Dear Mr. Clough:
Tills letter is in response to your fence waiver application for the property located at 406 W.
Ashton Drive, Meridian, Idaho. In your application you asked to be allowed to reduce the
setback from 20-feet to 13-feet from the property line along N. Alexis Way.
We received no comments from surrounding property owners, whom were notified in accord
with the City's Zoning and Development Ordinances.
The City has approved your Fence Waiver. The approved fence location is 13-feet from the
property line along N. Alexis Way, starting 20-feet from the front edge of the house. This
approval is subject to the conditions noted below. Section 11-1-11 of the Meridian City Code
allows any aggrieved person to appeal this decision. All appeals shall be filed with the Planning
and Zoning Department within fifteen (15) days after the date of this letter.
1. The face of the fence shall be set a minimum of 13 - feet from the property line along N.
Alexis Way. .
2. You must landscape and maintain the ground area between the fence and sidewalk.
3. The board side of the fence shall face out toward the street(s).
4. You must also obtain a building permit for your fence from the City of Meridian
Building Dep-artment prior to construction. You must also call for an inspection of the
fence once you have comp~eted construction.

The City of Meridian has no jurisdiction in the enforcement of the proVIsIOns of your
subdivision's protective covenants. We recommend that you obtain approval from your
homeowner's association for this fence location. We also recommend that you contact Dig-Line
at 342~1585 to locate any underground utilities prior to digging or excavating for your fence
posts.

NOTICE OF APPLICATION FOR FENCE WAIVER
NOTICE IS HEREBY GIVEN, pursuant to the Ordinances of the City of
Meridian and the laws of the State of Idaho, that Mark Clough has filed with the
Zoning Administrator of the City of Meridian an application for a Waiver from the
Fence Ordinance regarding his/her property located at 4156 West Campfire
StreetJ Meridian, Idaho. The Applicant proposes a (13) foot setback from
property line along North Alexis Way.
Comments, either for or against, said application must be filed with the
Zoning Administrator within fifteen (15) days after the initial publication of this
notice and shall be addressed to Planning & Zoning Department, c/o Sonya
Allen, City of Meridian, 660 E. Watertower Ln., Suite #202, Meridian, Idaho. If
there are pertinent and compelling objections filed within the time allowed, the
Zoning Administrator may schedule a hearing on the application.

~,' 4.12.1 Owner's liabilitv. It shall be the specific affirmative duty of
each Ownerto prevent any water on that Owner's lot from draining onto any other
Owner's property (and/or into any neighboring crawl spaces}. ,In the event that an
Own'er;;does not adequately maintain the grade, drainage and slope of the Lot as
provided herein, or uses excessive irrigation water, and water flows off the Lot onto
an adjacent property causing damage or injury, the offending Owner may be liable
for any damages oocurring as a reslllt of the drainage.
4.12.2 Grantor No Liabilitv For Drainage_. Grantor shall have no
liability for any damages or problems caused by drainage. Nor shall Grantor have
any duty to remedy, fix or cLire any drainage problems on individual Lots.
4.13 Landscaping. Berms and sculptlJ>",Ll planting areas are strongly
encouraged. Each Lot shall have " rull coverage automatic sprinkler system.
Landscaping of the front yard shall be completed within thirty (3D) days after
occupancy of the home (weather permitting) and such landscaping shall be the

The "front yard" shall be defined as that portion of the Building Lot from one
side Lot Hne to the opposite side Lot line lying in front of the front exposure of the
house. For Building Lots on corners, the "front yardtt shall also include all of the side
yard next to the side street from the front Lot line to the rear Lot line.
The back yard of~a.ch. home shall be landscaped or sodded within one year of
occupancy. .
Weed Control: Prior to the planting of grass it shall be the responsibility
of the .builder and/or the Owner to keep all weeds on the lot under control and
periodically cut so they remain less that 6" tall. Neglected weeds may be cut by the
Association vyithout notice and the bill there"for shall be paid by the lot Owner as a
Limited Assessment.
4.14 Fences.
4.14.1 Subdivision Perimeter Fences. Grantor may construct a perimeter

fence around portions of the extenor 0 t IS su Ivision property. After Grantor has
transferred title to any Lot which contains a portion of this perimeter fence it shall
be the responsibility thereafter of the Owner of that Lot to maintain, repair and/or
replace'; as needed that portion of the perimeter fence on that Owner's Lot (except
as set out below). The maintenance, repairs and/or replacement shall be performed
so as to keep the perimeter fencing uniform, attractive and harmonious.
4.14.2 Association Fences. Any six (6) foot chain link fences

constructed along the boundaries of Common Area Lot 21 t Block 3; Common Area
Lot 11, Block 13 and Common Area Lot 1, Block 14 shall be owned and maintained
by the Association. No holes, gaps, gates or access points shall be cut or allowed
through that fence (or any other Common Area fencp\ tn ::>rw .r"' ~..-' ........"n A rea Lot from
any Building Lot. All other fences constn ": ...~U In any Common Area, or on any
Common Area Lot shall also be ownr..J and maintained by the Association.
4.14.3 Other Owner Fences. Other Owner fences are not required. Any
fence by an Owner shall first be approved by the Board. Chain link fences, except
along a ditch, drain or ,wat?r~ay, are prohibited. No combustible fence shall be
;'constructed adjacent to and along" side of. a Common Area chain link fence.
4.14.4 Distance From Street. No fence shall be constructed on any Lot
(including corner Lots) closer to the front Lot line than two (2) feet behind the front
edge of the dweJling. For corner Lots, the fence along the side street shall be at least
fifteen (15) feet from the back of the sidewalkn (The back of the sidewalk is the side
away from the street.)
4.14.5 Chain link fences. No chain link fences are allowed except where
required herein or along watercourses or open ditches,

4.15 Construction. No pre-existing home, mobile hO,me, house trailer, tent,
shack, or prefabricated home shaH be moved onto any Lot. All homes in this
Subdivision must be constructed on the Lot. Once construction has begun,
completion of each building or other irhprovement shall be diligently pursued and
completed within 12 months. Temporary construction structures are permitted only
durino the time of construction. I

4.16 Pole Lights: Antennae. Each home within 30 days of occupancy will
have a photo-sensitive pole fight installed in the front yard, with a minimum bulb
power of 40 watts, designed to switch on automatically at sunset and off at
sunrise. Installation is the specific responsibility of the lot Owner.
