Idaho Transportation Department (ITD) appreciates this opportunity to provide comments regarding Artisan Victory
Market located at 2820 S Eagle Road, 2910 S Eagle Road, 2960 S Eagle Road, 2990 S Eagle Road, and 3020 S Eagle Road,
Meridian, Idaho. The application is to request annexation and zoning of approximately 14.47 acres, a preliminary plat
of four building lots and one common lot, and a conditional use permit for a total of 138 units.
1. This project abuts State Highway 55 (SH-55).
2. Traffic generation numbers were not provided with this application. Based on the size and location of this
proposed subdivision including its proximity to SH-55 (Eagle Road), ITD is requesting that the applicant provide
a Traffic Impact Study (TIS) reflecting full build -out of the development. ITD needs more information on the
trip generations to determine what mitigations, if any, that the applicant may be required to construct on the
State Highway system. Any necessary mitigation for traffic impacts identified by the Traffic Impact Study shall
be the responsibility of the applicant to install. ITD reserves the right to make further comments upon review
of any submitted traffic generation data or other documents.
3. An Approach Permit Application and fee shall be submitted with the TIS before the TIS will be placed in the
queue for review.
4. Per the Idaho Administrative Procedures Act (IDAPA) 39.03.42 (8a.): "Improvements intended to serve patrons
on private property adjacent to state highway right-of-way shall be setback from the highway right-of-way line
so that stopping, standing, parking, or maneuvering of vehicles on the Right -of -Way is not necessary. A
minimum setback of fourteen (14) feet from the State Highway Right -of -Way line is recommended unless a
greater minimum is established by an engineering study. When an ordinance requires a certain number of
parking spaces per square footage of the building, the parking spaces shall not be included within the State
Highway right-of-way."
5. Any addition, modification, change use, relocation, maintaining, or removal of an encroachment of the state
highway or use of highway right-of-way for any purpose other than normal travel, shall obtain an
Encroachment Permit to use state right-of-way.
6. IDAPA 39.03,42.600.04 rules govern landscaping within ITD right-of-way. No trees will be allowed within 4 feet
of the face of the curb at full growth. Irrigation systems shall be no closer than 5 feet from the pavement edge
and shall be adjusted so as not to cause water to cover any portion of the highway pavement.
7. Idaho Code 404910 does not allow advertising within the right-of-way of any State highway.
