Utility Easement Vacation Description
An easement to be vacated over and across a portion of Lots 8 and 9 of Heppers Acre Subdivision as
recorded in Book 19 of Plats at Pages 1298 and 1299, Records of Ada County, said parcel is located in
the Southwest Quarter of the Southwest Quarter of Section 12,Township 3 North, Range 1 West of the
Boise Meridian, Ada County, Idaho, being more particularly described as follows:
Commencing at the found 4 inch aluminum cap monument at the corner common to Sections 11, 12,
13 and 14,T3N, R1W from which the found 3 inch brass cap monument in asphalt at the quarter
corner common to Sections 11 and 12,T3N, R1W bears N 000 32' 39" E a distance of 2645.87 feet;
thence N 00' 32' 39" E along the section line for a distance of 447.74 feet;thence N 88` 31' 38" E for a
distance of 324.52 feet to the REAL POINT OF BEGINNING;
Thence N 00'46' 31" E for a distance of 192.61 feet;
Thence N 89'41' 22" W along the line common to Lots 8 and 9 for a distance of 30.01 feet to a found
5/8th inch iron pin with a cap stamped PLS 11463 at the northeast corner of Lot 8;
Thence S 00'46' 31" W for a distance of 192.00 feet to a found 5/8th inch iron pin with a cap stamped
PLS 11463 at the southeast corner of Lot 9;
Thence S 880 31' 38" E along the line common to Lots 9 and 10 for a distance of 30.02 feet to the REAL
POINT OF BEGINNING.

Hepper Acre Subdivision, Ada County, Idaho
Dear Ronald:
This is in response to the relinquishment application received by Idaho Power Company on
January 15, 2021, regarding the possible partial relinquishment of PUE located in the above
noted subdivision. The attached Exhibit A more specifically identifies the "easement area"
requested for relinquishment highlighted in red.
Idaho Power's review of the relinquishment application indicated that there are no facilities
within the above noted easement area. As such, Idaho Power agrees to relinquish interest in the
easement area as shown on the attached map.
Thank you once again for providing Idaho Power Company the opportunity to review and
comment upon the subject petition for relinquishment.

Partial Release of Easement
WHEREAS, by subdivision plat recorded in Plat Book 20, at Pages 1298 and 1299 on July 16, 1965, as
Instrument Numbefl/6 16425, in the records of Ada County, State of Idaho, Heppers Acre Subdivision, granted
to IDAHO POWER COMPANY an easement(the "Easement") for the construction,operation and maintenance
of certain power line facilities upon the following premises located in Ada County, State of Idaho, to-wit:
Heppers Acre Subdivision —A portion Section 12, Township 3 North, Range I West, B.M., Ada County,
Idaho.
AND, WHEREAS, it is no longer necessary or desirable that a certain portion of the Easement be
retained.
NOW, THEREFORE, in consideration of the premises, IDAHO POWER COMPANY does hereby
release and abandon that certain portion of the Easement over the following described lands:
The 30 ft public utility easement of the east side of Lot 9, Heppers Acre Subdivision.
ALL RIGHTS and privileges under the above-described document in and to the remaining lands
covered by the Easement and any and all prescriptive or other rights the Grantee has acquired through
occupancy and use over time of said remaining lands shall remain and continue in the Grantee and shall not be
affected in any way hereby.
IN WITNESS WHEREOF, IDAHO POWER COMPANY has caused these presents to be executed by
its proper officers thereunto duly authorized this day of March, 2007.
