Lake Hazel Road, Meridian, Idaho Dear Mr. Dodson: We are pleased to submit the above referenced applications for the proposed Development Agreement (DA) Modification on behalf of our client, LH Development, LLC. The intent of this letter is to meet the requirements of the Narrative to be submitted with the subject application. The following is the requested information pertaining to the Development Agreement Modification request: Original Project Name: Lavender Heights Subdivision Annexation/Rezone/Preliminary Plat file number: H-2020-0090 Date of City Council Approval of DA: May 12, 2020 Recordation date of DA & Instrument Number: August 18, 2020, Instrument Number 2020-106343 The reason for the requested DA Modification is to modify the housing product type on Phase 4 of the Lavender Heights development from a multi -family product to a townhome development. The developer prefers the flexibility provided by townhomes which can still be offered as rental units but can also be sold as individual residences. The proposed number of units will be slightly reduced so we are requesting a change to the minimum number of units allowed. The proposed DA modifications will only impact Phase 4 of the development. The following are the proposed changes to the DA: Section 5.1.a. Future development of this site shall be generally consistent with the preliminary plat, landscape plan and conceptual building elevations for the single-family dwellings included in Section VII and the provisions contained herein except as follows: The Phase 4 multi -family concept plan shall be replaced with the Phase 4 Townhome concept incorporated into this modified Development Agreement. Section 5.1.b. The 10- foot multi- use pathway shall be constructed with Phase 1 of the development, except for that area located in the proposed future w,..' 1y Townhome development along the southern edge of the Farr Lateral, shown as Phase 4. Section 5.1.e. No more than 54 and no less than 3-9 30 units shall be allowed on the R-40 zoned property. Detailed Conditional Use Permit approval is required prior to any development on the R-40 zoned area. Narrative Letter -Lavender Heights Development Agreement Modification Section 5.1.f. With the sale of all future homes in the Lavender Heights Subdivision, all sales information shall have language regarding the future P+u4i4GP44V townhome project that will be a part of this development. The proposed changes to the existing DA for the Lavender Heights Subdivision will still support the orderly development of the City of Meridian in a manner consistent with the Meridian Comprehensive Plan.
