Re: Fence Waiver Application
Dear Mr. & Mrs. Duncan:
This letter is in response to your fence waiver application for the property
located at 2838 S. Groom Way, Meridian, Idaho. In your application you
asked to be allowed to reduce the setback from 20-feet to 10-feet from the
street side property line along Girdner Drive,
No objections were received from surrounding property owners, whom were
notified in accord with the City's Zoning and Development Ordinances.
The City has approved your Fence Waiver, allowing the fence to be located
lO-feet from the street side property line along Girdner Drive. This approval
is subject to the conditions noted below. Section 11-1-11 of the Meridian City
Code allows any aggrieved person to appeal this decision. All appeals shall
be filed with the Planning and Zoning Department within fifteen (15) days
after the date of this letter.
1. The face of the fence shall be set a minimum of 10-feet from the
property line along Girdner Drive.
2. You must landscape and maintain the ground area between the fence
and sidewalk.
3. The board side of the fence shall face out toward the street( s).
4. You must also obtain a building permit for your fence from the City
of Meridian Building Department prior to construction. You must also
call for an inspection of the fence once you have completed
construction.

The City of Meridian has no jurisdiction in the enforcement of the provisions
of your subdivision's protective covenants. We recommend that you obtain
approval from your homeowner's association for this fence location. We also
recommend that you contact Dig-Line at 342-1585 to locate any underground
utilities prior to digging or excavating for your fence posts,

NOTICE OF APPLICATION FOR FENCE WAIVER
NOTICE IS HEREBY GIVEN, pursuant to the Ordinances of the City of
Meridian and the laws of the State of Idaho, that Matthew and Kathleen
Duncan has filed with the Zoning Administrator of the City of Meridian an
application for a Waiver from the Fence Ordinance regarding his/her property
located at 2838 South Groom Way, Meridian, Idaho. The Applicant proposes a
reduction of the required setback distance from 20 feet to 10 feet from property
line along East Girdner Avenue.
Comments, either for or against, said application must be filed with the
Zoning Administrator within fifteen (15) days after the initial publication of this
notice and shall be addressed to Planning and Zoning Department clo Sonya
Allen, City of Meridian, 660 E. Watertower Ln., Suite #202, Meridian, Idaho. If
there are pertinent and compelling objections filed within the time allowed, the
Zoning Administrator may schedule a hearing on the application.
The property at 2838 South Groom Way is more particularly described as
Lot 7, Block 6 of Sutherland Farm Subdivision No.2, Meridian, Ada County,
Idaho.
Any and all interested persons are welcome and invited to
comments.

SEcrION S.2i. Vehicles. The use of all vehicles, including, but not lirruted to,
automobiles, trucks, bicycles, and motorcycles, shaH be subject to ACe Rules/Ace Standards,
which ~nay pro~bit or limit the us7 thereof within the Property, and which provide parking
regulatIOns and other rules regulatmg the same.
sEC..nON 5.22. ExteriQr Energy Devices. No energy production device, indudin<1, but not
limited to, generators of any kind, and solar energy devices, shall be constructed or maintaj~ed on
any Lot without tne prior written approval of the ACe, except for heat pumps or similar appliances
shown on the plans approved by the ACe.
SECnON 5.23. Mailboxes. All free-,standing mailboxf'.s, constructed or installed on any
Lot, shall be of a uniform type and design, as determined by the ACe.
SECfION 5.24. SigM. No commercial billboard or advertising shall be displayed to the
public view on or from any Lot. Owners may advertise a. dwelling unit and Lot for reot or for sale
by displaying a single, neat, professionally painted, reasonably sized vacancy sign or "For Sale"
sign thereon. Signs, advertising the name of the builder, and the name of the ins.titution providing
financing therefore, may be displayed on a Lot during construction of the Improvements. Lighted.
moving, or flashing signs for any purposes are prohibited. Directionat signs may be used to give
directions to traffic or pedestrians, or give special instructions. A directional or identificatioll sign
within the Property shall be pemutted, provided the same is approved in writing by the ACe prior to
installation.
SECftON 5.25. Subdividing. Except for Blocks 1,5 and 6, no Lot may be further
subdi vided, nor may any easement or ot.her interest therein less than the whole be conveyed by the
Owner thereof without the prior wrirten consent of the ACe; provided, however., that nothing herein
shall be deemed to prevent an Owner from transferring or selling any Lot to more than one person
to be held by them as tenants in common, joint tenants, tenants by the entirety, or as community
property, or require the approval of the ACe therefore. [n addition, the conveyance of an
insignificant pOrUon(s) of a LOl (to G1e Owner of the Lot which abuts said conveyed portion) for the
purpose of correcting a common boundary or other similar purpose, shaH not be deemed to be a
subdividing of a Lot within the prohibition contained herein.
SEc...'TION 5.26. Fences. No fence or waH of any kind shaH be constnlcted on a Lot,
i!nless the plans and specifications therefore, including the location, design, material, and cotor
thereof, have been approved in writing by the ACe prior to the constnlction or installation. Ail
fences and/or walls constructed on a Lot shall be in compliance with the ordinances (applicable to
the Property) of I:he City of Meridian, Idaho.
All fences and walls shall be subject to the following restrictions:
(a) No fence or wan shaH be permitted to be constructed or installed on the Common
Area, or any portion of a berm constructed by the Gr.antor within the Property;
provided, that if the Grantor constructs or iIl',taUs a fence in a Common Area or on a
berm, the ACe may allow fences on the adjacent Lot(s) to be attached thereto, so
long as such attachment does not (i) impede the maintenance, repair, or replacement
-of the ConmlOIl Area or berm, (ii) alter the visual theme established by the fence
constructed or installed by the Grantor, and (ih) does not project above the top of the
fence constructed by the Grantor.
