Dear committee members,
My wife and I are native to Meridian and have cherished our little home on the corner of East 3rd and
Carlton. We want to retain the integrity of this 1930's home but also need more space for our growing
family.We have decided that the best course of action is to split our double lot and build a larger home
for our family on the newly cleaved lot.
We would like to split the lot on 1028 E. 3rd Street in Meridian Idaho. The lot is currently two original lot
sizes and ten feet of the lot directly to the East. We would like to create a north and south lot out of the
property.The current home, shed,trees and parking structure will be retained on the north lot.The
south lot will become the building site of our future home. The current measurements of the property
are 115'x110.'The proposal is to split it into a north lot that is 70'x110' and a south lot that 45'x110'.
Statement of Conformance: We hereby agree to conform to the UDC and all acceptable engineering,
architectural and surveying practices and local standards. However, we have asked for alternative
compliance on two items from the pre-application meeting notes.The two items are listed below.
1. The pre-application notes state, "... they will be required to provide a 6'detached walkway and
landscape buffer along E. 3rd. UDC 11-2A-7 requires a 20'landscape buffer along collector
streets. The walkway and landscaping can be within this buffer."
a. However, in order to protect the very large Maple tree on the 3rd St. side of the lot(see
Arborist letter),we request this alternate compliance: that the detached 6'walkway be
alternately routed (see plans). No curb or gutter will be installed at this time (as per
Alan and Bill).The
b. We also request alternate compliance on the width of the landscape buffer (see plans).
In compliance with the ACHD plan for this collector street,the site of the 6' sidewalk and
6 feet of the buffer directly adjacent to 3rd St. is already ACHD property.Thus, with
simply a 10 ft easement, more than the intentioned 20ft is achieved.Thus, we have
planned a 10' easement to the city of Meridian on the west side of both the North and
South lots. It is currently represented on the plans as a separate lot to comply with prior
code restraints.As per the recent code changes, please adjust this to by an easement to
the City of Meridian instead of a separate lot.
c. We would also like to request alternate compliance for the number of required trees to
be planted within the landscape buffer (1 tree every 35'), and instead will retain the
large maple tree on the North lot. The canopy of this tree covers most of the available
area on the front of both of these lots as there is a section of powerline and irrigation
system on the southern end of the south lot that would be impeded by the addition of
more trees. In keeping with the conventions of this downtown block of residences, this
buffer(which is currently grass) will be maintained as greenspace by the owner of each
residence and will constitute the front lawns of the current residence (North lot) and
proposed second residence (South lot).
2. The pre-application notes state, "A pressure irrigation system is required. Irrigation must be
provided by surface water first, which sounds like is available to the South lot. City water or well
can be used as a backup source for shoulder season."At present, irrigation collection boxes
already exist on both proposed lots.At present,flood irrigation works well on the area of the
South lot. We request this alternate compliance: please allow us to continue to use flood
irrigation (South lot) and personal pump will be used to provide irrigation to the North lot from
the existing collection box.
Statement about existing structures: All existing structures will be retained with this lot split. All
anticipated construction will take place on the South lot. We expect to build a single family residence on
that lot in the next year.

I am looking at your short plat application submittal.
The Short Plat Checklist (attached) requires a deed,fire department approval and approval of the
subdivision from the Ada County Surveyor's Office. I do not see these items.
In regard to the sidewalk and landscape buffer, I think the Arborist's recommendation against
constructing sidewalk in this particular area definitely supports your argument against this
requirement and I also support preservation of the tree. However, I am not convinced this precludes
sidewalk along the entire length, and at least some type of pathway in the vicinity of the tree . Also, I
am not convinced that providing the required 20' landscape buffer is not feasible. I am not
knowledgeable enough about irrigation systems to know whether the existing system precludes you
from landscaping in that area. I appreciate the argument that there is not sidewalk or landscaping
along the houses in the immediate vicinity. However, this road is planned to be widened to a
collector,there are road templates I provided to you that show how it is to develop, and as
properties begin to redevelop along this area they need to try to address the templates. A
landscaping plan is a requirement of the short plat, and I believe you probably have the ability to do
something within a 20' buffer there. If a landscape architect, nurseryman, irrigation district, etc.
were to say it is not feasible to plant trees or any type of landscaping in this 20' buffer, I may be
amenable to supporting some type of alternative compliance. But without better justification I
cannot support complete waivers of both the sidewalk AND at least some type of a landscape buffer.
At this point, I do not think this is ready to go to hearing. I believe you should work with someone to
come up with some creative solutions and include a landscape plan that tries to meet the
requirements or have a professional attest to why this is not possible.

Regarding: Tree Preservation
Dear:Russ McCrea and whomever else it may concern,
The Critical Root Zone of a large,mature specimen Silver Maple tree(Acer saccharinum)with a DBH
(Diameter at Breast Height)of 60 inches,an approximate height of 68' and 90' spread located at 1028 E
3rd St would be severely,impacted by the damage that would inevitably occur if construction of a
sidewalk in the area were to move forward.
The extent of the damage that would occur to the tree root system would inevitably lead to a rapid state of
decline or even complete,whole failure of the tree.
The additional work that would be associated with removing the tree,combined with the impact the loss
of canopy would have on the property and the character of the neighborhood,would drastically increase
the cost of the sidewalk installation,and make the project impractical,and unreasonable.
Therefore,it is my professional recommendation that in the interest of preserving this tree,and all of the
benefits it provides to the adjacent property and the surrounding neighborhood,no such construction
should occur.
We ask that ACHD waive the requirement to construct sidewalk in this section of the Right of Way at this
address.

I am looking at your short plat application submittal.
The Short Plat Checklist (attached) requires a deed,fire department approval and approval of the
subdivision from the Ada County Surveyor's Office. I do not see these items.
In regard to the sidewalk and landscape buffer, I think the Arborist's recommendation against
constructing sidewalk in this particular area definitely supports your argument against this
requirement and I also support preservation of the tree. However, I am not convinced this precludes
sidewalk along the entire length, and at least some type of pathway in the vicinity of the tree . Also, I
am not convinced that providing the required 20' landscape buffer is not feasible. I am not
knowledgeable enough about irrigation systems to know whether the existing system precludes you
from landscaping in that area. I appreciate the argument that there is not sidewalk or landscaping
along the houses in the immediate vicinity. However, this road is planned to be widened to a
collector,there are road templates I provided to you that show how it is to develop, and as
properties begin to redevelop along this area they need to try to address the templates. A
landscaping plan is a requirement of the short plat, and I believe you probably have the ability to do
something within a 20' buffer there. If a landscape architect, nurseryman, irrigation district, etc.
were to say it is not feasible to plant trees or any type of landscaping in this 20' buffer, I may be
amenable to supporting some type of alternative compliance. But without better justification I
cannot support complete waivers of both the sidewalk AND at least some type of a landscape buffer.
At this point, I do not think this is ready to go to hearing. I believe you should work with someone to
come up with some creative solutions and include a landscape plan that tries to meet the
requirements or have a professional attest to why this is not possible.
