Re: Development Agreement Modification for Brightstar Residential Living

Dear Planning Staff,
The owner of the property located at 2940 E. Overland Rd is proposing the new construction of an
approximately 5,600 s.f. single story residential care facility. The purpose of this request is to modify the language to
allow the residential care facility use in the Dorado Sub (AZ-05-019).
The applicant asks that the following clarification be made to the original Development Agreement,
Instrument # 105127512, recorded on September 2, 2005:
5. CONDITIONS GOVERNING DEVELOPMENT OF SUBJECT PROPERTY:
5.1. Owner/Developer" shall develop the "Property" in accordance with the following
special conditions:
6. Allowed uses are restaurant, retail, hotel, banks, office, and residential care facilities.
