"...The existing curb cut on Franklin Road is to be used as emergency access only and is
required to include an emergency access gate as depicted on the site plan approved with CZC
A-2022-0116...."
Reasons for Appeal:
• Undue Burden. Placing an "emergency access" limitation on the site's primary access
point will place an undue burden on the applicant.
• Fire Marshal Recommends Full Access. As Fire Marshal Joe Bongiorno suggested,
Applicant's project is over 124,000 square feet and will require secondary access to accommodate
the community. According to Mr. Bongiorno, "the full access off Franklin should stay in place."
• Health and Safety. Permitting full access, as requested, will not impair public health and
safety along Franklin Road. The access is needed to promote safe traffic circulation on
this large property.
• Applicant Did Not Create the Burden. The hardship caused by the elimination of an
existing access point was not caused by Applicant. Applicant expected to have full
access when it acquired the property and created development plans.
• Investment Backed Expectations. This property contained a curb cut on Franklin Road
at the time of purchase. Applicant had the reasonable expectation that the curb cut
would provide full access to the site. Applicant bought the property with the expectation

that it would have one shared access and one full access. By eliminating an existing
access point, the City would substantially limit Applicant's options for the property.
• Selective Enforcement. Heading east from the property on Franklin Road, it is clear that
dozens of properties contain multiple access points to service their business. By limiting
applicant to one shared access point at the perimeter of the property the City is
selectively singling out applicant for reduced access.
For the reasons above, we respectfully ask to remove the emergency access restriction
placed on the property's existing curb cut.
