I could not accept the CZC landscape plan from 1996 for CESCO. When overland road was widened it created a
problem and they took out all the landscaped trees at the frontage and changed the overall lot lines and make up.
John is proposing to replace all the trees on that frontage and I recommended he file for alternative compliance
on the gravel pad/areas which were the original approval. The UDC (UDC 11-313-2D.2 does not require the
internal areas to comply with current landscape standards but Display areas are not allowed in Right of Way
buffers as the addition is approximately 35% of the original approval. From what I can determine the landcaping
is approximately 17-24 feet to the display area as it varies along the frontage. This is from back of sidewalk as
measured on the 2005 aerial photos (not seriously accurate). I think that if Cesco replaces the trees, and files for
Alt compliance we should be able to issue the CZC for the addition to the building. Any further thoughts?

Joe,
Per our conversation reguarding the Cesco project and the Certificate of Zoning Compliance. When this project
was originally constructed, prior to Overland Road being widened, the application complied with the cities
standards for new construction. When Overland road widened, the right-of-way was expanded and now as we
are proposing and addition the project does not comply with the adopted UDC. We are requestuing/submitting an
Alternative Compliance Application to request that the existing landscaping and display area along Overlan
remain as it is today. When Overland was widened they removed (14) trees that had been planted. We are
proposing to replant those (14) trees to help in beutifying the Overland cooridor. The gravel that is in the display
area that was originally 40* feet from the right-of-way is for display of the products the Client sells. The gravel not
only serves a practical purpose but is good for the environment as it reduces the amount of impervious surface on
site, reduces heat gain, an reduces the amount of storm water run off on site. Again we are requesting alternative
compliance.

Conditions of Approval: Project is subject to all current City of Meridian ordinances and the issuance of this
permit does not release the applicant from any previous requirements of the other permits issued for this site.
Site Plan: The Site Plan prepared by Hansen -Rice Architects on January 5, 2006, labeled A0.0, is approved
(stamped "Approved" on April 28, 2006 by the Meridian Planning Department) with no changes. The
approved site plan is not to be altered without prior written approval of the Planning Department.
Landscape Plan: The Landscape Plan prepared by Hansen -Rice Architects on April 25, 2006, labeled L1.00,
was approved with prior CUP/CZC approval in 1996. See the CZC Exemption for landscaping. Only
Perimeter and Right of Way Landscaping are required. The applicant has applied for alternative compliance
for the I-84 corridor. The director has granted alternative compliance as the landscape plan is showing
approximately 100' of landscaped areas with additional plantings on the slope facing I-84, the required trees
were placed in 1996 and limited irrigation is available. The approved landscape plan is not to be altered
without prior written approval of the Planning Department.
PRIOR APPROVAL: 11 -3B -2D applies to the site as the request is for an addition to an existing structure.
The existing structure is 28,341 square feet the addition requested is 90x112 three bay shops, this shop would
be 10,080 square feet. The addition is 35.5% of the existing structure and UDC 11 -3B -2D2 requires perimeter
and right of way landscaping as required by Chapter 3 Article B. The landscape plan dated June 11, 1996
provides 40' of landscaping to Overland Road. The required landscaping is 25' to an arterial road. Perimeter
landscaping will be within the parking aisles and to the extent of the building. The applicant is showing a 12'
landscape buffer with trees every 35' to the east and nine pine trees with a graveled area to the west as
approved in 1996
Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the
approved specifications and in accordance with UDC 11-3A-15.
Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with
the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the
Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the
existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC I I -
3B -10-C.5.
Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-3B. Project
engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to the
Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA
and signed "Van Accessible".
Curbing: Per UDC 11 -3B -5I, all landscape areas adjacent to driveways, parking lots, or other vehicle use
areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing maybe cutto
allow for storm water runoff.
Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed
prior to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and
shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18.
Fencing: Any required or proposed fencing shall be installed with current fencing standards as defined in
UDC 11-3A-7.
Lighting: Lighting shall not cause glare or impact the traveling public or neighboring development and
comply with lighting standards as defined in UDC 11-3A-11.
Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in
compliance with UDC 11-3D.
Trash Enclosure: All dumpster(s) must be screened in accordance with UDC -11-3A-12. Trash enclosures
must be built in the location and to the size approved by SSC. NOTE: Because the dumpster for this lot is
located off-site (to the north), said dumpster shall be sited prior to occupancy of the subject building.
Handicap -Accessibility: The structure, site improvements and parking areas must be in compliance with all
federal handicap -accessibility requirements.
ACED Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any
changes must be made to the site plan to accommodate the ACRD requirements, a new site plan shall be
submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of
Occupancy. A written certificate of completion shall be prepared by the landscape architect, landscape designer
or qualified nurseryman responsible for the landscape plan upon completion of the landscape installation. The
Certificate of Completion shall verify that all landscape improvements, including plant materials and sprinkler
installation, are in substantial compliance with the approved landscape plan. A Temporary Certificate of
Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the
amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary
Occupancy.
Plan Modifications: Except for the changes mentioned above, the approved Site and Landscape Plan stamped
"Approved" on April 28, 2006, and are not to be altered without prior written approval of the Planning
Department. No significant field changes to the site or landscape plans are permitted; prior written approval of
all changes is required.
