Ballinger Ave., Meridian, Idaho. In your application you asked to be allowed to reduce the setback ITom 20-feet to lO-feet ITom the street side property line along W. Cedar Grove Street. An objection was received ITom a surrounding property owner, whom was notified in accord with the City's Zoning and Development Ordinances. A hearing was held by the Planning Director on July 8, 2005. The Director . determined that the fence should be allowed as proposed but that where the side fence meets the rear fence, it should be constructed at a 450 angle as shown on the attached site plan. The City has approved your Fence Waiver, allowing the fence to be located la-feet ITom the street side property line along W. Cedar Grove Street. This approval is subject toth.econditions noted below. Section 11-1-11 of the Meridian City Code allows any aggrieved person to appeal this decision. All " appeals shall be filed with the Planning and Zoning Department within fifteen (15) days after the date of this letter. 1. The face of the fence shall be set a minimum of la-feet ftom the . property line. 2. You must landscape and maintain the ground area between the fence and sidewalk. . - 3. The board side of the fence shall face out toward the street(s). All exterior materials and colors shall be selected and used which are approved by the ACC and which are compatible with other Buildings on the Lot and on neighboring Lots to the end that all such Buildings will present a unified and coordinated appearance. All exterior finishes and/or colors shall be approved by the ACC and shall be in accordance with the ACC Design Standards. 4.11 Signs. No commercial billboard or advertising shall be displayed to the public view on or from any Lot. Owners may advertise a Dwelling Unit and Lot for rent or for sale by displaying a single, neat, reasonably sized vacancy sign or "For Sale" sign thereon. Signs advertising the name of the builder and the name of the institution providing financing therefor may be displayed on a Lot during construction of the Buildings. Lighted, moving or flashing signs for any purposes are prohibited. Directional signs may be used to give directions to traffic or pedestrians or give special instructions. Any directional or identification sign within the Property shall be permitted, provided the same is approved by the ACC prior to installation. Notwithstanding the foregoing, the ACC shall have the right to adopt ACC Design Standards with respect to signs allowed within the Subject Property, which Ace Design Standards, if adopted, shall regulate signs within the Subject Property and shall control over the specific provisions of this Section. 4.12 Construction Time Frame. All construction work on Dwelling Units shall be diligently and continuously pursued, and shall be completed within nine (9) months from the date construction started. 4.13 Outbuildings. Outbuildings, separate garages, sheds and shelters may be constructed only simultaneously with or after a Dwelling Unit has been constructed on the Owner's Lot. All such buildings shall be constructed only after written approval thereofby the ACe. All outbuildings shall be constructed of similar or compatible exterior materials with the Dwelling Unit so as to be aesthetically compatible therewith. 4.14 Fences. All Lots shall have an enclosed fenced backyard, however, no fence or wall of any kind shall be constructed on a Lot unless the plans and specifications therefore, including the location, design, material and color thereof, have been approved in writing by the ACC prior to the construction or installation. All fences and/or walls constructed on a Lot shall be in compliance with the applicable ordinance of the City of Meridian, Idaho. In addition to the requirements of the ACC Design Standards applicable to fences, all fences and walls shall be subject to the following restrictions: ( a) Fences and walls shall not extend closer to any sidewalk than twenty feet (20') nor project beyond the front setback of the Dwelling Unit. Ballinger Ave. Meridian, Id (Lot 8, Block 20 of Lochs a Falls Subdivision). Our reasons for opposing the proposed waiver of the fence ordinance are as follows: - Drivers traveling on both Ballinger Ave. and Cedar Grove 81. would have a restricted field of view with regard to children playing around the comer, or on the properties adjacent to the Grafproperty. Our property neighboring the 5421 N. Ballinger served as a Kindergarten bus stop during the end of the 2004-2005 school year. A fence extending out beyond the neighboring fence would afford a blind spot where children could dart out from, increasing risk in an area where children congregate - The decrease of the setback intenupts the continuity set forth in the neighborhood covenants. Neighborhood covenants clearly indicate guidelines to help insure continuity and to ensure that all lots in the neighborhood are maintained, well groomed and that property values will increase. ~ We feel that a change in the fencing setbacks would result in a decrease of our property value. Our house was designed and built with the premise that we would maintain neighborhood covenants and use them to add value to our property. A protruding fence would detract from the aesthetics of our property by limiting the view from certain windows and by disrupting the landscape plan that was designed to optimize the large setbacks required by a comer lot. In the event of a futW'e sale, buyers might be dissuaded by a yard that lacks continuity with neighboring yards. , We appreciate your consideration of our opposition to the setback waiver. The safety of our clùldren, the potential loss of property value, and the conflict with established covenants prevent us from supporting the Grafs desire to extend their fence.
