to have flexibility in the general configuration of the buildings.
The letter outlines our preferred language, I believe.
As an example, if we are unable to secure, say, Retail 2 or one of the drive-through tenants, the layout of the existing
buildings may change, along with potentially the square-footage (not an extreme change – I’m envisioning like 15-20%
larger/smaller maximum), but the concept plan – the overall locations of buildings, and general square-footages -- will
remain similar.
This flexibility is important because we do not have leases signed with all tenants, and it seems silly to have a restaurant,
for example (or another use allowed in the C-G) have to go to Council simply because it it looks different than the
original concept plan. I think the best/easiest course of action is to allow for minor changes to the site plan (building
footprint/orientation, parking layout, etc) with a site plan review/DES, and saving a DA mod for only if we change the
concept plan in a major way, such as, for example, moving retail 2 to the other side of the site, or pulling a shops
building back to the SE corner or something of that nature.

Since the concept development plan includes all of the property owned by Hawkins, are you requesting to include the
entire property in the development agreement? I assume that’s your intention but wanted to double-check.
