1. This development recognizes Idaho Code, Title 22, Chapter 45 Right to Farm, Section 22-4503, which states "no
agricultural operation or an appurtenance to it shall be or become a nuisance, private or public, by any changed
conditions in or about the surrounding nonagricultural activities after the same has been in operation for more than
one (1) year, when the operation was not a nuisance at the time the operation began; provided, that the provisions
of this section shall not apply whenever nuisance results from the improper or negligent operation of any agricultural
operation or appurtenance to it."
2. Any resubdivision of this plat shall comply with the applicable zoning regulations in effect at the time of resubdivision.
3. Minimum building setback lines shall be in accordance with the zoning ordinance at the time of issuance of any
building permit. All lot, parcel and tract sizes shall meet dimensional standards established in the zoning ordinance.
4. All lot lines common to the subdivision boundary line and public right-of-way, the rear lot lines of Lots 13, 14, 15, &
16 of Block 1, and Lots 3, 5, & 6 of Block 2 have a ten (10) foot wide property drainage, irrigation and public utility
easement. The easements are as shown on this plat.
5. Lots 1, 7, 9, 10, 19, Block 1 and Lot 4, Block 2 are all common lots and are subject to a blanket drainage, irrigation,
and public utility easement. Lot 8, Block 1, is a common lot and is to serve as a 25' wide landscape buffer. Lot 4,
Block 2, is a common lot and is subject to a blanket ingress/egress easement in favor of Lots 2, 3, and 5, Block 2.
Lots 1 and 6, Block 2 will take access from N. Sepino Ave.
6. Lot 10, Block 4, is a common lot and is subject to a blanket drainage, irrigation, and public utility easement. This Lot
is servant to and contains the ACHD storm drainage system. The easement and the storm water drainage system is
dedicated to ACHD pursuant to Section 40-2302 Idaho Code. The easement is for the operation and maintenance of
the storm water drainage system.
7. Irrigation has been provided to this subdivision in accordance with Idaho Code 31-3805(1)(B). This Subdivision is
situated in Settler's Irrigation district. Irrigation water will be delivered to each lot by said district. Each lot owner shall
be responsible to pay irrigation assessments to said district.
8. Maintenance of any irrigation or irrigation drainage pipe or ditch crossing a lot is the responsibility of the lot owner
unless such responsibility is assumed by an irrigation/drainage district.
9. Direct lot access to W. Daphne St. and N. Black Cat Rd. is prohibited unless specifically allowed by the Ada county
Highway District and City of Meridian.
10. This subdivision is subject to an ACHD Sidwalk Easement per Instrument No.
11. Lot 7, Block 1 is subject to an existing Septic Tank Drain Field Easement per Instrument No. 2021-040578.
12. This subdivision is subject to a City of Meridian Development Agreement recorded as Instrument No. 110015780.
13. The bottom elevation of all structural footings shall be set a minimum of 12 inches above the highest established
normal ground water elevation.
14. This subdivision is subject the Declaration of Covenants, Conditions, and Restrictions for Pero Place Subdivision
homeowner's association, to be recorded at a later time and may be amended from time to time.
15. Lot 9, Block 1, is a common lot and is subject to future right-of-way dedication to ACHD.

review by a Qualified Licensed Professional Engineer (QLPE) representing City of Meridian Public Works,
and the QLPE approval of the design plans and specifications and the conditions imposed on the
