City Clerk OfficE RE: FENCE VARIANCE REQUEST - 714 West Calderwood Street. Dear Mr. And Mrs. Hale: The Fence Variance Committee of the City of Meridian, met at 4:45 P.M., May 21, 2003 in City Hall, to consider your request for a fence setback variance. After due consideration, the Committee decided to allow a variance request for you to construct a six (6) foot tall wooden fence in your side street setback area. There was opposition to this variance request from adjacent property owners, who were notified in accordance with City Ordinance requirements of the variance request. This approved fence location is as shown on the attached sketch and this approval is subject to the following conditions: 1. The face of the fence shall be set a minimum of 13 feet - 0 inches from the yard side edge of sidewalk along West Calderwood Street. Also you have agreed to work with Mr. And Mrs. Pearson to the East, and have agreed to forty-five the SouthEast comer as shown on the drawing. 2. The ground area between the fence and sidewalk shall be landscaped and maintained by you. 3. The board side of the fence shall face out toward the street(s). 4. The City of Meridian has no jurisdiction in the enforcement of the provisions of your subdivision's Protective Covenants. We therefore recommend that you obtain approval from your Homeowner's Association for this fence location. 5. We also recommend that you contact Dig-Line at 342-1585 for location of underground utilities prior to excavation for your fence posts. 6. Please obtain a building permit for your fence from the City of Meridian Building Department prior to beginning construction. Please call for an inspection after the fence construction is completed. 660 E Watertower Lane, Ste 200 Meridian ID R':\fi4? (?osn 510IL""nn r.'~v '''If\O\ 00'7 1 ""..., MAYOR ROBERT D. We object to the variance on the following grounds: 1- The front of the house technically faces Beartooth Street, but the address is CaldelWood, because the City of Meridian Planning and Zoning Committee did not agree with the homeowners and change the zoning of the lot. Therefore, for the purposes of this meeting, the front of the house is on Calderwood and so is their front door. In the subdivision CCRs, Section 4.1. 7, it states that "no fence shall be constructed so as to extend toward the front of the Building Lot past the front plane of the dwelling structure." Therefore, the fence cannot come up and around the front of the house. 2- When the owners bought the comer lot, they knew or should have known of the limitations that the lot had. We knew when we bought the house next to the corner lot and don't feel it is fair to change the rules once we have already constructed our house to have that open view of the comer and road. We knew the fence could only come up 20' from the sidewalk and so should the owners. Sincerely, Kevin & Cheri Pearson t@CbO W .
