Simison E IDIAN.� City Council Members: =�� Brad Hoaglun John Overton Joe Borton Jessica Perreault D A H O Luke Cavener Liz Strader June 15, 2023 MEMORANDUM TO: Mayor& City Council FROM: Bill Parsons, Planning Supervisor CC: City Attorney, Baron Properties RE: Artisan Victory Market(H-2022-0066) On May 91h, City Council heard the Artisan Victory Market application. During the hearing, several design elements of the plan (better integration of the commercial uses including limiting/restricting the drive-through AND removing the commercial in favor of renoticing the project with all residential units)were discussed. Based on these discussions the applicant has removed the commercial component and incorporated more residential units which was noted as one of the options the applicant could pursue. The project was noticed pursuant to the City's ordinance to reflect the changes being proposed by the applicant. All of the revised documents are included as part of the public record. Staff has reviewed the revised plan and offers the following for Council's consideration: 1. Residential unit count has increased from 131 units to 138 units and the number of buildable lots has decreased from 5 lots to 4 lots. 2. Strike DA provisions b and d because the revised plans don't include commercial. 3. Strike preliminary plat condition 2a. because the project no longer has a commercial component. The applicant is proposing a pedestrian connection instead of a vehicular connection to mitigate the commercial traffic from the south entering the residential development. Strike preliminary plat condition 3c. as the fencing plan has been updated to comply with UDC fence standards. 5. Strike Conditional Use Permit conditions of approval 12a. and d. The CUP site plan and open space exhibit have been revised to meet these conditions. 6. Modify Conditional Use Permit condition 12g. to reflect the parking count increase from 236 to 314. If the Council supports the revised plans and the modifications to the conditions of approval noted above, the staff report will be updated to reflect these changes and include the revised plans provided by the applicant prior to the adoption of the Findings. 2
