Alan and Caleb, th This is a follow-up to my email from January 12. th The public hearing for the Skybreak Subdivision No. 1 final plat is scheduled for April 5. We bring this to your attention because the current plat does not comply with the conditions for approval. It does not contain the “Non-Build Area” in the lot adjacent to our residence that the developer included as a concession - see attached Narrative. The Non-Build Area is 110’ in distance along our property line measured from the property corner of Lot 36 on the current plat (it was called Lot 80 in the Narrative). The Non-Build Area is equivalent to a setback and must be shown on the plat so that it can be enforced. Please do not allow the plat to be approved without this condition. And thank you, Alan for verifying the non-build will be provide. Just to clarify though, public hearing notices are not sent to property owners for final plats. Final Plats are placed on noticed agendas of the City Council, but there is no public hearing for final plats. Caleb C. A January 4 meeting did not happen. They have to complete a wildfire hazard plan before we will accept their application. When that happens, you will get notified. Hi Alan, We live at 3804 E. Vantage Pointe Lane, which is adjacent to the south border of the Skybreak development. We did not receive a notice for the January 4, 2022, hearing for the final plat, and as a result we did not provide comments at, or prior to, the meeting. However, we have a question on the final plat regarding the “Non-Build Area” (see attached Skybreak narrative) that the developer proposed on the lot adjacent to our property. The developer made this concession because he wanted a 15’ setback along our property line instead of the 30’ setback he provided on all other lots adjacent to Vantage Pointe subdivision. We understood this non-build area would be defined on the plat and recorded. However, we do not see it listed anywhere on the plat, site plan or other documents. We would like to get this omission corrected so that the non-build area can be enforced with any future construction on the lot – home, outbuilding, etc. How do we do accomplish that?
