Dear Ms. Ellis:
This letter is in response to your fence waiver application for the property located at 2090 E.
Horse Creek Street, Meridian, Idaho. In your application you asked to be allowed to reduce the
setback from 20 feet to 10 feet along S. Gold Bar Way.
We received no comments from surrounding property owners, whom were notified in accord
with the City's Zoning and Development Ordinances.
The City has approved your Fence Waiver request. The approved setback for the fenc~ location
will be a minimum often feet from the street side property line on S. Gold Bar Way, starting
behind the front edge of the house. This approval is subject to the conditions noted below.
Section 11-1-11 of the Meridian City Code allows any aggrieved person to appeal this decision.
All appeals shall be filed with the Planning and Zoning Department within fifteen (15) days
after the date oftrus letter.
1. The face of the fence shall be set a minimum of 10 feet from the property line along S.
Gold Bar Way.
2. You must landscape and maintain the ground area between the fence and sidewalk.
3. The board side ofthe fence shall face out toward the street(s).
4. You must obtain a building permit for your fence from the City of Meridian Building
Department prior to construction. You must also call for an inspection of the fence once
you have completed construction,

The City of Meridian has no jurisdiction in the enforcement of the prOVlSIons of your
subdivision's protective covenants. We recommend that you obtain approval from your
homeowner's association for this fence location. We also recommend that you contact Dig-Line
at 342-1585 to locate any underground utilities prior to digging or excavating for your fence
posts.

The restrictive covenants for the Tarawood subdivision state that all fences must
be in accordance with the Meridian city fence ordinance. The T arawood
Architectural Control Committee has approved our fence being 10 feet from the
property line (on a corner lot), rather than 20 feet (as the ordinance states) as
long as our fence waiver application is approved by the city.

8.3 Dwellina Unit Size. No Dwelling Unit shall be
constructed or placed on any Lot containing a total floor area on
all floors intended and suitable for use as living area (not
including a garage or a basement) of less than 1,800 square feet
measured from the outside of the exterior walls, or with a ground
floor area of less than 950 square feet. In computing floor
area, basement space or any floor with a finished elevation more
than three feet below the natural contour of the surrounding area
shall not be included. No Building shall exceed two and one-half
stories or 35 feet in height unless approved by the Ace. In
granting or withholding such approva1r the Ace shall consider the
adverse effect of height on other properties within the
subdivision and such other facts as-may be reasonable. Each
dwelling unit shall have an attached or detached fully enclosed
garage adequate for a minimum of two (2) standard size
automobiles. No carports shall be allowed.
8.4 Construction of Buildinos. All construction work on
Dwelling Units shall be diligently and continuously pursued, and
shall be c~mpleted within nine (9) months from the date the OWNER
purchased the Lot from Declarant.
8.5 outbuildinos. Outbuildings, separate garages, sheds
and shelters may be constructed only simultaneously with or after
a Dwelling Unit has been constructed on the Owner's Lot. All
such buildings shall be constructed only after written approval
thereof by the ACC. All outbuildings shall be constructed of
similar or compatible exterior materials with the Dwelling Unit
so as to be aesthetically compatible therewith.
8.6 Fences. Wrought iron fences are encouraged. Cedar
fences may be allowed provided the design is for a solid top
rail with no dog-eared or irregular topped cedar fences allowed.

be constructed on a Lot unless the plans and specirications
therefore, including the locationr design, material and color
thereof, have been approved in writing by the ACe prior to the
construction or installation. All fences and/or walls
constructed on a Lot shall be in compliance with the applicable
ordinance of the City- No other type'of fence shall be allowed.

Comments, either for or against, said application must be filed with the
Zoning Administrator within fifteen (15) days after the initial publication of this
notice and shall be addressed to Anna B. Powell, Zoning Administrator, City of
Meridian, 660 E. Watertower Ln., Suite #202, Meridian, Idaho. If there are
pertinent and compelling objections filed within the time allowed, the Zoning
Administrator may schedule a hearing on the application.
