ALTERNATIVE COMPLIANCE

Recently an Alternative Compliance was submitted for the Noodles to be located at
3103 W. Milano Drive. This request derived from updated plans received by the
planning department regarding the adjacent tenant and their approved layouts. With the
obtained information we realized that our initial layout conflicted and subsequently
confined to a more narrow workable area. A revision to the locations footprint as well as
adjustment to the pick up window was implemented. The pick up window is now to be
located on the south side of the building. The pick up window location was modified due
to its nature and intent. It is to be noted that the standard Noodles pick up window
differs from traditional order pick up windows as it only consists of pre-made orders by
the following methods:
• Online
• Noodles App
• Phone in
The Noodles pick up window also does not contain a physical menu board, again as
most traditional order pick up windows do, which would cause pause in drive through
flow along the path.

With the pick up window allocated on the south end of the building, the drive aisle
leading to the pick up window now has adequate space to accommodate any potential
stacking that may possibly ensue without impeding into the common area shared by
both Noodles and the Dentist facility located North on plan. Additionally, with the
updated pick up window location the escape lane would occur at the Southwest corner
juncture and not affect the Ten Mile road walkway and greenery nor the Bank to the
south.
As a result of the narrower space limitation due to approved plans for the south
adjacent tenants and in effort to make our layout work and retain the pick up window
aspect of our design. We are requesting a variance in the following area:
• With regards to the landscaping separation with the Bank. We are requesting
approval on an additional 2'-0" of landscaping on the Noodles side of the
property line. This would result in our drive aisle being a total of 25' on the south
end and the landscape separation to be a total of 10'-0"(with 8'-0" on the banks
end)
• As a result of reduced landscaping separation, greenery will be allocated
according on the other end of the layout to compensate for the loss
Provided along with this Narrative are revised civil plans, landscaping plans, site plans
and elevations that reflect the footprint change as well as the proposed drive aisle and
landscaping adjustment.
