Lochmeadow SL Dear Kyle: The Fence Variance Committee of the City of Meridian met at 4:30 P.M., October 13, 1998, in City Hall to consider this request. After due consideration, the Committee decided to allow this variance request to construct a six (6) foot tall wooden fence in your side street setback area subject to the following: 1. The face of the fence shall be set a minimum of 10 feet from the yard-side edge of sidewalk along N. Lochness Way beginning at your southwest property corner. The fence shall parallel the yard edge of the sidewalk and shall return to your house at its southwest corner. 2. The ground area between the fence and sidewalk shall be landscaped and maintained by you. 3. The ooard side of the fence shall face out toward the street(s). 4. The City of Meridian has no jurisdiction in the enforcement of the provisions of your subdivision's Protective Covenants. We understand that you have obtained approval from your homeowner's association for this fence location. 5. We recommend that you contact Dig-Line at 342-1585for location of underground utilities prior to excavation for your fence posts. 6. Please obtain a building permit for this fence from the City of Meridian Building Department. Please call for an inspection after this length of fence construction is complete. Meridian, 10 83642 Description of requirements of the ordinance that needs to be reduced to permit the proposed fence: Meridian requires that a fence on a corner Jot be no closer than 20 feet from the sidewalk. I am requesting that the 20 feet be reduced to 10 feet on our lot facing North Lochness Street. Note: Our neighbors across North Lochness Street (West of our location), have previously filed for a variance to move their fence facing North Lochness Street to 10 feet from the sidewalk and were approved. Meridian, ID 83642 Statement that fence is allowed under the restricted covenants of the subdivision: I called AMI (Associated Management, Inc.) on September 14, 1998 and talk with Dick Miller. (Chateau Meadows Homeowners Association uses AMI to support the subdivision restrictive covenants, as well as other responsibilities.) I advised Mr. Miller of my intentions to move our fence, located on the West side of our lot, facing North Lochness Street, to within 10 feet of the sidewalk. Mr. Miller advised me at that time that there was no need to bring this before the Architectural Committee and that it was perfectly fine for us to move the fence as long as Meridian City approves the variance.
