Dear Ms. Kozlowski:
This letter is in response to your request for City Council review of the Planning& Zoning
Commission's decision in the matter pertaining to your request for a reduction in the buffer
width from 25 to 15 feet with no landscaping other than grass within the buffer to the residential
use along the northern boundary of the site (H-2022-0007). This letter is to confirm that the City
Council upheld the Commission's decision pertaining to the buffer and denied the subject
application.
The property owner has the right to request a regulatory taking analysis under Idaho Code 67-
8003. Such request must be in writing, and must be filed with the City Clerk not more than
twenty-eight(28) days after the final decision concerning the matter at issue. A request for a
regulatory takings analysis will toll the time period within which a Petition for Judicial Review
may be filed.
