Based on the above, the architectural control committee has revised the BridgeTower # 1 fence guidelines to allow vinyl fencing on the interior fence lines that match the current color and style now being installed in the BridgeTower Crossing phases. May 27, 2003 BridgeTower #1 (Autumn Run) Fencing Guidelines Review Committee Recommendation As the appointed representatives of a special sub-conunittee to the architectural control committee. commissioned to make recommendations arid prop<l8e changes to the "Fence Guidelines" for BridgeTower Subdivision No.1, Kelly Mattson and Bob Earl submit the follovving: An attempt was made during the last couple of months to contact as many as possible of the current homeowners of BridgeTower Subdivision No. 1 (Autumn Run), All households received a notice in the April community new-sletter with an attached. questionnaire regarding this matter. In addition an attempt was made personally by the committee members to contact as many as possible of the households, either by phone or in person. The issue presented was "Are you in favor of revising the "Fence Guidelines" to aU ow the option of vinyl fencing?", The approved vinyl fence would match the interior style now being used in the new phases QfBridgeTower. Of the 5410ts in phase No, 1, one Lot is vacant. Of the 53 households, responses were received from 39 of them. The results of our polling indicate that of the 39 responses: · 29 are in favor of allowing an option of either wood or vinyl · 8 are against the option o 2 abstained Based on the above results showing that greater than a Ipajority of the residents are in favor of alloVling an option, this sub-committee recommends that the "Fencing Guidelines" for BridgeTower No.1 (Autumn Run) be revised to allow the option of either wood or vinyl fencing. A timely decision on this matter wQuld be greatly appreciated as a number of the households contacted indicated they are holding off on installing a fence pending the results of this request. (Note requirement for subdivision perimeter fencing in the CC&R's) OPTION TWO: The only approved style of vinyl fence is 4' solid T & G 6" boards with 2' lattice on top, total 6' high. Color to match Butte Fence Montery Sand. (Le. must match current fencing being instaUed on the interior of BridgeTower Crossing phases). No other style or color shall be allowed. NOTES: 1. Coachman Ave. Meridian, Idaho 83642 Re: Fence Waiver Application Dear Ms. Close: This letter is in response to your fence waiver application for the property located at 3425 N. Coachman Ave., Meridian, Idaho. In your application you asked to be allowed to reduce the setback :from 20-feet to II-feet along Primeland Drive. We received comments in opposition of the proposed fence waiver'from surrounding property owners, whom were notified in accordance with the City's Zoning and Development Ordinances. A hearing was held on April 29, 2004 at which time the request and objections were considered. It was determined that the waiver request would be allowed with one modification. Where the rear of the fence meets the back property line, it shall be constructed at a 45-degree angle back toward the existing neighbor's fence per the attached diagram to provide a smoother transition between fence lines. The City has approved your Fence Waiver with this change. The approved setback for the fence location will be a minimum of ll-feet from the property line on Primeland Drive, starting near the back edge of the house. This approval is subject to the conditions noted below. Section II-I- II of the Meridian City Code allows any aggrieved person to appeal this decision. All appeals shall be filed with the Planning and Zoning Department within fifteen (15) days after the date of this letter. 1. The face of the fence shall be set a minimum of II-feet from the property line along Primeland Drive, 2. You must landscape and maintain the ground area between the fence and sidewalk. You must obtain a building permit for your fence from the City of Meridian Building Department prior to construction. You must also call for an inspection of the fence once you have completed construction. The City of Meridian has no jurisdiction in the enforcement of the provisions of your subdivision's protective covenants. We recommend that you obtain approval from your homeowner's association for this fence location. We also recommend that you contact Dig-Line at 342-1585 to locate any underground utilities prior to digging or excavating for your fence posts. Watertower Ln. #202 Meridian, ill 83642 Re: Fence Waiver for 3425 North Coachman Avenue (Lot 1, Block 5 of Bridget ower) Dear Anna: This letter is in response to the "Notice of Application for Fence Waiver" that we received last week. We are very concerned about the appearance ofthe completed fence should this waiver application be approved. Currently, the Scott family that occupy Lot 2, which is back-to-back to 3425 North Coachman Avenue or Lot 1, have erected a wooden fence around it's backyard that follows the city ordinance required distance of20 feet away from the street. If the fence waiver for 3425 N. Coachman is approved, such variation from the city ordinance would create a very odd shaped view that would be directly in front of our home. In addition, the owner at 3425 N. Coachman intends to put up a vinyl fence back-to-back to the current erected wooden fence on the Scott's property, which is something we also intend to object with our homeowner's association. The main reason for our opposition to this waiver application is that we feel this potentially odd-shaped fence design could devalue our property in the future. Also, we feel that the owners are requesting this waiver because constructing a fence following the city ordinance of 20 feet would not be possible on their lot. Earlier last year, they had cement borders put around their planting areas which crosses the 20 foot line from the street area making any construction of a fence on that 20-foot line very difficult (and probably odd-looking if completed) because ofthose cement borders. We feel that these cement borders should have been put in after the construction of their fence. Lastly, we understand another waiver application was filed last year for Lot 6, Block 5 of Bridgetower Subdivision #1. Although that waiver application was approved, many people did not object to the application because the fence was completed before the application was filed. Many residents in Bridgetower we spoke with didn't feel their objections would be heard since the fence was already completed. However, we feel that the makeup of Lot 6 is much different that the makeup of Lot 1 and Lot 2. Lot 6 did not have another lot facing its' back, as is the case with Lot 1 and Lot 2. Also, as noted before, Lot 2 has already erected a fence at 20 feet. We wouldn't be objecting to this application ifboth fences were erected at the same distance, whether at 20 feet or 11 feet. The one thing that drew our interest to this subdivision was consistency and that consistency needs to remain intact. Thank you for your consideration of our comments.
