Dear Bill,
We reviewed the email that you received from Mack Myers with Settlers Irrigation District ("SID") on
March 1, 2022. It appears that we have had some miscommunication with Mr. Myers. We are sending
this letter to clarify our discussions with him.
By way of background, in our initial discussions with Mr. Myers, he told us that SID would like us to tile
the Lemp Canal. Our original proposed irrigation plans were submitted to Mr. Myers on October 6, 2021,
and those plans did include tiling the Lemp Canal. Unfortunately, due to scheduling issues, we were
unable to meet to review the plans at that time. In the meantime, we discovered the following key items
and made the decision to propose leaving the canal open:
• ACHD stated that we could leave the canal in the ROW (See email from ACHD dated
11/4/21, Exhibit A).
• The ACHD CIP 2020 plan for widening McMillan and for the roundabout at the corner of
McMillan and Black Cat indicated ACHD would shift both the road and roundabout north
due to the Lemp Canal and power pole locations.
• Meridian Planning Staff had no opposition to our exemption from tiling request(See email
from Alan Tiefenbach dated November 16, 2021, Exhibit B).
• Due to the size of the Lemp Canal, adjacent developments have been permitted to leave the
Lemp Canal open.
We revised our plans to reflect the Lemp Canal remaining open and resubmitted those to Mr. Myers on
November 30, 2021. Between December 1, 2021 and January 5, 2022,there was a great deal of back-
and-forth regarding the plans between our civil engineering and construction teams and Mr. Myers. We
agreed to all of his requested changes.

On January 6, 2022, we received an email from Mr. Myers approving the Irrigation Plans with the Lemp
Canal remaining open and, on January 11, 2022,we entered into a License Agreement with SID that
reflected the same.
While there appears to have been some confusion as to when construction was approved to begin,we
worked with Mr. Myers to address his concerns. Since construction resumed we have been in regular
and constant communication with Mr. Myers and SID. We have onsite observation reports collected and
filed weekly with SID. We are also completing compaction testing and reporting regularly.
We have diligently attempted to communicate and coordinate this project with Mr. Myers. We
understand that he is very busy and has many projects to handle as the district manager; however,we
have been given a deadline within our SID License Agreement to complete all the work and any
communication delays are costly and put the entire project at risk.
We are open to working with SID on their request to modify the agreement, as we see a benefit to SID,
ACHD and our development. We will speak with them about relocating the canal to our property,
directly south of the power poles. Once the Lemp Canal is relocated,we could then dedicate additional
right-of-way to ACHD, which would create the opportunity for ACHD to widen McMillan on the south
side of the road.

We have been working with Settlers and Nampa Meridian Irrigation Districts in regard to their facilities located within the project site. Per your email below,you have requested relocating
the Irrigation laterals outside of the ACHD ROW. The attached exhibits indicate where the laterals are located within the ROW and where they are located outside of the proposed ROW's. We
have run into some issues relocation the Lemp Lateral outside of the McMillian ROW. Discussing the Lemp flows with Mack Myer,their delivery flow rate was only+/-16 cfs through this area,
he then stated that the storm water runoff from within the ACHD ROW increases the required flow rate to+/-28 CFS. Our analysis on conveying this peak flow rate would require a minimum
60-inch diameter pipe. We would like your consideration on allowing the Lemp lateral to remain in its current alignment along McMillian due to its size. This consideration is consistent with
the adjacent Bridgetower Subdivision(Volterra Heights Sub). We have no Issue with dedication addltional ROW to allow the Lemp Lateral to be relocated,but we feel that
the relocation of this major irrigation lateral should be completed jolntly with the future expansion of McMillin Road. This request Is due to the size of the lateral and the
addltional Intgation structures that would be required to relocate the alignment that was allowed through Bridgetower to the future alignment which would be outside of
ACHO's ROW.

We have reviewed your staff report on Jamestown Ranch Subdivision and agree with your findings
except for the following items:

The applicant proposes pavers on the local roads instead of standard pavement.The applicant
states pavers will not only help to alleviate sonic of the challenges associated with the high
groundwater present in the area,but will foster an exclusive and high-quality charm for Future
residents.ACHD is still discussing whether they will support this alternative.
ACHD has agreed to allow permeable pavers for all roads except for the collector.
Our plans have been updated accordingly.

The Cresson Lateral runs along the western property line paralleling W.McMillan Rd.and
connecting through the Quartet Subdivision to the south.The Lemp Canal adjoins with the
Cresson Lateral along the property's frontage adjacent to McMillan and continues to travel south
along Slack Cat Road.Both laterals will be piped per UDC 11-3A-6.Maintenance roads are
indicated along bath laterals.Coordination will be ongoing with the irrigation districts managing
the waterways to meet their requirements.
We would like to request an exemption from tiling the Lemp Canal along McMillan
Rd due to the size of this facility.The Lemp Canal would require at least a 60-inch
nine to contain it City Council has regularly granted waivers of the requirement to
the the Lemp Canal{see the neighboring Bridgetower West subdivision). In addition.
ACHD has confirmed that we will not be required to relocate the Lemp Lateral from
within their right-of-way,the Lemp will remain in its current position. For these
reasons,we are requesting that the Lemp Canal remain open along McMillan Rd.
