The aerial denotes the McBirney Lateral and the Watkins Drain, which, in contrast, is a relatively “dry” facility. Clearly an
“open” Watkins Drain amenity poses no threat to public safety.
Thus, we reaffirm our request for the City Council to waive the piping of the Watkins Drain per the P&Z Commission’s
recommendation for approval “as presented…with no modifications, but embrace of \[sic\] the applicant’s request to have
a waiver for the open waterway for the Watkins Drain.” \[P&Z Commission February 3, 2022 meeting minutes, Commissioner

In order for Council to waive the requirement for covering the drain, it has to find that the public purpose requiring such
will not be served & public safety can be preserved per UDC 11-3A-6B.3a. How do you propose to preserve public safety
if the waterway is left open?
If fencing isn’t proposed, it should be improved as a water amenity which requires construction drawings and relevant
calculations prepared by a qualified licensed professional registered in the State of Idaho are required to be submitted

to the Director and the authorized representative of the water facility for approval. The waterway/drain is required to
be improved as a part of the development, in which its banks in all places adjacent to and located on said development
are no steeper than one (1) foot vertical per every four (4) feet horizontally and which has a depth and velocity in all
places adjacent to and located on said development such that the product of the maximum depth (feet) multiplied by
the peak velocity (feet per second) does not exceed four (4).

Sonya, our only comment is regarding condition #7. We are requesting Council waiver to keep the Watkins Drain open in
order to provide an amenity feature.

attend in person or virtually via Zoom – the link/phone number to join the meeting is located at the top of the meeting

Please submit any written response you may have to the staff report to the City Clerk’s office
(cityclerk@meridiancity.org) and me as soon as possible. If you have a presentation you’d like to present at the public
