The Fence Variance Committee of the City of Meridian met in your presence at
4:15 p.m., June 9, 1997, in City Hall to consider this request.
After due consideration, the Committee decided to allow the six (6) foot tall fence
constructed in the side street setback area to remain as built along with the transition
fence built out to the sidewalk.
The City of Meridian has no jurisdiction in the enforcement of the proVISIOns of your
Subdivisions Protective Covenants. Since this is a variance to a provision of your
Covenants, we suggest you also contact you Homeowners Association.
Please obtain a fence building permit from City Hall.
Thank you for complying with the City ordinance in requesting this vanance.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to 11-9-605 J. 10. of the Revised and
Compiled Ordinances of the City of Meridian, that the Fence Variance Committee of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 4:15 o'clock ....E....M., on Monday, June 9. 1997, for the
purpose of reviewing and considering the Application of Allen Krueqer for a variance
from the Meridian Fence Ordinance at the property legally described as follows: Lot 9.
Block 3 Chamberlain Estates and known by the address 1769 E. Couqar Creek.
Meridian. Idaho 83642. The Applicant proposed to reduce the required setback distance
from 20 feet to 15 feet.
The public is welcome. Testimony, objections, and comments will be heard and
considered by the Committee.
A written decision of the Committee will be issued to the Applicant and any person
requesting in writing a copy of the decision will be furnished one.
Any aggrieved party may appeal the decision of the Committee directly to the
Meridian City Council pursuant to Section 11-2-416 G. 1.

gravel or asphalt.
4.3.9 Colors. Exterior colors of earth tones or
light blues or greys shall be encouraged for the body of
the house. Bright, bold or very dark body colors shall
be discouraged. Dark roof colors shall be encouraged.
Approval of exterior colors must be o?tained from the
Board, and any changes to colors or exterior in the
future must be approved by the Board.
4.3.10 Pole Liqhts. Each home shall have a photo-
sensi~ive pole light installed in the fro~t yard within
five (5) feet of the sidewalk and five (5) feet of ~he
driveway, with a ~inimum bulb power of 40 watts, designed
to switch on auto~atically at sunset and off at sunrise.
Installation is the specific responsibility of the Owner.
4.3.2.1 Landscaoina. Landscaping of front yard shall
be conpleted within thirty (30) days of substantial
com~letion of hone. For purposes here the "front yard"
shall be defined as that portion of the Building Let from
one side lot line to the opposite side lot line lying in
front of the front wall of the structure. For Building
Lots on corners the ltfront yardll for purposes here shall
also include that portion of the Building Lot from the
front of the structure to the rear of the structure to
the side street (i.e., the side yard next to the side
street). Landscaping shall include sod in the front yard
a.nd -:.....'0 ".:rees of at least 211 caliper. Berms aJ1d
sculptured planting areas are encouraged. Grass shall be
planted in the back yard within one year of uccupancy.
In the event of undue hardship due to 'i...eather condition:;;',
this provision nay be extended for a rea.sonable length of

4.3.12 Fences.
a) su::'division pe:::-ii71eter Fences. Grantor shall construct
a perimeter fence around the exterior of ~his subdivision
proper-:.y. After Grantor has transferred title to any 3.ot
which contains a portion of this perimeter fence it shall
be the responsi~ility of the owner of the lot to
maintain, repair and/or replace as needed that portion of
the perimeter fence located on that owner's lot. Said
main:.enance, repairs and/ or replace::J.ent shall be
performed so as to keep the perimeter :encing uniforrnr
attractive and ha.r~onious.

b) Other Owner rences. Other fences by Lot Owners are
not required. If a fence is desire'., plans for it shall
be approved by the Board prior to construction. ?ences
shall be of good quality and workmanship and shall be
properly finished and maintained. Fences may be built of
wood, such as a 6-foot, dog-eared cedar. Chain link
fences are not allowed except along ditches o~ retention
pond areas. Fences shall not be built closer to the
front of the lot than even with the front corner cf the
house, nor within 20 feet of any street rights of way.
c) Retention Pond Fence. The fence around the retention
pond/drainage basin contained in that common area lot
(Lot 13, Block 1) shall be maintained by the Association.
4.3.13 Construction Time. Once construction has
begun, cowpletion of each building or other improve~ent
shall be diligently pu:::-sued and comp'leted within 12
months.
4.3.14 Construction on Premises. No pre-existing
dwelling or pre-fabricated dwelling shall be moved onto
any :.ot. All dwellings in this Subdivision tlust be
constructed on the lot.
4.3.15 Sewer Locations, HOOk-ups. All bathroom,
sink and toilet facilities shall be located inside th~
dwelling, and connected by underground pipe to lot line
sewer. All connection and sewer charges are the
responsibility of the owner of each lot at the time of
connection.
4.3.16 Antennae. No exterior radio antenna,
television antennu, satellite dish antenna or other
antenna of any type shall be erected or maintained on the
Property unless it is located or screened in a ~anner
acceptable to the Board.
4.3.17 No Further Subdivision. No Building Lot may
be further subdivided, nor nay any easement or other
interes~ therein less than ~he whole be conveyed by the
Owner ~hereof vlithout the prior written approval of the
Boardi Frcvided, however, ~hat nothing in this section
shall be dee~ed to prevent an Owner from, or require the
approval of the Board for, transferring or selling any
Building Lot to more than one person to be held by them
as tenan~s-in-comrr.on, joint tenants, tenants by the
entirety or as cor.~unity property.
