We are requesting the minimum lot size for 44 of the 81 lots be reduced from 2,000 square feet to 1,694 square feet. ' ��■� W. Achievement St. ' __It ai r � 1 '� � '► see c t AL �-- Ustick Rd. A Site Location and Existing Uses The subject property is part of a current development application for annexation into Meridian City and a preliminary plat. This portion of the property is approximately 10.51 acres in size and is located at the northwest corner of Ustick Road and McDermott Road. The property is not improved with any buildings and is currently being farmed with a corn crop. Justification Section 11-5B-4.E of the Unified Development Code states the required findings to grant a variance are: 1) The variance relieves an undue hardship because of characteristics of the site. 2) The variance shall not be detrimental to the public (Awl health, safety, and welfare. I The exhibit on the right illustrates the characteristics of — the site that create the undue hardship. 1. The Highway-16 right-of-way cuts through the 5 property at an angle. The alignment of the highway is fixed and was determined by ITD. The alignment creates a remnant parcel that is an unusual shape .---- ---- ------ -- .-- for development. In addition, it severely restricts how the property can be developed. 2. The Sky Pilot Drain traverses through the middle of the property. The drain has a 100-foot-wide - easement where no structures can be located. This greatly reduces the amount of developable space _ on the property. 3. Ustick Road as it abuts the property will be widened _ to accommodate the Highway-16 interchange at this location. This reduces the amount of developable space for the property. , 44. McDermott Road will be terminated with a cul- de-sac eliminating access from Ustick Road. In addition, this reduces the viable uses for the property. 1 5. McDermott Road is in a fixed location and must be widened to meet ACHD standards. This further reduces the amount of developable space for the _ property. IL IL I-L IL 6. A landscape buffer must be provided along the northern property boundary to provide a buffer to the light industrial use proposed on the abutting property. This also reduces the developable space for the property. Reducing the minimum lot size of the proposed townhome lots from 2,000 square feet to 1,694 square feet is not detrimental to the public health, safety, or welfare. Access will be provided by either public streets or private drive aisles that meet all ACHD standards. Adequate open space is provided within the development, and no concerns regarding the size of the units has been provided by the neighboring property owners. Conclusion As previously noted, the proposed variance relieves an undue hardship due to the characteristics of the site and will not be detrimental to the public health, safety, or welfare. We respectfully request the variance be approved.
